    Is this rule different for technical content that is not novel and fiction related? (Such as skill, information on subjects, education) And, if an author has already established themselves for many years in the market without AI, wouldn't that then lend weight to their ability to show that they are doing most the work (against the AI)?
    To be honest, after so many years writing without an AI, I think the AI would be inferior. BUT the only advantage is that it could let me save time for some things (IF I used it, which I've not yet. There's no point to start unless I'm sure it could be safe to do).

      No, it's still ineligible for copyright protection because the human isn't going the work. It's also seen across the board as highly unethical. Generative AI and assistive AI are very different things, but even assistive AI needs to be used sparingly. Generative AI does remove authorship, authority, and safety. If you're a professional in a field, I highly advise against using any sort of generative AI, especially in books or manuals.

    What about your have an idea suggest to create an outline to have form however, you create charities yourself and build on the outline as a basis?

      That still counts as generative AI because AI created it, even if you tweaked and built it out. As the laws are now, you can't get copyright protection for that.

    What if I use extensive scene orompts, like how the character is feeling. Who he or she are talking to and what their conversations are about? I mean a lot of input into the prompt. Like having the AI as a writing partner.

      The ai is still doing the work. You’re not writing it. There is no copyright protection for anything generated by ai because it’s not created by a human. All platforms across the board have extensive rules about using ai, traditional publishers wil not touch it, contests and mentorship’s all have rules against it, and the readers as a whole will blacklist you for trying to use ai to cheat to write your book. Do not recommend trying this.

    So what if it is substantially changed? Like if you use the ai periodically for when you have writers block, but kind of make it a rough draft? How much do you need to change it for it to qualify for copyright protection?

      None of it can be written by AI. Literally none of it. It can generate ideas, but you have to write every single word for it to not lose it's copyright.

    I see no difference between using AI to write a book and using a ghostwriter to do the same, especially if a human is heavily involved in the creative process.

      And ghost writing is considered by much of the industry to be highly unethical for novels.

      @@KMRobinsonBooks I think you'd be surprised how acceptable ghost writing is in the industry. Many of the biggest indie names on Amazon put out a book a month. I've seen some put out one a week. Only the most gullible person on the planet would actually believe they are writing all those books themselves. As for AI, I think it's morally wrong to sell a book you didn't write and call yourself an author, but there are some formula driven genres where no one is ever going to know as long as you change the words around. Romance comes to mind off the top of my head. Romance has the exact same beats over and over. You don't even need AI. You could take someone else's book and change the words around. They wouldn't have a clue, because theirs is like everyone else's, too.

      There is a difference. Ghostwriters write on your behalf. They create the work and give it to you. AI uses already existing work on the internet. Basically, it takes snippets of Stephen King's work and many others' work. Honestly, it really is not right and it is cheating humanity as a whole in the arts.

    Can you explain how someone would even know if a person rewrote AI in their own words? Because the sentence he rewrote live are now his words. Who is actually going to know is the "idea" behind it was his?

      Oh, it's very simple-there are SO many ways. The metadata. When the ai plagiarizes. The watermarks. It goes on and on and on. It's not difficult at all to tell, and because technology is advancing, it's only going to get easier. Even if people think they can get away with it now, a few months or years from now, anything they create and try to pass off as their own will be publicly uncovered and criticized.

    What if I use chatgpt to proofread and rewrite some of my sentences? Am I still elegible to copyright it?

      It’s not good at proofreading, use Grammarly and ProWritingAid, and that’s just for your self edits, you always, 100% of the time, need a professional human proofreader.
      There was a court case this week that flat out said ai can’t be copyrighted so if you have it change things, buh bye copyright protection. But again, ai as is now should not be used for proofreading because it sucks at it.

      Again, you need to be using programs designed for self editing, chat gpt is full of bad information and errors, this is as bad as if you just glanced through it yourself and called it a day. Using ai as it is now to self edit a book will go down as one of the worst things authors can do in the industry until there's some kind of major overhaul of its capabilities. You're looking at many years before this could even be a consideration.

      @@KMRobinsonBooks thank you. I have been using editing programs mixed of prowriting and grammarly. Beta readers also help me too. But sometimes I can't rely on them which is why I've been self-editing to manually change things like tense consistency. Also, you are right, using chatgpt to proofread is not really good. I've reverted the prompts to original since it looks so bad to read.

    This conversation seems more from the perspective of "ChatGpt write me a story about xyz meating 123." And then taking it and editing it. But What if I wrote a draft of that same concept that then asked, "ChatGPT take this chapter I wrote, clean it up, and maybe add more suspense to the scene without changing the structure." Wouldn't my initial input be "substantial human input" considering the AI is using my plot points, my words, and my ideas?

      As per court cases, anything created by AI is not copyright eligible. There's one case we've discussed on the channel that has some implications that means AI could change a word here or there and not wreck your copyright, but for now, nothing using AI can be copyright eligible. In the future we could see copyright offered only to the parts you write and not the parts the AI wrote, but if AI does any of the actual work, you're out of luck at this point. Everyone has ideas....but ideas can't be copyright protected either.

      Grammarly and ProWritingAid are fine. Just remember it doesn’t replace a human editor, editing programs still have a longggg way to go

    Can you guys comment on independent writers and the perils of their work being taken? I think in another video Tony said you need an attorney to bring a lawsuit if somebody is given some portion of your writing via AI. Does AI give out whole phrases from books? For example, John Steinbeck wrote this beautiful passage from the Grapes of Wrath, "It was her habit to build up laughter out of inadequate materials". I love that passage. Steinbeck is my favorite author. Can Tony give examples of how AI might use something like that? Or does it only choose random words instead of whole phrases?

    So it seems as long as every word is written by a human, then it's good. Since ideas can't be copyrighted, then AI could be used to help create the structure of the book, basically a skeleton with all the important things to consider at each chapter of the book. While the guide will ensure the whole book has cohesion, the human must write the title, chapter name, and each explicit sentence in the book by hand. AI helps to prevent the author from unnecessarily inflating certain parts, gutting others, or missing important aspects of certain scenes or characters, all the while the author is explicitly writing the story themself.

    Okay, I get. So it's better not to copy and paste words, and just continue writing your own version of the story. But at the sametime, one can still have fun with AI generators.

      Moreso for marketing ideas, back histories for characters that aren't in the novels, etc
