    As a former car salesman, this type of crap makes me furious. I believe that when you are found guilty of fraud like this, then you should not only have to pay a fine, but also go to jail and even either lose their business license and not be able to ever own or operate a business like this, or at least be shut down for a set amount of time. This can not be the first and only time this stealership has done this sort of thing.

    that is another dealer trick: salesperson commits fraud, manager acts like the salesperson was some cat that just walked into their dealership and sold a car to you. It's THEIR employee-they need to own this mess!

      I am convinced this is why dealership turnover is so high. Salespeople disappear from one store and show up at the place next door a day later. Many of them seem to be transient - and it allows management to say, "That person no longer works here."

      @@stevelehto "But he worked here when he misbehaved, so it's still on you." I ran into that with a repair. They needed to remove the passenger door panel, I forget why, but after the repair I noticed a new noise. It sounded like a screwdriver or similar in the door, rolling when I went around a turn. So I returned to the dealership and explained the problem. The service manager first tried to argue that I was imagining it, then that it was just the hinge. I finally convinced him to have someone open up the panel and look. He told me it turned out to be a screwdriver left behind by a tech. "He no longer works here". I was more annoyed at the service manager, for being so adamant and unhelpful, than at a simple mistake by the tech.

      @@stevelehto,Sometimes it is. It is a 2 sided coin though. It's typically one of the following... either the salesperson messes up and the management catches them and fires them and they leave, or they are decent ppl and see that either another salesperson or manager is not a good person, and they leave.
      I was working at a dealership for about a year, and had been selling quite well. Overall sales started slipping for 3 months, so the owner fired the General Manager and hired a new one. This guy brought in a new desk manager and closers and I few salesmen. About a week later, I started noticing too many consistent negative issues happening within this new team. So I had a conversation with the GM. He said that's how things happen on his team and if I don't like it, I can hit the street. So I had lunch with the owner and let him know what was going on, and that he should be aware or, more importantly, get another team in to run the dealership.
      Unfortunately he didn't say anything or do anything, so a few days later after I still saw and heard the same crap happening, I packed my stuff and left.
      A few hours later I was seting up my desk at another dealership a few blocks down the road. When you can sell well over 20 - 25 cars every month, you can do that. But in reality, most dealerships will give a lot of people a chance.
      Another reason for high turnover is that we just don't get along with the other ales staff, or aren't selling enough cars.

    I bought a truck from a business and asked three times to see the title, each time I was told that they were still looking for it on the forth trip there when I had the money in hand they were able to find the title just before closing and rushed to get the paperwork done before closing. When I got home I took a good look at the title and found rebuilt on it. I tracked the owner of the business to his home address on Sunday and knocked on his door and confronted him about the title and that he had not disclosed the fact that the truck had been rebuilt. He got upset at me for coming to his house and started calling me all types of words and after he finished I told him I wanted my money back and him using all types of foul language did not change what he did.At which he said that a refund would never happen. I informed him my next move was to call the local TV station and see if they would take my cause up on their news cast, if not I would fill a complant with the State AG. I left and by the time I got home he called and told me that he would refund my money if I did not call the TV station. Some business try to intimidate you with foul language when they get caught trying to scam you. Keep your cool and remember if they just tried to scam you that you were more than likly not the first by them, report them.

    I would think the most compelling argument was that the dealership did not provide a marketable title so she could register the vehicle. Isn't that mandatory for any car sale??

      @@nocalsteve That transaction was rescinded by the dealer. Maybe if the judge believes they told her she could only trade it for the 2nd vehicle it might have some importance.
      What won the case for her was the salesman writing AS IS on the contract of the second vehicle after she signed it.
      If the AS IS had been on the 2nd vehicle contract before she signed it she may still be out of luck today.

    I bought a used car from Texas from a dealer..I live in Indiana...pictures looked great! The dealer I spoke to claimed it was in perfect condition..I told him I would drive down and check it out and drive it back. I really wanted this car! He convinced me he could ship really cheap and I went for it.😪😪😪 Turns out the car was nothing as described. Never again will I buy a car without test driving it first. Lesson was hard learned!!

      There are companies that will do a PPI for you in other cities. As they are paid by you, they are looking out for your interest.

    When dealing with private parties your ignorance can be a big problem, but being stupid shouldn't be an excuse for a dealership to take advantage of a customer, being that you deal cars exclusively you should hold yourself to a high standard that any business does it's called ethics all businesses should use them not just selective ones.

    In denmark consumer law state that "as is" or "as seen" etc dont carry any legal meaning. You are not able to sign anything to remove/lose your basic rights as a consumer.

      That's true in the US, as well. But, most states have very little consumer protections, for used cars. If the seller doesn't get recorded knowingly lying about something, you're usually screwed. But generally, knowing the issues for the car, especially after giving it a test drive, is a good way to negotiate the price down.
      If you're not up to dealing with the car's problems, there are dealers that guarantee them to be in decent shape. But, their prices are higher.

    In my state there is a "warrantee of merchantability" for any licensed dealer or vendor. An item must function as intended. A car dealer is, by definition, selling cars that run for at least a reasonable amount of time. A car which looks great and starts and runs around the block, but dies a week later is the responsibility of the dealer to reconcile with the purchaser.

    I have lived in Arkansas since 1980, and trust me it is more common than you might think to have a fifth point when you actually say you have four points. I even bought a brand new truck from a dealer (early 90's) and 3 days later the brakes quit working. They insisted that I needed to DRIVE the vehicle in for service, even though I explained to them multiple times that I had NO brakes! I actually had to call Dodge corporate and file a complaint to get the dealership to send a tow truck to take my vehicle in to fix the brakes. Needless to say, I never purchased another vehicle at that dealership.

    I have bought several vehicles from the same person at my local dealership. When they are in the low-price category, he simply chooses a likely candidate at the dealer auctions and buys it if the price is reasonable. It then gets inspected for registration and insurance purposes, and any glaring problems are identified. At this point I can take the car for what they paid plus some extra for their trouble, or they put it into their inventory. All the papers are legit, and he usually picks something that he can get some background on. No dogs so far, and I get affordable wheels. He knows that if he gets creative, it will come back on him in a big way, so he’s the sort of guy who keeps it simple and clean, and moves a lot of units in a year. I imagine he sleeps well most nights, and he does okay money-wise. He will tell you what they paid for a vehicle if you ask him, and if you have something they need, they make it worth your while. I never understand why some idiots don’t see this as a better way to run things.

    I’m a BHPH dealer in SC and retiring this year. We have a specific buyers guide they have to sign and we can’t sell a car without a test drive unless they sign a non-operational disclaimer or are buying a scrap car, etc…
    That’s just shady from day one? For us they had to run if we expected payments to keep coming in!

      Ive worked for 3 GM dealerships. 2 were totally honest, would bend over backwards make and keep u happy. 1 was just a nest of thieves. Cheated the factory the employees and anyone who they could. I didnt last long there.

      @@eugeneferguson301 Ditto. Worked at both a Ford and a GM dealership. Great stores that did what they could for their customers and I buy from them even after leaving.
      Story swap? : Craziest story was a woman came in raising hell because she bought a POS and demanded we make it right. They refinanced her trade which she was upside down in it adding it to the new vehicle on a 6 year loan. Within months it broke down and she was demanding we take care of it.
      Here is the crazy. It was not only out of warranty by mileage and time she bought it from another unrelated dealer. The dealer she bought it from was even in another state and different franchise. But since we were a GM dealer it was our responsibility to make it right. She was never a customer of ours before this as she refused to buy local. Our first introduction was a car being towed in and this whole situation.

      Actually dealerships are the easiest to collect from because even if they refuse and you have to get an enforcement order, the vehicles are seizable to cover the debt.

      In cases like this where there is something to collect (the party has money) it's very easy, if they delay it will only take slightly longer, maybe 2 more weeks for the writ of execution.
      It's actually kinda worth it when the police officer starts physically removing their property to sell it at auction.
      It's amazing how fast attitudes adjust in that moment

      there are good dealerships. its not the normal, but there are good ones. I was very happy with the dealer I used when I bought my wife's Saturn. I ended up buy 4 more cars from them over the years. it was one of the best car buying experiences I have ever had, until GM killed off Saturn. the GM dealer that took over is horrible, I was looking at a small truck (Diesel Colorado), could not get them to even let me take a test drive in one. not a good customer experience, and I ended up walking away and going to the Jeep Dealer next door and bought me another Wrangler. the Dealer I bought my Jeep from has also been good. I have had to haggle price with them, cause they like to mark the price up a lot, but in general they have treated me well. I have bought my last 3 Jeeps through them. my last buying experience with them was a great no haggle experience (they probably had a not this guy again moment). when I get ready to trade this one in, I will use them again.

      Well. To be fair even better quality dealerships will try to get away with as much as they can. But there is a difference between pure predatory destructive behaviour and pushy annoying sales tactics.
      Going to the dealerships definitely a step stone in adult hood. Its capitalism. You have a choice as a consumer. You dont have to buy.
      This client has self esteem issues that make predators pounce and take advantage immediately.
      I like to drive the dealerships crazy :). Just keep dragging it out and keep being annoying. Hand it right back at them.

    I used to do mobile paint work for dealerships. The particular dealer I was at on this day, is known locally for selling junk cars. They sold this gal a pontiac grand am, and the brakes locked up before she had made it off the lot. Overheard the sales manager arguing with the service manager that they weren't going to fix it. I gotta hand it to the service manager, because he ripped the sales guy a new ass for refusing to let him fix the car. Service manager did convince the salesman eventually, and the car was fixed.

      I do pdr for dealerships. I’ve seen some crazy stuff. Working one day, the dealer had a caravan that was four different colors. The customer test drove it with just the salesman. He bought it. Then when the new owner, wife, and child came out to get in, the rear door fell off! As is, is just that. That’s what the dealer told em. I knew from that point on, I’d be gouging the shit out of em.

    Because this happened in Arkansas, it reminded me of a conversation I overheard in a used car dealership in Michigan.
    The buyer of a car inquired of the salesman if the car he bought had a guarantee? The salesman said the car has an Arkansas guarantee.
    "When you drive away from here, if your car breaks in half in the middle of the road, you own both halves!"

    As a dealer I am amazed how many customers tell me they bought a car sight unseen...and it was a POS. It stuns me. My entire sales pitch is "It's an old truck, here's the keys, go drive it, have it inspected and buy it or don't." I also make sure they understand AS-IS really does mean AS-IS(although I give them 72 hours automatic buy-back...though I don't tell people because there are people who really will break them deliberately). As for paperwork, either it's good and the car can be titled or the dealer owns it and you give the customer their money back...in EVERY state.

    I had a small car dealer put me on his license and i bought and paid for a van and come to find out HE took and sold it without giving me a DIME. I sent a long letter to the DMV and they fined him $150 for each car he put out for ''curb selling'' - not selling on his lot but putting cars ain front of a grocery store AND made him give me my money back. IF HE gets too many complaints they will take his license

    I had a used car dealership in MA & we were not allowed to sell as/is. Some dealers still wrote as/is on the sales contract (as a diversion method) but technically in court that wouldn't stand. If I want real "as/is" sale I would write "The vehicle being sold is not road-worthy in its current condition & will not pass state inspection. buyer agrees to perform all repairs necessary to the vehicle at their expense prior to operating on a public way or submitting application for registration".

    First mistake the buyer made "saw the car advertised on Facebook" and inquired. Second agreed you never sign anything without having the darn thing inspected by another party. They absolutely will take your money and not give it back.

      I've owned 3 Hyundai's. Never had a single problem with any of them. My neighbors Dodges are in the shop having something fixed at least once a month. Which is no surprise to me after working as a tech at a Chrysler-Jeep dealership.

      first its not a person its the dealership being sued. It may be a felony over a particular amount of money etc , dealership wasn't charged with a crime they were sued in Civil Court. No felonies in Civil Court that I am aware of.

    Steve, I know you know this but the trend, which is accelerated with the pandemic, is to purchase cars remotely without personally seeing OR test driving it let alone having it inspected. I, like you, thinks this is absurdly crazy but it is being done thousands of times/day.
    Likewise, three years ago I was in the market for a second home in Florida. My wife and I went to Florida, contacted a realtor and was hoping to find something to purchase during the time in the state. Unfortunately, we did not. The realtor continued to send us listings. Seeing one we were interested in, I contacted her (we have permanent home in Michigan) and she asked if I wanted to put an offer on it. She said I would have a certain amount of time to have an inspection done to either confirm or rescind the offer. I said I couldn't fly down within that time frame and she kind of chuckled and said;"oh, you don't need to see the home in person." I said, oh, yes I do! She said a lot of out-of-staters buy a home sight unseen! I told her that may be true but will not happen with me. I couldn't believe it but now down in Florida, sure enough a lot of homes are sold without the buyer even laying eyes on it. And, I learned that certified home inspections are less than comprehensive and, in some cases, accurate and true. Even though I saw the home we eventually bought and looked things over I had a certified home inspector inspect the home. Oh, I got an impressive 12 page report with this and that on it. There were a couple little things like two locations needing ground fault receptacles but everything else was in very good condition. NOT! Within the first year we had a roof leak that had been going on for some time as part of the wall and floor had rotted out due to the chronic water infiltration. This was a very costly repair. Then we found a couple other "soft" spots in the floor that needed torn up and repaired. More mess and costly repair. The second year of ownership the central AC unit needed replacing for $5500. I contacted an attorney in regards to the home inspector and he had so many protective clauses in the contract my attorney said he basically was not liable for anything in the contract!!
    I can't believe people make major purchases without personally seeing what they are spending thousands and thousands of dollars on.

    I knew of a used car dealer that I did business with. he had advertised a Taurus he claimed ran good engine wise. never made claim to anything else about the car. guy came over and started the car and the engine ran fine. guy bought the car and when he drove off, the trans slipped badly. since the seller never made claim that the trans worked or not, he was stuck with the vehicle.

    Never buy As seen unless you know what you're buying! I was buying a £40,000 , $ 60,000 Motorhome two years ago and on reading the Sales Slip it clearly stated As Seen??? There was no mention of this during any conversation leading upto the sale? The sale stopped immediately! I took this to be a con, and that the seller hoped I hadn't seen the sales slip? Be careful out there!

    When I was around 18 in the 70s (Arkansas) I let some slick used car dealer con me into a down payment + 1st month's payment without having driven the car. After payment, he refused to give me the car saying he would have to move other cars around first and that might take a week. I demanded my money back - and he refused. I was clueless what to do next and went to the police station. Fortunately, a desk officer told me they knew who the guy was and instructed me to inform the car dealer that legally I had 3 business days to back out of ANY business deal. And I did. To which he laughed it off and scoffed, "Who told you that nonsense?" - to which I replied - "The police." His jaw dropped! And he started to hem and haw and plot and "Just a minute young man, I can work a deal with you.." - which I refused his yammering - demanded and got me money back. Turned out the man was my landlord's brother! Even he said., "Yeah - that's no surprise. I wish you would have talked to me first. I coulda told y9ou my brother was a crook.".

    There used to be a small car dealer here in town, who by all accounts was very honest but the shut downs early in the pandemic put him out of business. We got two cars from him. He straight up told us that we may have to do some small repairs on the cars because they are used but that we would not find anything major wrong with them. The transmission and engine, drive train, etc were all good.
    We bought the cars at separate times. Each time, we took the vehicle to the mechanic for a thorough inspection. The Toyota just needed some hoses replaced and its been running like a dream for the past 4 years or so. I would not be afraid to take it cross country alone.
    The Chevy was obtained a year later and was found to be in excellent condition by the mechanic. He just suggested a coolant flush and a year later, we had to replace tire sensors but otherwise very good cars. And many people spoke well of him. I hate that he closed down and am hoping that he didn't go out of business due to death.
    I had visited a few other used dealer lots before going to this guy the first time but the others did not want our mechanic to look it over. One even told me no because "mechanics always find something wrong when there is nothing wrong." Red flags went up with him because I was thinking, what's wrong with your vehicles that you do not want a mechanic to find.
    When purchasing a used vehicle that is 10 plus years old, I fully expected to have to do some minor repairs and maintenance on the vehicle. What I was wanting a mechanic to look for are things that would be very costly like engine and transmission issues, or a slipping timing belt, etc. Simple repairs do not put me off on a used vehicle.
    However, on a bran new vehicle, I would expect nothing more than perfection.

    Now these used car services like Carvana base their whole business model on this.. but they do give you 7 days to return the car if you get it and find a problem.

      I haven't done business with them but know of people who have. They all seemed to get pretty good cars at a decent price.

    Derrick from 'Vice Grip Garage' always buys his unseen, most of them not having been driven in decades. A brilliant channel that I can highly recommend, a very funny guy.
    In the U.K. we had a case Oscar Chess v Williams that was all about innocent misrepresentation compared to purposeful. They said the car they sold was about ten years newer than it was, the case wasn’t long after the war when no new models had come out in years. They courts said that Chess had to refund Williams as it had been a purposeful misrepresentation. They would be covered by statute now though.

    As I have said to you twice before, any Car Dealer who find themselves in Court will certainly lose because everybody hates car dealers. Seriously, this lady won bc of the egregious conduct of the car dealer, I.e. you can’t inspect or drive the car and bc the buyer was a woman and obviously taken advantage of. Now the fact she’s a woman shouldn’t make a difference but she’s in the South and therefore a sympathetic Defendant. POS should have never attempted to bully her and certainly should have made her happy even if it would have cost them money bc Court and Bad publicity cost the Dealer far more...I have 50 years in the Automobile Business and early on I was taught to stay out of Court by one of the nations largest Car Dealers. He is long deceased but his boys run the many franchises today and I know they believe what their father taught them and me over 40 years ago. I will also add that we didn’t ever treat customers like that. We took back cars and returned deposits when we didn’t have to. I always lived by that lesson.

    I am going through the spot delivery problem even though I have a signed contract and it says they can take it back if they couldn’t get me approved. They told me 1. They needed us to resign papers. 2. The bank wouldn’t approve because the Kelly blue book value was $8000 less. 3. When confronted about there is no way, they said it was the opposite, they needed to get $8000 more out of the truck then what they originally sold it for. 4. When told it wasn’t right and I would see what a lawyer says about it, they then said I just wasn’t approved and he was done talking to me.

    Some years back, I needed a second car to travel for a job out of town. I had in mind that I was set on a coupe, not a 4 door. I visited 20 or so auto dealers, but only one had a car that I thought would fit my needs. I had excellent credit at the time, and had a credit card with a limit much higher than the price of the car. On the test drive, I found that the air conditioning did not work, something kind of important in summer time in Florida. The salesman assured me that they would fix the a/c after I bought it. So, with that assurance, I bought the car "as is" and paid with a credit card. On the place for signature on the credit card, I wrote "contingent on airconditioner repair" and signed my name. The sales lot did not have a mechanic of their own and were not able to work on the car on weekends, the only time I was not using the car. After 4 weekends of frustration, I brought the car back to the lot and said here is your car back, I want my money back. Of course, they were nasty, but I drove away in my second car. I disputed the payment with the credit card company, and won the dispute.

    Here in the UK we have a thing called a MOT (Ministry of Transport Certificate), it is a test for all vehicals (over 4 years old) must have every year to meet a minimum standard. No dealer would sell a car without this, as you can't have a car on the road without one and they only last a year. Even people buying a car in a private sale won't buy without this MOT. Mabe the US should have something simular, as it would stop this and take unsafe vehicals off the road.

      We do. Vehicles made after 1995 have to be inspected yearly and recieve certification that they are still good to go. Doesnt check for minor defects, but does hit the high points. Vehicles made prior to 1995 have to be checked as well but not with the same restrictions as they don't have the OBD2 censors.

    That is a very interesting case. I suspect the appeal might have been different if the first car had had a clear title. In a similar situation, I would have noted in writing that my agreement was contingent on a satisfactory report from my mechanic before signing anything.

    I got took on a car dealership in Arkansas back in 2002. I test drove and signed paperwork on a brand new truck. 4 days later they claimed my credit was no good and I had to return the truck, this after my credit was approved. So I know how scandalous car dealerships are, new and used

      My brother traded in a POS Chrysler. Several days later they called and said he owed them money. What happened the used car appraiser got the year wrong and the condition since there was a similar newer one being traded in also. Their paperwork mistake, I told my brother no don’t even go back because they may take the vehicle hostage while he was inside. So he talked over the phone with several different people….I had a dealer make a mistake on a truck with the engine size. The VIN code showed the larger engine and under hood it was confirmed, but their paperwork showed the base engine. I skated away with that.
