You can fight and win against a valid ticket. If the law contains any ambiguity or is poorly defined then you can get it thrown out because not every officer would have the same definition for it and while that officer gave a ticket another might not have.

This is a clear cut case of a DNR officer on a slow day having to flex on someone. Go to court and a Judge will dismiss quickly. Tell them its the Ice or the local Walmart parking lot!

@Duner250R if your vehicle does go through the ice up here in Minnesota there are fines every day your vehicle is in the water but it happens all the time and there are companies that specialize in pulling cars, trucks, snowmobiles, ice house you name it out of frozen lakes.

Some places treat ice like roads, some don't, in Michigan you can get tickets on the ice, but they are like a boat ticket. You can get that dropped if you tell the magistrate what you were doing, and that you had the area clearly marked and there was nobody near you for 5 miles. (Ask for defective equipment as a secondary defense)

Cops use social media to catch people doing all kinds of shit, from dealing drugs to selling stolen merchandise. To the law, posting on social media is no different than buying an ad in the local paper. If a cop saw an ad in the news about an illegal street racing, they would have every right to go there and bust the racers. However, this was a DNR officer not local or state PD, so he cannot issue a roadway violation anyways. They probably got some kind of park violation for misuse of the facilities without proper permits or something stupid like that. Thing's like that in my area are usually civil fines under $100, no marks on criminal or driving records.
Perfect example of being officious. They obviously closed off what they were doing and being as careful as possible to not hurt anyone. That officer just got them on a technicality just because he can on a whim. People who strive to be in positions of power just to put the hammer down on trivial things don’t deserve those positions.
It's actually not even a technicality, the officer is actually wrong. They were off-roading on public water, on a temporary track of their own creation. It's not illegal to practice off-road driving maneuvers off-road or on private roadways in Canada. Furthermore, their track is a temporary track on a temporary sruface, so they have not caused any damage to any kind of public property. Their clearing of snow is analagous to clearing snow off a lake for a hockey rink and less damaging to the surface than drilling a bunch of holes for a village of ice fishing huts. But even then it's a self regenerating, temporary surface. This was the safest way for them to practice these driving techniques that they could have thought of. The officer is wrong.

It's general public health and safety. It's also putting a stop to something before the worst happens. This is the issue with humanity at the moment, noone thinks. What if any of them went through the ice, what if any of them did so and then were trapped? Who would be pulling the body out, his friends, or him? I've heard enough horror stories from officers and other emergency workers to know that, even if it's an extremely low chance, doesn't make it a certainty not to happen. But let's put it this way: Put yourself in his shoes. How would you feel if they weren't talked too, and then all of a sudden, they've gone under? And you KNEW you could've stopped it from happening?

This has happened to me. I was boofin around on the ice. Some ice shack karen called the cops. I was already off the ice and parked at a friend's house down the road. The cop had to drive around and look for a vehicle that fit my description and then have me a ticket for reckless driving. Took it to court, cop didn't show ofc cuz they never do and it was dropped.
cops have different dates they can schedule your court date. Some they plan on not showing up and everyone gets off. Other dates they plan on getting convictions and they show up.
Yup unless you even admitted to being on the ice he didn't witness it so that ticket wouldn't stick at all. The witness would have to show to court, in fact why did you show to court. In stuff like this call the DA's office directly and talk to them. They will usually take a look and drop the case, they too don't want more on the docket then needs to be. I just did that for a speeding citation I receive din another State, DA's office was awesome they just wanted the money and I knew it and they were like yeah just pay us now over the phone and it's done...okay. Play the game, I called and made a court date 3 months out. A week before I called and postponed it, another month out, then I called a week before again and talked to the clerk gal who was nice and gave me the DA's number and they were willing to just have me pay and drop it. Done...LOL

Having been in Law Enforcement years ago, I think this DNR Officer is really splitting hairs. Clearly, there was no risk to other members of the public (I could not see anyone else there) & it appears to be a fairly remote location. I would much rather see you guys doing this stuff out & away from the public (ie. not doing it on the streets or parking lots). We always worked with something called "Officer Discretion" & he does not really appear to be doing so. Yes, he could cite operational violations & maybe some others for "risk to the public" - but seriously, it just is not worth it - he needs to learn to pick his battles & this should not be one. Now, if there were others in the area ice fishing, etc and it was risking their safety or disturbing them (ie. he got a complaint), that would be different. Personally, I would just tell you to watch the ice thickness & if others showed up to ice fish, I would ask you to shut it down. Until then, have fun & stay safe! By the way - I don't know how the guy in the quad didn't toss his cookies after doing that wild donut spin! Crazy (cool too lol). Wishing you all a safe & Merry Christmas!

A road citation in the middle of a lake? I'd definitely fight that one in court. Minus being on 2 wheels, it looked to me like you guys did everything possible to ensure a safe environment to screw around on the ice.
In the UK road traffic laws apply to anywhere with public access, so places like supermarket car parks or open spaces are still covered. Land has to be private with restricted access if you want to do your thing, I suspect most first world countries have similar legislation.

If the car crashes through the ice it creates a ton of pollution, and it will endanger any recovery team that has to now pull the wrecked car and your dead body out from under the ice that’s obviously thin enough for vehicles and recovery equipment to crash through. If they wait till it melts then it leaks a lot of oil and gas into the environment, and if they still want to pull it out they now have to use a barge and crane, or at the very least have a scuba diver recover the body… There are other reasons why it may be illegal to drive like that on the lake too. It definitely has consequences for more than just yourself if something goes wrong. Expensive, a waste of time, and dangerous for everyone involved in the situation. The officer has discretion but there are indeed a few legitimate reasons why driving on a lake like this can cause issues for more people than just yourselves. There are designated ice racing lakes for a reason, since they’re known to be thick enough to not be dangerous and they sometimes even have standby recovery equipment for sunken cars.

Also, not every frozen lake can be driven on… again, even if the ice seems thick there can be thin spots on some lakes which is the reason why some lakes are not allowed to be driven on. I disagree that you can drive on frozen lakes in most places because that’s literally not true. Most places don’t get ice thick enough to reliably support vehicles. People illegally drive trucks on the lake where I live and there’s always a couple of them that go into the water and require very expensive and dangerous recovery, exactly as I said. Even in the coldest part of where I live only some high up lakes can legally be driven on because not all get enough ice to support a vehicle, and I live in a pretty cold place overall… definitely colder than most places in the USA

Some places treat ice like roads, some don't, in Michigan you can get tickets on the ice, but they are like a boat ticket. You can get that dropped if you tell the magistrate what you were doing, and that you had the area clearly marked and there was nobody near you for 5 miles. (Ask for defective equipment as a secondary defense)

Cops use social media to catch people doing all kinds of shit, from dealing drugs to selling stolen merchandise. To the law, posting on social media is no different than buying an ad in the local paper. If a cop saw an ad in the news about an illegal street racing, they would have every right to go there and bust the racers.
However, this was a DNR officer not local or state PD, so he cannot issue a roadway violation anyways. They probably got some kind of park violation for misuse of the facilities without proper permits or something stupid like that. Thing's like that in my area are usually civil fines under $100, no marks on criminal or driving records.

It's actually not even a technicality, the officer is actually wrong.
They were off-roading on public water, on a temporary track of their own creation.
It's not illegal to practice off-road driving maneuvers off-road or on private roadways in Canada. Furthermore, their track is a temporary track on a temporary sruface, so they have not caused any damage to any kind of public property.
Their clearing of snow is analagous to clearing snow off a lake for a hockey rink and less damaging to the surface than drilling a bunch of holes for a village of ice fishing huts. But even then it's a self regenerating, temporary surface.
This was the safest way for them to practice these driving techniques that they could have thought of.

the problem with "reckless driving" is that it's very much a subjective law. I see reckless assholes all the time on the road, but these kids who are on a literal lake doing this removed from society on a clearly laid out track with miles of visibility to see anyone approaching somehow being reckless driving rubs me the wrong way.

This has happened to me. I was boofin around on the ice. Some ice shack karen called the cops. I was already off the ice and parked at a friend's house down the road. The cop had to drive around and look for a vehicle that fit my description and then have me a ticket for reckless driving. Took it to court, cop didn't show ofc cuz they never do and it was dropped.
cops have different dates they can schedule your court date. Some they plan on not showing up and everyone gets off. Other dates they plan on getting convictions and they show up.

Yup unless you even admitted to being on the ice he didn't witness it so that ticket wouldn't stick at all. The witness would have to show to court, in fact why did you show to court. In stuff like this call the DA's office directly and talk to them. They will usually take a look and drop the case, they too don't want more on the docket then needs to be. I just did that for a speeding citation I receive din another State, DA's office was awesome they just wanted the money and I knew it and they were like yeah just pay us now over the phone and it's done...okay. Play the game, I called and made a court date 3 months out. A week before I called and postponed it, another month out, then I called a week before again and talked to the clerk gal who was nice and gave me the DA's number and they were willing to just have me pay and drop it. Done...LOL

Having been in Law Enforcement years ago, I think this DNR Officer is really splitting hairs. Clearly, there was no risk to other members of the public (I could not see anyone else there) & it appears to be a fairly remote location. I would much rather see you guys doing this stuff out & away from the public (ie. not doing it on the streets or parking lots). We always worked with something called "Officer Discretion" & he does not really appear to be doing so. Yes, he could cite operational violations & maybe some others for "risk to the public" - but seriously, it just is not worth it - he needs to learn to pick his battles & this should not be one. Now, if there were others in the area ice fishing, etc and it was risking their safety or disturbing them (ie. he got a complaint), that would be different.
Personally, I would just tell you to watch the ice thickness & if others showed up to ice fish, I would ask you to shut it down. Until then, have fun & stay safe!

A road citation in the middle of a lake? I'd definitely fight that one in court. Minus being on 2 wheels, it looked to me like you guys did everything possible to ensure a safe environment to screw around on the ice.
In the UK road traffic laws apply to anywhere with public access, so places like supermarket car parks or open spaces are still covered. Land has to be private with restricted access if you want to do your thing, I suspect most first world countries have similar legislation.

If the car crashes through the ice it creates a ton of pollution, and it will endanger any recovery team that has to now pull the wrecked car and your dead body out from under the ice that’s obviously thin enough for vehicles and recovery equipment to crash through. If they wait till it melts then it leaks a lot of oil and gas into the environment, and if they still want to pull it out they now have to use a barge and crane, or at the very least have a scuba diver recover the body…
There are other reasons why it may be illegal to drive like that on the lake too.
It definitely has consequences for more than just yourself if something goes wrong. Expensive, a waste of time, and dangerous for everyone involved in the situation.
The officer has discretion but there are indeed a few legitimate reasons why driving on a lake like this can cause issues for more people than just yourselves.
There are designated ice racing lakes for a reason, since they’re known to be thick enough to not be dangerous and they sometimes even have standby recovery equipment for sunken cars.

Also, not every frozen lake can be driven on… again, even if the ice seems thick there can be thin spots on some lakes which is the reason why some lakes are not allowed to be driven on.

People illegally drive trucks on the lake where I live and there’s always a couple of them that go into the water and require very expensive and dangerous recovery, exactly as I said.
Even in the coldest part of where I live only some high up lakes can legally be driven on because not all get enough ice to support a vehicle, and I live in a pretty cold place overall… definitely colder than most places in the USA

Get lawyer and I would have that officer charged with over policing (as he admitted to basically stalking you online) and file for a restraining order so that if he feels the urge to ticket you again he cannot come anywhere near you.
