Aoa sir.. Behram here.. Your student from recent badge of CJ preps. Sirr I met a retd. Session judge sahab yesterday where he asked me difference bw 249A and 265K. I answered the same as you taught us. But if we read 249A it states that magistrate will acquit if he finds the charge groundless.... That means Charge frame howa tb eee groundless consider krega... Hence after framing of charge acquit krega magistrate.. I need your opinion on this matter. Thanks.

No restriction on the power of trial court to pass order without framing charge
PLJ 1999 Cr.C (Lah)
Please refer this judgement to worthy session judge which clearly states that court has power to acquit under this section even without framing of charge
