      Germany is now subject to EU law which, technically, is 'Corpus Juris', which differs from the 'Habeas Corpus' applied in the US and, once upon a time, the UK. The difference is very simple, under habeas corpus you are considered innocent until proven guilty in a court of law. With Corpus Juris, you are guilty until you can prove your innocence. This is an abomination as it's almost impossible to prove you didn't do something- after all, there will be no evidence of you not doing it. The reality is, in the EU, it's possible to be incarcerated for an indefinite period, without even being told what it is you're accused of - which increases the difficulty level of proving innocence to a far higher level. It also relieves the principle of 'beyond a reasonable doubt', so if you were where the offence took place, without any witnesses, and somebody said it was you, you're screwed. The other big difference is that, in the US, you can do anything you wish unless it is prohibited by law. The EU had already adopted the principle that you cannot do anything unless it is permitted by law - the style the WEF is intent on forcing on the world. The UK has already started down this dreadful route by giving local authorities the right to penalize people without trial & your only recourse is to 'appeal', which is usually refused, following which you have to take them to court, which most people have neither time nor money for...

    This case has caused quite a stir in Germany, because liking a post can be accidental or even be caused by a glitch, so I hope our German court systen will change that ruling

    I do nothing on facebook. I did not create one, I did not ever sign up, I never wanted anything to do with it. However, a spiteful neighbor created an account, used my picture from a local ad, and then spent two months pretending to be me with liking random stuff online. Then, spent two weeks making threats towards kids at the local school, resulting in a 2am visit from the local armored law enforcement detachment. Just out of the blue. Because he hated the fact I grew a hedge that blocked his dog from coming onto my lawn.
    I *despise* most social networks... but everything hinges on them now.

    This is clear judicial overreach even here in Germany. It will not stand. The inconvenience of getting your stuff confiscated and locked up in evidence is like a punishment in itself, how to rectify that I have no Idea.

    Im German and just now read the article and looked up the ruling...if a second semester student would argue that ruling in a test it would be a clear failing mark followed ny the heartly meant advice to maybe think of alternatives to a career in law

    I travelled around the world as a Marine, retired in 97, and I found lots of people found our "right to speak" extraordinary, everywhere outside the US. We tend to take it for granted, but there was nowhere foreign I found that one could easily with confidence, simply ignore the issue. The last place I was overseas was Bahrain, and free speech was not an option there.

I live in a swing state, but we almost always keep a Republican governor, so we manage to keep most of our rights, and a much better 2nd ammendment protection, has recently been achieved.

But there is no way to do this in Germany, because in order to legalize marijuana, you need to express its approval, but it is illegal to express approval of (illegal) marijuana in Germany.     My first duty station when I was a US Air Force officer was Wiesbaden, Germany. During my orientation, it was pointed out that by German law, a German citizen can take you to court for insulting them and the court can compel you to make a written apology.

      What you said still applies. I'm working on a Dept of Defense contract in Stuttgart and even I know that addressing police using the German article "Du" is an insult and arrest-able by the Polizei. Last person I heard address a female officer was a young German guy who asked her "du bis eine Hure" when she told him to disappear from her face.

    If I've said it once, I'll say it again. Until they start holding judges fully accountable for garbage like this, the cops are going to do it. The judges rubber stamp this stuff. You can be absolutely guaranteed that if the judge's name was on that warrant as the suspect, they would have denied it before The ink was dry. But because that judge doesn't have any kind of personal interest or stake in what happens to the suspect, why not? It's not their stuff being stolen.

    FYI: the shooting: 2 cops were cold bloodedly executed. Everyone was shocked, because usually we neither have shootings in Germany nor any significant violence against leo. The network assertion act is purely against free speech. Everyone warned that it's a bad law, and it is contested in court. It will get stuck down eventually because it's clearly unconstitutional, but that will take years. In the meantime Leo can hold anyone in "contempt of cop" arbitrarily based on whatever the person says online.

      I don't think that this is unconstitutional in Germany. Much more likely that it will be reduced in scope by the usual processes that temper the application of some laws. Remember that if you indicated approval of a pro-Nazi post that this indeed should remain illegal.

People are entitled to have opinions that may be foolish and incorrect, provided that these opinions don't harm anyone (i.e. cause them to lose housing, employment, safety, etc. which is different than offending or insulting). You can think any ethnic group or gender, etc. are whatever. You just can't commit prohibited acts based on your opinion. There is a difference between thoughts and speech and illegal acts.

Speech is often provocative or offensive.. but it's how progress happens. That's why the supreme courts have ruled (at least until all this social bullcrap) that offensive speech is allowed by the First Amendment.

      IMO, there's no way to define "hate speech" where all forms of discussion would be fairly represented; it really is that simple. It's a slippery slope. The first question you have to ask, is who gets to "decide" what hate speech is? Mob rule? Politicians?
      Nah; First Amendment says everything you need to know. All speech and ideas are protected. Inciting violence is NOT a form of a protected idea. It's a call to action.
      We already have laws. People being offended by the silliest things and forcing others to be in control of how something is perceived, is a dangerous proposition that easily leads to "thought policing". It's NOT my job to codify others, and it's certainly not my job to make others feel all warm and fuzzy when I speak. If my speech offends thee, don't listen. Quite simple.

    "Hate speech" is an incredibly dangerous concept. As a former Marine, I am deeply offended by US flag burners, but I put my life on the line for their right to do so. While I find their expression of their opinions to be hateful, it is their right to offend me. Unfortunately, we do have those in our country that think we should punish those who don't agree with them and would classify it as punishable because it is "hateful". If we don't have the right to express our opinions when someone else disagrees or is offended, then there is no freedom at all. Any opinion worth expressing will be offensive to someone even if you are 100% correct and the offended person has no logical reason at all to disagree. If it is possible for one person to agree and someone else to disagree, it is in fact an expression of opinion.

One woman was arrested for a Facebook post in which she was organising a protest during lockdown and therefore breaching the public health directive of the Victorian Government.     When I lived in Europe (came back 3 years ago) I spoke quite a number of Germans - outside of Germany and in English - so they felt freer to express themselves than at "home" to a non-German, outside of Germany.
    I was told numerous times by many, that Germany has no real freedom of speech and have to be careful of what they say at home.
    As one put it succinctly: "We are an occupied country and we're not free to talk openly and truthfully - like you are in America".
    This case clearly reflects what they told me.

    Facebook can force likes and groups can tag you to any picture posted. It is scary that a person or group can tag pictures and I have to manually remove it myself and Facebook can't stop the tag from getting into search engines and associated pages.

    In Deutschland, “du bist was du magst”. You are what you like (on social media). :-)
    The German Constitution (Grundgesetz or Basic Law) is nothing like the US Constitution in areas like free speech, or individual rights in general. It was largely written by the Western Allies for West Germany after WWII. Top priorities included De-Nazification. So protections for political speech are weak. Political parties like the NAZI’s are outright banned. And the threat of bans is always there.
    I found the web-site Steve mentioned but not the article. I was curious about the translation.
    One thing I find with Maschine Translations is that they default to bland words. There are many words or expressions that might be rendered as “creature” for example. As in English, some, in some contexts might be inflammatory or offensive. Google Translate likely won’t pick that up, or would avoid the more offensive rendering if it did.
    I’d be curious for a link to the actual article if someone has it.

    The insane German justice system, they have a thing called "Beamten Beleidigung" (Insulting a government Official) example calling a Police Officer a Haubentaucher (Helmet Diver) makes the offender liable to a fine.L o L !

      The Beamtenbeleidigung was a law in the Prussian Empire but nor more today.
      It's just a normal Insult. But insulting a gov official is crime that has a "public intrest".
      Thats why the sentences and punishments are harsher then calling your neighbor names.

    I haven't used FB in years but just started to browse it again on a tablet. I've noticed while scrolling it can easily like posts/ads without me wanting to because I have to drag the screen upwards. So now people have to fear accidental likes due to tech errors?

    On a side note, I'm from Brazil, and I've heard of at least two cases here that involved online harassment and people who "liked" the original post harassing someone else also got into trouble in here.
    But not criminal trouble, more like sued for damages. No idea if they actually lost the lawsuit and had to pay anything though.

    US is so similar to Russia, where political opponents can be jailed, their residences are searched, and you can be prosecuted for repost or like. Plus, conviction rates in federal courts are in 90% plus range, just like in the Putinland.

    As a European strongly in favour of prosecuting stochastic terrorism and endangerment through malicious slander on social media,
    This level of government over reach and over reaction is preposterous and frankly dangerous to the point that the reaction by the local justices is more dangerous to the local community and it's democracy than everything they reacted to combined.
    And I hope the German federal courts overturns this case and censures the lower court heavily for their transgressions.

At 70, I have never been in trouble with the law, have never even received a traffic citation. But in this insane era, I wouldn't be surprised if I was swatted by the FBI...
