In terms of contracts, breach is the failure to perform material obligations in which then options are to negotiate and settle, mediation or arbitration, or to litigate contract action.

Either or both patties can include liquidated damages. Just make certain they represent actual losses from a breach.

What about moral damages.. Would you consider them as compensatory damages or non-compensatory damages?

What about Special Damages?
if we work freelance/part-time at place which is non-competitior of your employer then does breach contract??
If you have a non-compete agreement, it will lay out the limits of your side work. If there is no non-compete, you are free to work outside of your job. The limits are when your side activity violates your duty of loyalty to the employer, which is to not compete with or usurp business from the employer without making them aware and giving them an option at the business opportunity first.
Can a court simply enjoin the breaching party to fulfill his/her part of the contract without necessarily awarding any monetary damages to the plaintiff?
Hi. Yes. It’s called ordering specific performance. It’s only used for sale of unique, irreplaceable goods.

Punitive damages are not awarded for breach unless the breach claim resembles a tort claim or is accompanied by a tort claim.
