    Doing a month to month is no problem in Sacramento. Lots of renters to choose from. I don't want to be around anyone who doesn't want to live in the property. I'd rather have them go away ,I can get more money from somebody else. I'd like to here more good clauses if u got them. Thanx good video from Sacramento

    Sublet clause - including short term rental of any part of the property - I. E. Air BnB, VRBO, including garage space etc.

      @@winnieizcool Personally for me, If I allow for subletting in my units I will lay out rules to outline to the tenant to provide details of each person coming into the unit and how long they will be staying. I'll also make the tenant responsible for any damages to the property for each visitor.
      The advantage of allowing your unit to be subletted is the tenant has no invested interest to fight to stay in the property if they default on the rent because it's a business for them and it's not their primary residence and if they are producing an income off the unit they will more likely choose to become a longterm tenant.

    month to month lease works great for me.. I can get them out easier if I need to... that is fine if they leave because I can usually find a decent renter with in a month. The area I live has a great demand for affordable housing

    Renting out your house is always a gamble. You can draft the most bullet proof rental agreement and be very thorough screening potential renters and still get the renter from hell. Do the best you can and cross your fingers or say a few prayers if you're so inclined you get a responsible renter. Good luck!

      And a landlord can let in a British Gas engine whilst your on holiday. And fit smart meters against your wish and two months later cos your annoyed serve a section 21 no fault eviction order on you cos she feel’s intimidated that she broke into your home without your express permission.

    I had one landlord who would provoke child molestation and mass shootings with door slammers abd Alabama farmers abd Bessemer people who forge leases renters signatures and they misuse their identities. To get extra section 8 money in some cases. I have no evictions in my background record.

      It's probably a good idea to consult a CPA or attorney who can advise you on the best plan for your specific situation. LLCs are good ideas and provide extra protection for you but I'm not a legal advisor or accountant which is why I suggest talking with those professionals. Same advice I would give my clients.

      Eric Hernandez I would stick with a straight lease. Lease options don’t always work well in my opinion and if a tenant is interested in purchasing the property then you can determine a fair market value at that time and move forward with the sale. We’ve done that with many of the properties we manage where the tenant wanted to purchase it and we made the deal work. Sorry I missed your reply while back!

    Month to month leases is better because it protects the landlord against tenents that are not responsible with their contract.

    Question: our place is usually booked through Airbnb but we have our first tenant coming off of Furnished Finder. We’ll be blocking the dates of his stay so how do we enforce a cancellation fee if they were to back out a week before? We can’t afford to block those dates and then have to open them back up.     I was wondering if you could answer a question for me? I lived in a house this year with girls that made me feel unwelcomed and I was going to sign with them again but changed my mind and now want to get out of the lease. I signed the lease but one of the terms of the lease is your have a parent co-sign and notarize it and send it back to the landlord. Well neither of my parents have signed as co-signers or notarized it and they haven’t sent it to him. So basically our copy would be the copy to have all the signatures(aka the official copy). Since my parents never signed the lease would that make my lease not complete and voidable?

      If your 18 or over anything you sign is a contractually obligation. They could have overlooked a parent if they figured you were a good person. Just my 2 cents.

      Brian Devillier Glad the video was helpful. I’m not an attorney but here’s what I would suggest... Basically what you can do is find the standard lease that is used by your local real estate board. In Northern Virginia we have the Northern Virginia Association of Realtors. Likewise in your location there should be a similar association and you should be able to get a free copy of the standard lease. You can use this as the baseline and make the modifications with simple clear language with the clauses you want to add if they are not already included in the base lease. However if you start from scratch or just get a lease off the Internet I would recommend having an attorney at least review the lease to make sure it complies with your state and local laws. It can never hurt to spend a little money and have an attorney review such an important document. It will be money well spent.

    Why is it that the agreement (between two entities) spells out what's required from the tenant but it never says what's required of the landlord /mgmt company?
    Like if you do this for me (or us) we promise to provide:
    - timely repairs to your performing "unit of production" (with in this time limit)
    - Timely repairs to the building - especially when it affects building safety and security
    - Heat and hot water

    I live in PA and am a renter. I had a 2 year lease and when the lease ended, my landlords were more than happy to give me a lease renewal for 3 years. After only 5 months into the lease, my landlord gives me a 30 notice that the rent is going up $150.00. Is this legal?

      Every lease is different but if you signed a renewal for 3 years at an agreed upon rental rate, then they can't randomly just raise the rent mid lease. However, I don't know the details of your lease so read through it carefully. Did you sign a lease renewal document stating the exact terms of the renewal?

      One.more question. ...do states rental rights (?) Supperceed the rights stated in these generic rental forms that are easily downloaded? I.live in PA and the minimal research I've done says these generic rental.forms do not hold weight against states' rental laws

      @@michaelokeefe8709 Good idea to contact someone to represent you who knows your state and local laws. The bottom line is that in every lease agreement, what's in it must hold up in a court. So I could write all kinds of nonsense into a lease and someone could sign it but at the end of the day, if it went to court, it wouldn't hold up if it didn't comply with the laws. Does that make sense? Of course I don't know your lease but I think you should have a good case. I know it's frustrating and time consuming to go through all this hassle but you'll learn something too in the process. Good luck with it!

      Early Termination Fee, equals to what ever is allowed or legal in your area.

    Question: I was approved for a new home rental, gave my deposit and signed a contract with the Landlord, 4 days before my move in date Landlord calls me says his currant tenants changed their mind about moving and dont want to move anymore! What can i do??

      Randy Meza That’s a tough situation! In all reality it’s very unlikely that the current tenant will move or that they can be forced out. I think the first thing I would do is to talk with that landlord and ask for compensation for any money that you might lose as a result of him backing out of the deal. Technically you have a legal contract and the landlord is not living up to their end of the contract. If you lost money because you had to hire movers or rent a truck or whatever or any money you have to spend now because you have to rent a temporary place can be factored in and you can ask the landlord for that as compensation. You can’t really ask for money as compensation for inconvenience but for actual money lost I would start there. If that doesn’t go anywhere then you might want to just have a conversation with a local attorney who can give you some advice on other things you could do. If it’s a smaller amount you may consider going to small claims court and seeking damages that way. Seems like the landlord would have known more than four days before the lease ended and notified you. Sorry you’re in that situation but hopefully you’ll find another place soon!

      It depends on what state you're in and your local laws, but all states will have a required notice period for changes to the lease terms. In Virginia, if there is no written lease then a 30 day notice is the custom. I'd recommend checking with an attorney or legal advisor for your rights in your area. Many counties and cities also have public service departments that can help with consumer affairs and tenant services.

      My lease had an 8% rent escalation clause, and other landlords thought that was too high and tenants wouldn’t agree - but I never had an issue with tenants agreeing to that.
      Today, I think that 8% is too low - the rate of inflation for the past twelve months exceeded that 8%. I will be using language that will pick the greater of 10% or the CPI rate of inflation for the previous twelve months - just because prices are going up that drastically.
      Double rent is typically used for “holdover” tenants who weren’t given a lease renewal but instead were told their lease was ending but they didn’t leave.

      Either way can be used, but make sure the laws in that jurisdiction support the method you use.
      In my case, I have an initial flat fee for late rent, and if a certain number of additional days pass without payment another flat fee is added on.
      So there are many ways to do this.

      My tenants have paid late fees when they have been late, and I expect them to do so or be asked to move (and be evicted).

    Here's one: Renter hereby agrees and acknowledges the deposit and/or rent paid will not be refunded if he is unable to move in as agreed. Rent paid is not refundable if renter moves out early.

    As a tenant their is no way in hell I would sign a paper stating that I agree to be responsible for my roommates (another tenant) rent AND actions. I am not his/her owner, I can not force them to go to work, write the rent check, not get a pet, not smoke in the apartment (especially when I am not even home) ect. I am not their babysitter, their mother, or their personal financial manager! I have a life too! Why should I get evicted and have an eviction record because my roommate who is an ADULT! decided to either not pay the rent or break the lease! Anyone who agrees to sign that is either desperate and out of options or unaware of the (potential) consequences of agreeing to such terms.

      You have probably signed a lease just like that already; “joint and several” is common language in leases.
      You might not have understood that meaning, or may not have paid close enough attention to the lease when signing it …
      You have hit upon the very reasoning as to why your choice of roommates is important. If you choose some scoundrel as a roommate, that is not going to go well. So choose wisely.

    I would like to know if the fair housing act discriminates against all people regarding the ability to get and maintain safe affordable housing. People are being priced out of safe and affordable housing daily. It should not be the right of a landlord to be able to raise the rent at the beginning of every lease. I believe this is overall violating ALL people's rights to fair safe and affordable housing. The literal interpretation of safe fair and affordable housing should be available to all and not be subject to constant rent increases that are designated as allowable in the fair housing act. In summation, landlords are raising rents and effectively putting people at risk of being homeless. The people who are at risk are the people 'designed' to be protected by this act.
