If a court issues an order, *every one* - with no exceptions - are bound by it. That is the point.
If I had a salary deduction for Housing Levy after the courts declared it to be illegal, my employer has broken the law.
It matters not what KRA has said, has done or wants to do... (they will be falling foul of the law as well).
But the focus here is on my employer... who should have ceased deductions at once.
