      Didn’t emerge in my case. That mysterious butterfly was dead in the box. Thanks to my ProBono lawyer and my own naïveté in the court room. On top of that, l was against (oh the irony) freshly -graduated Chapman University (Orange County, CA) lawyer-to-be. She lied to the judge. I COULD HAVE easily proven that she was lying, if during the trail process things were done the right way.
      Since, I studied the civil and criminal laws’ fundamentals - nova days, i will see the deception: no one can easily trick me when it comes to my rights and the legal proceedings. In that, I succeeded 100%. But.
      It still hurts, when I remember . My point is, to KNOW YOUR RIGHTS motto is a life-saving skill we MUST learn during high school years, not afterwards, on the spot - when it’s often too-late. Maybe... Some day… Things will change… But for now, the Money Power rules over the courts - not the Blindfolded Justice. With rare exceptions. Because “Shopping around for expert witnesses” and lawyers willing to spend TIME on the case is unnecessary pricey:
      - Good luck achieving JUSTICE on the budget.
      (1) Learn the Rules of the legal Land or (2) lose: no Land of Milk and Honey for the naïveté with shallow pockets - system’s available remedies will be bypassed - if the deep pockets are not DISCOVERED beforehand. The “attorneys’ best interests” are to settle (and move on to the next) case, unless someone’s footing the bills: PAYING them high-premiums, HOURLY. Understandably.
      However,
      Q: What ‘fairness’ can possible come from such an initially unfair set-up?

    I love it. Thank you so much. I'm a virtual assistant helping a law firm, but I'm not even from the same form of government. Trying to understand federal law is really not so easy and this video has helped me so much to understand how discoveries work.

    I have see lawyer two lawyer cause I didn't have the money to put up front . But lawyer CLLC lawyer see the document was fraud and forgery and said the property Deed was void.

    Does all this information relate to all of the courts? such as criminal and civil
    I would like to know if these rules will work in cook county of Chicago

      Even though your question is from long ago (and you've probably long since moved on), there might be others who could benefit from an answer to your question. The Federal Rules of *Civil* Procedure, often abbreviated as FRCP (ex. FRCP 12(b)(6) ), apply only to *civil* actions brought in *federal* courts, and are uniform throughout the United States, regardless of the district or circuit (i.e., your geographic location, although in addition to the FRCP there are also so-called "local rules," which can and do vary from district to district). So, the question isn't where you are *geographically* (for example, Cook County in IL); it's rather whether you are in *state* (sometimes called county) court for Cook County, or in the *federal* court which has territorial jurisdiction over Cook County (so your federal district court isn't always necessarily in your particular county; it could be located in an adjacent one).
      For *criminal* matters pending in federal court, the Federal Rules of *Criminal* Procedure apply, and once again, these are uniform throughout the U.S., except for any local rules which will vary from district to district.
      Parenthetically, since FRCP could technically stand for either "Federal Rules of Civil Procedure" or "Federal Rules of Criminal Procedure," the preferred abbreviations for better clarity are Fed. Rule(s) of Civ. Proc. and Fed. Rule(s) of Crim. Proc.

FRCP 12(b)(6) ), apply *only* to *federal* courts, and are uniform throughout the United States, regardless of the district or circuit (although in addition to the FRCP there are also so-called "local rules," which can and do vary from district to district, and furthermore, judges or magistrates within the same district can have their own quirky little requirements, making navigating through the federal court system somewhat daunting for non-lawyers or even for attorneys who typically practice in the state--sometimes called county--courts). For state/county courts, each state has its own set of civil procedure rules. For instance, in California, these rules are found in the California Code of Civil Procedure, often abbreviated as CCP. Of course, if in conjunction with discovery, you are talking about obtaining evidence, in California there is also the Evidence Code, which lays out the rules for admitting evidence such as scientific evidence and witness testimony, including expert witnesses and opinions.

The Judge concluded that she would provide me with tools to find a Pro Bono Attorney. I live in Florida and have found there differentiation between counties. The defendant was arrested two years ago charged with grand theft in the second degree, a felony charge. If I told you what I am hearing from these Law Firms that I contacted, it’s a wonder they are aloud to practice law. I would pay the Lawyer and don’t expect a free service. What I have not shared with these firms is the six figures that I’m confident to win, my money returned. I have every document proving the perpetrator guilty. The defendants Attorney has yet to see my evidence nor has the court. I am a retired educator who happens to have stage IV cancer. I mentioned this fact because I truly need to be resting not in court. Respectfully, Jeff

    I am helping a friend in a case... civil and criminal, it involves a Credit Union, a lady ,and my friend. His Attorney is not including the C.U.....Stated that they may be the victim as well.....they are directly involved. For Truth, I want all parties involved held accountable. IDEAS?

      I would post a genuine response, but seems any serious reply to a question, no matter how accurate and informative, is being categorically deleted (whether by the channel creator or YT I don't know), so at the risk of sounding cheeky, I'd say go after the butler. It's always a good bet that the butler did it!

    I'm suing the California Franchise Tax Board for financial fraud and psychological abuse I'm so psychologically damaged by these people I want to know am I allowed to have a stand-in I'm afraid that'll have a nervous breakdown or my diagnosis will be exacerbated in the courtroom am I allowed to have a stand-in illegal stand-in can somebody tell me please and thank you

    I filed a federal lawsuit against my soon to be ex-wife for stealing all the insurance money when our house burned down. I never got a response from her attorney but received a denial based on Rule 9a, do you see anything wrong with that?

    It is every officer of the court's determination not to prevent evidence from being admitted into the record but to ensure the evidence being admitted is relevant and a proper foundation is made. If the opposing party is misusing objections to prevent credible facts from being considered by the trier of fact then the opposing party is committing an ethical violation of professional conduct. In this pro se litigants opinion for what that's worth.... America
