      i dont think anybody wins in cases like these because so many working class people with children in america are struggling financially and even though legally the plaintiff won , i think morally and ethically its not such a win because getting a free 1100 dollars at the expense of a struggling family is immoral in my personal opinion and these two week clauses are just a way to get unearned money from people who have to make a decision to remove their child from that type of service .

      @@marleonetti7 The parents were not forced to put their children in her daycare. Like the judge stated ALL daycare have clauses such as this. This is their business and how they make money. If parents pulled their children out of the daycare without cause, the providers cannot feed their families. Daycare providers do not get rich caring for children. If you do not want to put in your children in daycare, don't.

It was a concocted story from the beginning, 4 year old don't articulate things the way the dad stated, I should know I've raised 2 to young adulthood and they had very expanded vocabularies because I didn't baby them and even they wouldn't have told a story that way.

      @@marleonetti7 let’s see if you would feel differently if it were you that owned the daycare. You are completely disregarding that the parents agreed to the early cancellation fee in the contract. This fee is for a reason, the daycare provider still has to pay their staff when someone doesn’t give any type of notice, even when it’s better for the parents because they are saving money.
      From your statements,
      it sounds like you believe someone else should suck up this fee that the parents owe bc they are short of money? This is an extremely weak argument.
      Don’t try to pass on what you owe to someone else. It’s called being a responsible adult. If you yourself struggle with daycare fees and go back on agreements you’ve made, don’t have kids. You knew the price of daycare before you had a child

    • @marleonetti7
      @marleonetti7 ปีที่แล้ว +2

      @@kac4klhc977 well the only way they would owe money in the most literal sense is if they actually left their child in the daycare for 2 weeks and then refused to pay . but this is a situation where the daycare actually gets to be paid for not actually taking care of their child for two weeks and i think its unfair . i think the law should only enforce a contract that is fair one and these type of contracts only benefit one party so they are unfair .

    The Defendant and his wife were absolutely liars. Not only did they say they were moving the kids to the YMCA, but then in the follow up email, the wife says “this will wreck our finances and we won’t be able to afford the YMCA”. Only when the Plaintiff wouldn’t budge on what she was owed did the Defendant come back with the “Oh remember the time we thought our kid was being abused.” So…you mean to tell me you thought this school was potentially abusing your kid, but you never took any action, never made a report, never moved the kids until sometime later, and only seem to want to mention it as a means to get your money back after you failed to read the contract. Give me a break. It seems the poor kid comes by lying honestly, because his parents do it.

      @allegroaffettuoso9012 ปีที่แล้ว +2

      @@leelee3665 The Defendant’s clearly didn’t have any problem with confrontation, because, based on the Plaintiff and Defendant’s testimony, the father went into the classroom and aggressively confronted the teacher about the alleged situation. So, there is no fear of confrontation there. Then the kid laughed and hid and the father said it might be a lie. The father knows his son better than anyone else. Moreover, why would kids lie? Because kids sometimes tell fibs for fun. It’s up to us as adults to speak with the child to determine the truth and follow up on what they say, and clearly, based on the child’s reaction and the statements from the teacher, the child either was telling a fib or took a normal situation and described it in a way that sounded bad, as the Plaintiff explained when she talked about how the kids sometimes trip over each other while walking and that may have been what he was describing. If they really believed it, they would have followed through by reporting it. Not by moving on, and then only bringing it up to blackmail the Plaintiff into giving them the money back.

    1. You do not confront a teacher about an issue with the 3 year old right there. 2. It sounds like they were only there from April 25th to late May. So they were only there a month, not 3 months as stated in the beginning. 3. It sounded like they were only looking for a daycare to cover them until they were accepted elsewhere for free daycare. 4. Unless you call the police & file complaints, you still owe for 2 weeks per child for a notice. 5. The wife, who conveniently isn’t there, wrote a bogus ‘thank you for all your care’ text. And now, they are claiming abuse? I highly doubt they read the handbook! Or she wouldn’t have written that text. And then discovered they had no money to cover their other bills. 6. They wife is a trip on threatening the daycare. 7. A daycare is by attendance only. You pay for holidays when they are closed. A babysitter is only paid per attendance (you hire them for 3 days, you only pay for 3 days. A daycare care is you pay for the week & if they are sick for 4 days & can’t go, you STILL pay for 5 days. Get real parents. READ EVERYTHING!

      @@mexicanspec it is a mix between a service and a product. You are paying for the facilities, teachers salaries, sometimes food, school supplies, safety regulation maintenance, security protocols and licenses - it has very little to do with the literal day to day. No one is talking about the husband who might actually be a good man but he has to deal with her crazy manipulative wife. I bet she even said to him "you see? You were nice again and that's why we lose. You are not like your brother!" Or something like that.
    The father said and admitted his kid might be lying in front of the teacher. Now he had to show his face because the mother did all that blackmailing. The person we should all be shaming is the mother.
