      You're talking to the wall. People are manipulating left, right and centre. I think as you do but people will not stop their games. It's infuriating and tiresome when your stuck with a manipulator that thinks they have a right to lie and abuse. Even worse when they are armed with weapons. Northumbria police arrested a woman for being drunk and disorderly only she wasn't drunk. She was actually a diabetic and their ignorance caused her to fall into a coma. I suspect my husband is because he has all the symptoms my late brother had but he won't get checked. He has been a nasty piece of work. It all falls on deaf ears.

    Sometime ago a company van barged in-between me and my partner when we were out on our motorbikes. As we always ride with cameras recording, it was all caught on camera.
    We contacted the company by e mail and sent a copy of the footage explaing what happend . The main man called me and apologised and will take it up with the driver and get back to me. He actually called me back and said the drivers story was completely differnt to our own, then he sat him down and showed him the footage . Ka boom.
    He thank me for bring it to his attention and asked if his company can use the clip during their companys training for driver's. Thats how things shold be done and concluded. 🇬🇧

      Whereas I made a complaint about a school bus driver that was aggressively gesticulating to 2 students on a zebra crossing outside a school, while they were deciding whether to walk in front of such a bus driver, and they did nothing.
      The school didn't do anything either.

      I have a problem like this, in that I know for sure that carrying any item for self defense will never be used in anger, but the only way to prove this is to video my entire life's journey to the endpoint for the legal proof I am correct.
      Isn't it good that we have video that can follow you around and knowing that when you're dead you can carry a gun all day long.
      Maybe it can be used in training videos for children and law 'makers'.

      Generally why not?
      They are still human and have the same foibles and weaknesses as other people.
      One of my customers was defrauded out of roughly £4 million a few years ago by 2 lawyers.
      Have a mooch through the Bar Standards Board disciplinary reports online and you'll find some shocking behaviour.

      People have to learn from their mistakes!
      But also, as previous commenter said, nobody is above the law. It's a real pity that most recipients of similar letters like this lose time and energy and MH defending themselves against ridiculous threats. I'm glad that Daniel is publicising this because it might give those people confidence and strength to defend against a bully

    If the company whose van it was had just said they were disappointed in their driver's conduct and it didn't reflect their high standards when representing them in a sign written vehicle ... then there would be a whole lot of money & time saved, and we'd all have a bit of respect for them compared to what we now think about them. They, themselves have tarnished their own image - far worse than the incident did - and then hired similarly arrogant legal council. Just like the Post Office and other "institutions"

      There are genuinely decent lawyers who care about what is right and just, and are less interested in money. That doesn't apply to lawyers who practice in the commercial sector (e.g corporate law). Oh yes and tax lawyers, because the tax system now exists to serve itself, rather than exclusively to collect tax.

    Accidental inclusion ref the company name on a van breaking the law. The company should own it and apologise for their drivers illegal driving and explain how they retrained the driver or penalised him and it would have gone away. This is like the latest piano and Chinese incident which in their attempt for privacy have become a world sensation 😂🎉😂

      @@RobinPhillips1957 I live in the USA where we do not have TV licenses.
      We do have monthly satellite or cable services that run about $250.00 a month and what we call PAY PER VIEW events(where you pay for every event you watch such as a boxing match or a concert some run $400.00 or more for each event), but only if you are interested.
      We also have antenna TV television that has local programming, some network programs, some news programs, many old programs from the 1950’s thru the 2000’s that are free. We can also watch shows on computers on TH-cam etc.
      I do not understand having to pay to even turn on your TV.

    As a Barrister (probably an excellent one) you can deal with this. For us plebs, false accusations can be a worrying or traumatic experience. My experience of the average Solicitor is that they are disinterested or inept.

    I have been involved with lawyers for the whole of my 40+years of my career and one thing that I have learnt is that they are not an elite and should not be feared in any way. What one lawyer says will inevitably be countered by another lawyer so that the legal opinion expressed is not definitive, it is after all an opinion.

    Oh they are so screwed if this goes further. Seriously, did no-one think of the public fallout that would occur with an attempt with something like this? Quite frankly, A simple apology, and a disciplinary word to the driver (however hollow that is) would have acheived far more than swinging around their self grandiose, and acting like a playground bully.
    They've done WAY more damage to their public image now than the initial video, and whoever decided to try and threaten legal action should have their crayons taken away from them, and never be allowed to make decisions for their company without supervision for a very very long time.

    The SLAPP is interesting. Taking Brendan Kavanagh's video and his subsequent follow ups, it seems that the tourists are making repeated requests to TH-cam claiming a privacy violation. Even about videos where he appears on various News Programs. This seems like harassment. Now, while this has yet to wander into the legal arena , it does bring up the question of digital threatening behaviour and harassment and what to do about it. Its certainly adjacent to your experience here.

      When I read the title I (wrongly) assumed this might be linked to BBB's comments on the Dr K video and his (Dr K's) updates on the number of takedown requests he's received, which also seem to be spurious and vexatious in my non-legal opinion. Am sure BBB can handle this (Copyright arguement) and would be keen to know if he also has received anything related to Dr K? Time will tell. Am posting this as a reply and will also post as a comment.

    Absolutely right to challenge them Daniel, not all lawyers have your sense of fair play and common sense. You bring the difficulties of law and explain it so the layman amongst us can understand and I for one am grateful for your time and effort in what you do for us all on your channel.

    A great video. A typical example of solicitors behaviours. Throw out a threatening letter to try and get the other part to back down.
    Personally I think their rules should be broadened to prevent them threatening when they know they are in the wrong as in this case. Bullies shouldn't be tolerated in any walk of life.

    I know a junior barrister who was punished by a top law firm because she refused to represent and upset a VIP client when advised he 100% had no case. The client understood he had no case but had the cash and wanted to cause pain. She valued her qualifications and oath.

    I filed a claim against a medical supplier. They agreed to payoff. I said be sure that payment is here before court time. Day of court came. - no check. I went to court they didn't . I of course got summary judgement. Their lawyer called me later that day and threatened to have me disbarred. Sorry, you can't disbar a civilian. I guess my paperwork was to clean.. LOL

    I am only at 5:08 and something else has already caught my attention about the Letter and it is something you mentioned with regards the JD Vs AH Trial, More concerning as this is the United Kingdom and obviously far smaller than the United States...
    Most Solicitors and Barrister's in the UK know one another VERY WELL, There are a very small Number of Legal Professionals compared to the Populace, so they are more than likely going to have attended meeting together on frequent occasions - Potentially even when facing one another on opposing sides of a Legal Case! It is part of the importance of the Standards that no Legal Professional should ever "Harass, Abuse or Threaten another in the sector" to paraphrase the document you are reading from...
    Which, Is leading me to a concern that this is NOT written by a Barrister / Solicitor at all! And that in itself would also be an Offence...
    And if the content of the letter is regarding teh conduct of TH-cam Viewers - That is something that NO TH-camR has any real control over! Youi can request and insist people do not make disparaging remarks, But you cannot control them! They are individuals!
    Take for instance my disdain for TikTok LGBTQ+ Activist Jefferey Marsh, Many TH-camrs and such I have followed who have covered this person always say "Dont harass, bully or otherwise" - And I don't... But I can quite freely state here that I think that man is a Perverted, slimy, Vile piece of shit... It is MY OPINION... Protected by law - to an extent of course... I f I were to constantly post those words, and repeat such words on all his videos, That would 100% be an offence... But to voice an opinion is NOT UNLAWFUL!
    I did see teh comments on that video, and most were very polite... Just restating that they felt the Van Driver was in the wrong! A Viewpoint you echoed in your opinion within your video! I did not see any disparaging remarks about the company except a couple of people saying that them trying to get teh video taken down for Trademark Infringement was damaging to the business and how they would now make sure they never used them!
    That though is more of a Streisand Effect... Had the Company not sought so hard to protect their brand from One Bad Driver, No one would have a bad opinion of them directly! They are now punishing people for a problem they created!
    Hell, I only know the company Name - And even now I dont remember it... I just recall it being visible in that video... I did not need to know it so did not remember it - Because they issued the original Trademark "Takedown" - When I watched that Video I was judging the Drivers Actions, That was my focus... It was THE COMPANY who drew attention to the BRAND!
    In effect, They DEFAMED THEMSELVES!

      And my comments about JM... Yeah, just an opinion and I woudl never go out of my way to harass or attack Him / Them - I do try and be respectful of pronouns, Who knows, Maybe if I met them - My opinion may change - There is a difference between teh "Social Media Persona" and teh Real Person in many cases... And they are probably a very nice person to talk to and may even listen if spoken to face to face...
      ... But the Online Personality they display, I HATE IT!
      I guess I am that cautious with my words though not because of BBB but because I am aware of my own "Mask" I wear... Suffering Depression and Anxiety, If I do get my script written and upload my TH-cam Video, What people see will not be "The Real Me" but the Personality for the camera.     If I'd done a bit of welding, but wasn't an actual welder, I wouldn't be an expert in that field. Same applies to, say, accountancy. I might have done a few sums but that, again doesn't make me me an expert. So why do those who are not qualified within a legal profession think that they know better than someone who is?

    It looks like Cornices Center Ltd can't get enough publicity. Firstly their driver makes them the stars of the show with atrocious driving, which quite distinctly looks like driving without due care, and then they've seemingly threatened everyone with legal action who discusses the issue online, seemingly with equally questionable legal antics.
    Wow. I wonder if it was the boss driving?
    Most competent companies would have apologised for their drivers actions, but then again, not all companies are competent .......

    Hi Daniel, I do recall that video and remember most of the details what has now developed seems to me to be quite typical behaviour that is often demonstrated by people who are challenged by anybody, because they have no real rational foundation for their original assumptions when those assumptions are challenged the only way they can respond is with threats and abuse.
    In is very sad that so many people think that they can treat their cognitive delusions as immune to such challenge but it is a deeply embedded part of modern culture little of which has real legal or rational foundation.
    As far as I can see this response of yours is entirely justified and I do look forward to a satisfactory resolution I would also expect some significant compensation for the anxiety and stress they are causing you even if in fact you are not badly disturbed, this would qualify as punitive damages similar to what has just been awarded in the current Donald Trump defamation case but perhaps not quite so much!.

    Making threats against a lawyer is without doubt the most stupid thing you can do. Apart from anything else, they can represent themselves- so they don’t pay legal costs. And they can ensure that those threatening them rack up huge costs.

    Something similar happened to me. I asked a question on social media about people's experience of a company's products. Within three days I got a threatening lawyers letter. Caused me massive grief. A few years later some of the people running the company were prosecuted for fraud and others struck off as company directors. The solicitor who wrote to me was investigated by the SRA and struck off. He was a senior partner in a major commercial law firm. In spite of his experience he felt able to send lots of these letters to prevent potential victims of the fraud finding each other.

    If the owner of the company acts responsibly and professionally in business then I question why an errant driver
    would cause them any affront ,offence or outrage apart from that which they may direct at the driver. We now live in

    BBB is seeing this entirely in terms of civil law and professional conduct. But I am not convinced that there isn't a criminal offence being risked, if not yet committed.
    Using threats to impose a loss is just as much blackmail as using threats to exact money. I think BBB might consult a criminal lawyer at some point.

    It easy to say don't panic regarding anything to do with law, but the reality is that a lot of people simply can't afford good independent legal advice, which is the first thing you would recommend. And the law firms know this, and know as a result that a lot of people really have no option but to just roll over because they can't afford to find out if a claim has merit, and certainly can't afford risking an expensive case against them.
    It's easy to have that opinion from a place of privilege, but the reality for poor people is very different. So in the event I get a legal threat I will still panic, because I can't afford the alternative! It's frustrating when you know they probably just trying it on, but you can't afford to risk finding out.

      Yes indeed, good question. The context behind this statement isn’t yet complete, however I see little more here than a pompous irate question. Someone who feels aggrieved and is venting their frustration. Many folk may choose to simply disregard such a question, but there may be more context behind this question that we don’t know about yet. I feel that I don’t know enough yet to form an opinion whether this is a storm in a teacup, or even an ‘incitement to SLAPP!’ I’m taking care not to pick sides, and I look forward to hearing more.

    I agree with the assessment provided. One point of clarification. The Bar Standards Board is the regulator of the Bar but the Bar Council operates an ethics service. For advice, a member of the Bar should contact the Bar Council, not the BSB. The BSB does not operate an advice line for Barristers. If you seek ethics advice from the BSB, there is a protocol in place that means that you will be advised to call the Bar Council. So, the letter was correct in so much as the Bar Council is the right place to seek advice. I agree that asking that question was inappropriate.

    Thank you so much for this video. I'm a photographer and poet who most of their art is on the topic of mental health. I've gotten many veiled threats from my workplace about posting inappropriate content when I only talk about my feelings, struggles and inform others about mental health, and shared experiences. Something I find personally abhorrent that is happening to me. At the moment nothing's been written.
    I know you won't see this but I'd be interested in hearing your take.
    I started my mental health advocacy for being dissatisfied with feeling so alone, unheard and no one being in the same boat with my depression, because of a 'good vibes only' society on social media. So I post the positive and negative aspects, information on autism, depression, loneliness, and mental health struggle so another who may see it may feel a little less alone.
    I've met a few people who I've helped with the open honesty of my work and who they themselves are doing similar.
    But the veiled threats are getting me down and anxious.

      I'm not 100% sure but I think you're saying that your employer isn't happy with the art you've created, is that right?
      Can it be linked back to them or does it mention their company? Is it will known that you work for them, perhaps?
      Sorry for all the questions, I'm not a lawyer but have a little legal knowledge - I guess that'd depend on the country you are working in too 😁
      Only share if you're comfortable. If not, you might want to think about publishing future work under a pseudonym & via a VPN if it's going to become too troublesome to continue as-is. You'd have to leave the work you've done to-date, perhaps explore a different style or medium until there's enough for you to gradually return to your original style.
      Again I'm being _very_ cautious here because I don't know your situation.

      Hi@@Blue_Sonnet I would appreciate any insight you may have. To answer your questions, the main things my manager says 'to be careful with' is me mentioning I'm going through a difficult time, or may mention 'work' in the abstract. My accounts definitely can't be linked back to them, even less so now. I've blocked every work colleague on them, it isn't well known if I work with them and my account is minuscule.
      The only time if I have an arch nemesis who wants to ruin me who may be willing to do as much digging as physically possible to link me which even I don't think they'd be able without cross referencing different unconnected social media accounts, stalking each of them for a while only to then take a gamble and see if it pays off.
      May have to use a pseudonym, but perhaps it's me, but I personally think this should be illegal. Almost like if my workplace tried to coerce me to vote a particular way in a general election, but even in this case it's impossible for them to verify even if they had tried. I mean, I had someone try to silence my art before, we're now friends, we've made up and they apologised, I was just saying my struggles, difficulties, my feelings, my lived experience. No particular mentions. I'm not gonna lie, spent 30 mins now looking at my workplace instagram account and blocking every name I recognise. Will have to do the same for my second account later today. It's definitely stressing me out, even my therapist has said "you know yourself very well and creating art and sharing it is key to your own mental and physical wellbeing".

      If you're worried then definitely use a pseudonym - it's something that artists do often and the anonymity that comes with it can be really freeing solve you don't need to worry about any fallout or complications.
      With your work, I guess it would depend on how strong the worker protection laws are in your country/area. If you can, I'd recommend joining a union (I joined one during a work dispute and they couldn't help with anything that started before my membership, so it's best to get there early).
      It might also help to move departments or employers to have a fresh start - it's hard to tell whether they're is any ill intent or if they're just legitimately worried about you and just worded it poorly.
      You might feel more reassured if there's a clear line between your work and your art - in an ideal world you should be able to say and do what you like as long as it doesn't bring your employer into disrepute, but life isn't like that.
      If you want to stay with your employer, then a pseudonym and using a VPN when posting/uploading, making sure photos are in a different area to where to work and/or in difficult to identify locations will mean they won't have any way to link it back to their business. If there's someone you can trust in the HR department, you can maybe ask for advice on where they would draw the line on out-of-work activities that could impact their business.
      I'm not working with the full picture here (it's not really possible to over the internet!) but it sounds like you'd benefit from having your art be a safe space to express yourself, separate to your everyday life - if so then starting afresh with a pseudonym, VPN and making sure your art isn't traceable to a single location would do you a lot of good.     Maybe the company that employs the driver should look at the risk of its drivers going through red lights rather than threatening legal action for pointing out that its drivers go through red lights and put other road users at risk. There are so many vehicles with cameras these days, you would think that someone in a sign-written van would have more sense.
    Quite amusing that a solicitor threatens a barrister with a code of conduct report and then gets one right back.

    Excellent advice as always. Thankyou. Isn't it disappointing that ignorant law breakers cannot accept liability and guilt as in the case of the van driver and company and then a law firm is prepared to threaten litigation? I am interested to see where this one goes.

    My experience is that many people feel threatened by a letter from a solicitor and some members of the legal community are only too willing to take advantage of this.
    An example...Somebody local to me (a tenant) cut their side of a boundary hedge that belonged to a wealthy neighbour (the roots of the hedge were on the neighbour's land, thus making it their hedge) which they are allowed to do BUT they have to offer the cuttings back to the neighbour (you don't have to deliver them, just offer them for collection).
    The upshot was a letter from a solicitor threatening legal action if they did this again - the landlord was so worried they forbad the next tenant cut the hedge, even though it obstructed the driveway.
    Had this been me I would have adopted one of the following courses of action...
    1) A short 'up yours' response to the solicitor.
    2) A 'You know I can do this, how about we see how much money you can screw out of the
    old bat so we can go for a good meal?🤣🤣

    Being respectful to your wishes I will not quote the company name many of us saw on the van. The first threat of legal action was counter-productive and this one has dug a deeper hole. Every day someone is caught on camera for bad driving, a singularly forgettable thing. That is what should have happened, they maybe get a fine and a few points on their licence and we all carry on. Drawing attention to themselves by initiating these complaints is generating negative publicity, of course I can only speculate why they apparently have a solicitor on "speed dial".

      Like the ones who buy unrecoverable council tax debts and then use threats to try to bully apparent debtors into paying them to the solicitors.
      A friend showed me one his wife had received, I immediately asked him if the debt was more than 6 years previous, which it was.

    Shining the light, INTERNALLY, on veiled threats by colleagues (Solicitors or Barristers) is the correct way of dealing with this abhorent, unethical and unprofessional behaviour. This is even more egregious (A word the author of your letter also used) when it is a threat not directly from them but on behalf of a client, even more concerning if the client does not know of this.
    We need ANti-SLAPP legislation here in Australia as well. As well as tort reform on a fair amount of concerning matters (defo espec) - though I digress.
    Keep up the good work, it can only make society and the profession better. (Sidenote: if a barrister doesn't use caveats are they really a barrister? ;) )

    I wonder if this is an example of a pattern of behaviour from this solicitor. I doubt very much that it is a one-off.
