    if it looks like a scam, it is a scam.
    Use a qualified solicitor , or a qualified accountant.

    Important part is its “deprivation of assets”. Local authority will review all this and may refuse to pay. Trust / legal shield is irrelevant when it’s clearly done to avoid costs. Not related to IHT 7 yr.

    TBH £2k for a properly drawn up trust is very reasonable. For an improper one it is of course a waste of money. My ma had one drawn up a good 20 years before she died for estate planning purposes. Exentually she went into a home, the Local Authority looked at the trust and left her assest (trusted to us her children) alone.

    Why not phone or contact the guy who has taken the 2k payment and ask them what the hell is going on taking money from a vulnerable elderly lady ?

    Surely, whether he claimed to be a solicitor or not, it's still an offence under the Legal Services Act 2007 of carrying out a "reserved legal activity" without authorisation.

    How did she pay? Cash or bank transfer or cheque tricky to get back. Debit or credit card much better chance

    100% guarantee the "legal associate" will claim they said it might work rather than would work, especially if they listen to this show to get their legal knowledge.
    If the house is being put into a trust maybe check who has control of that trust - might be the "legal associate", they may also have gained enough information from the target to commit identity fraud. In fact I'd make sure he hasn't been involved in any will writing because he may end up as a surprise benefactor in the will.
    I know plenty of people in this situation who would arrange for the same "legal associate" to visit a fictional relative on the pretence of doing the same thing and then "having words" with them.

      it is not impossible for this to happen but there are a lot of steps and unlikely to have happen this time frame and without checks and balances. Just practically setting up a trust is non trivial. The scam is more charging a fee for something they know isn't offering what they say it will, and the may not even submit it themselves. It is all about their upfront fee fee.
