There are two types of pension in existance under eps 95
(1) Lower pension (min. 1000/- & max. 7500/-) fix on retirement corresponding to employer contribution of 8.33% of cap amount of Rs. 15000/- (i.e. 1250/-) and without dearness relief
(2) Higher pension as per order of Honourable Supreme Court fix as per prorata basis on retirement corresponding to contribution of 8.33% of basic salary + DA and without dearness relief.
(3) We need pension corresponding to employer contribution of 12% on full basic pay+DA and this should be exact 50% of basic pay+DA at the time of retirement and with provision of Dearness relief in each half year. For this pension if contribution require more then 20.33% (12% of employer and 8.33% of employee) may be given to eps and contribution of 3.67% only in epf from employee. Please note that home take salary will remain same under this option also.
You may please prepare scheme as per (3) which is most favourable from employee point of view.

The point of EPS is not really logical for rejecting Exempted trust, earlier when the upper limit was enhanced from Rs.5000 to 6500 and from 6500 to 15000 most of the Exempted trusts did not incorporate or amended the bye-law. Then the EPS increased the pension accordingly without checking or questioning the bye laws. I dont know how they are raising this question now. I think there will be a prolonged legal battle in Supreme Court.

I was retired in December 2021. But till date I have not withdrawn my PF. Also I have already applied in 2023 for higher pension. I am eligible. Please let me know if the PF office will give me interest from 2022 ? OR What I get benefits for till date. I will proceed my PF amount withdrowl in next / July 2024 month. Please advise.

Dear sir.. is there any difference between excempted and unexcempted organization...some PSUs employer are getting letter from epfo stating that your epf trust rules are not permitted for higher pension...what is this...where it is difference...can you please explain
Yes there is an issue with trust rules. If any exempted trust specifically mentions that higher wage CONTRIBUTION is not allowed then EPFO is rejecting such forms. So trust rules are important

It does not bar higher pension. Then what will happen.

Mere abhi takriban 12 yrars bache hain.....agar main higher option leta, tih jo maine calculation kia hai, mujhe 75 lacs amount kam milta(1.5 crores ki jagah 75 lacs)....now on pro rata basis, it would take atleast 23 years to break even....i will show yiu my calcukation tomirrow...i better not opted the scheme......

Dear Sir,
I have come to know that employees do not want eps95 pension which give min. 1000/- and max 7500/- after so many years which will have no value at that time and therefore they take break in service so that before completing continous 10 year service, they are enable to withdraw their eps amount. Epfo and govt. should think about it that they do not want such meager pension after so many years. Pension of employee should be such that employee can live comfortably otherwise no use of such beggar pension. Either epfo/govt. should increase the pension or remove it. For incteasing the pension if need increase contribution of employer even beyond 12%.

Any changes have to be approved by both houses of Parliament and made into a law. EPFO is not a law making agency. EPFO does not put this money into bank deposits to generate fund for pension. Madam, aap chahe to pension 50 umar ki age se bhi le sakte hai. Lekin har salke liye 4% kam ho jayegi. Matlab ki agar 58 me aako 1000 rs Milne wali thi to 50 se agar lengi to 32-36% kam milegi, matlab approx 640-700 k bich.
Dusra aap chahe to pension Chennai se bhi le sakti hai. Ek baar PPO ban gaya to Paisa automatic aapke banke account me aate rahega. Aap apne debit card se ya online banking se bharat bhar me kahi bhi us amount ko use kar sakte hai.Aapko bus har saal online jeevan praman patra submit karna hoga . Wo aap email se hi bank ko bhej sakti hai. Aap chahe to annexure K wala form use karke PF amount mumbai transfer karwa sakti hai lekin wo thoda tedha kaam hai. Uske liye thoda mushkil to hota hai lekin possible hai. Agar aap Chennai se bhi pension le to jyada issues nahi ayenge.
Retirement k baad ka paisa aap kisi bhi tarah se use kar sakti hai. FD ek tarika aur dusra tarika hai k koi acha pension plan le le. Usse jindagi bhar k ek fixed monthly amount pakka ho jayega. Sir higher pension amount will depend on your wage data and service period. But in general, it is understood that if pension is high, refund amount is also high. On an average of you survive till 68-69years, you would be able to recover all your money back.

केवल इपीएस से संबंधित जानकारी बताने या जानने से कुछ नही होगा जब तक आप इन नियमों को कर्मचारी हितेशी नही बनवाते हैं । इसके लिये कर्मचारियों को संबंधित मंत्री तक अपनी बात पहुँचाना होगी । इपीएस 95 को लागू हुए 15 साल होने आये लेकिन अभी तक मिनिमम पेन्शन 1000 रुपये ही है । इस पिरियड में महँगाई के अनुसार मिनिमम पेन्शन बढती तो 20/25 गुना तो हो जाती लेकिन नायम में समय पर संशोधन नही करवाया गया और आज 7500 मिनिमम पेन्शन के लिये भी संघर्ष करना पड रहा है ।

epfo viag rejected for late employers reply
Of the three employers which I worked for one approved my higher pension application, but two older employers did not action it (neither approve/nor rejected). So now the overall status of my higher pension application is showing as "pending for approval from employers". Since the last date for employers to action the application is crossed already, what will happen to my higher pension application now ? How will it be processed by EPFO ?
Sir EPFO is accepting late replies too. But you need to contact the older organisations and get the work done. In such complicated cases, getting higher pension will be challenging..

There is no provision for exit after 10yrs.Only option is pension. Spouse gets half the member pension.
Before 10yrs only member can withdraw. Spouse cannot claim withdrawal. Only option is pension.

My recovery show in EPFO site is Rs. 4950000/-as on 30-09-2023. every month charging is Rs 4000 every month. No communication by EPFO . Shows pending with EPFO. New Delhi . By seeing amount I have left hopes cancelling higher Pention . Guide. I am not willing to pay such higher amount Devendra Garse MTNL.
Sir the amount payable must be very high. But you may be in net profit of you are able to survive till 69 yrs. Breakeven for higher pension is coming nearly at 69 years. So taking into consideration the arrears and pension amount,higher pension is financially beneficial only if you survive till 69. If you cudnt survive then you may not be able to recover it even when your spouse might get half the pension.

As part of response to initial uploads by employer, EPFO is asking employer to provide "proof of remittance to higher ceiling of 5000/6500". What document should the employer provide for this? Any idea?
PF statement and old payslips should be enough. Any 2 pay slips of each period before and after 01.09.2024 shud be good.

@@Valueaddition-Harshwardhan sorry I made a mistake. Their letter says "proof of remittance in pension fund in wages exceeding the prevalent wafe ceiling of 5000/6500 if any, not attached".
What i understand is -
We have never contributed to pension fund above the limit of 5000/6500. We will be contributing if we go for higher pension. So effectively this means the reply to their query should be "no remittance made in pension fund on wages exceeding 5000/6500".
Have i understood right?
Sorry for late reply. You have to provide a proof that your PF was always deducted on actual wages and not cieling. And all such amount was deposited in your PF account. As there was no provision to contribute on higher wages to EPS earlier, all this extra money was left in your PF. This is the only proof you need to submit. Your query shud be answered with respect to the PF contribution only and not pension contribution.
