. - (1) Subject to exceptions under these rules, thismethod shall be used for procurement of goods of estimated value of Rs. 10 lacs (tenlacs rupees) and above or such limit as may be prescribed. Advertisement in suchcases shall be given in the Official Gazette of Himachal Pradesh and at least in twoleading daily news papers having wide circulation

shall be adopted whenestimated value of the goods to be procured is upto Rs. 10 lacs (ten lacs rupees) orsuch limit as may be prescribed. Preference shall be given to the supplier having depot or dumps within the territory of Himachal Pradesh. Copies of the tender documents shall be sent directly by speed post or registered post or courier or e-mailto the firms dealing in required goods to obtain more responsive bids on competitive basis. The number of firms in Limited Tender System shall not be less than three Performance Security
. - (1) Performance Security shall be obtained from the successful contractor on the award of the contract irrespective of his registration status, which shall be for an amount between five to ten percent of the value of the contract.
Efficiency, Economy and Accountability in Procurement System. -
To ensure efficiency, economy and accountability in the procurement system, the following factors shall be taken into account:-(a) for avoiding delay, appropriate time frame for each stage of procurement shall be specified by the Department
;
(b) for minimizing the time needed for decision making and implementation of contract, the Department shall act as per delegation of financial powers as may be prescribed
;
and(c) the Department shall award the contract within the validity period stipulated inthe tender documents; provided that extension in time period in the validity period may be allowed by the Competent Authority only in exceptional circumstances for which reasons shall be recorded in writing.

Buy Back Offer. -
The Department may decide with the approval of the CompetentAuthority to replace existing old goods with new goods of better version from thecontactor by adjusting the cost of existing old goods as per mutual agreement forwhich a clause shall be inserted in the tender documents in the prescribed manner.

Under rule 98 of hpfr local purchase committee notified by HOD& purchase committee has already been constituted by FD in which SAS officer is mandatory a member
