The judge absolutely did not find that prosecutors did not act in bad faith or excuse their behavior by saying they were swamped. The conclusion in this piece misses the entire point of what happened in court. The judge saw exactly how badly these prosecutors have disregarded discovery rules and basically warned them, that one more violation, and their evidence would be excluded.

Which was why the woman defense attorney stood up for probably the first time in 5 months to finally say whats going on with all these warnings? They even cited where the state was warned 8x for the same thing with the same final warning speech each time. The judge still said okay and? Just because she is a new judge handling the case she still has to keep in mind the prior admonishments each side has incurred over the trial. Especially when the attorneys point those moments out to her with exact dates. So yea they had a correct reading of this moment. Do you think me or you would get 8 warnings during a potential "LIFE in prison" case? I doubt it. Thats like testing for drugs and your probation officers say 8x okay dont keep coming up dirty or else. But the "or else" part never happens for 19 months straight.

It is litterally a near perfect example of bad faith.
If the state fails to turn over evidence, the charges should be dismissed with prejudice in all cases. This is a tactic they use far too often. They just got caught this time.
