They didn’t prove he was drunk he just refused field sobriety which in some contexts are notoriously inaccurate. Even lab work depending where/what you’re talking about can be months or years and have had highly public widespread issues of contamination/mislabeling etc. She was getting fairly aggressive regarding the call with the attorney which isn’t exactly illegal from my understanding to do. Driving drunk is obviously dangerous and a significant offense but some of the drivers/criminal records systems have been systematically compromised, people in certain states get arrested for driving with trace amounts of thc which can stay in blood from a contact high/going to state where it’s legal/etc for literally 30+ days even though that quantifiably basically poses zero risk. The guy is a bit odd for sure but people can behave weird when law enforcement is present or after an accident for a lot of legitimate reasons. Just an airbag without car impact can cause significant injury/concussion. Mainly any police contact even for entirely lawful citizens can cause disabling levels of stress/anxiety. It’s well documented. This specific guy absolutely could be legally drunk but it wasn’t exactly proven in any actual material way. It’s disingenuous and dangerous to understate some of the practical, significant documented issues with US LE infrastructure.
Visual impairment due to intoxication is a matter of perspective and perspective is inherently relative. All I saw was a guy who had been driving a drove off the road. He called his attorney which could be related to anything. He could then call a a tow truck to tow his car and have a friend or transportation service pick him up. He should not participate in any physical tests to prove anything to police. For the police to do that to someone who was just in a car accident is irresponsible. He could be physically and mentally shaken up which could lead to false sobriety results during testing. And just because the officer “smelled alcohol” means nothing. She is a police officer not a scent expert and he is in a open field where alcoholic beverages could have been thrown out windows of passing cars and landed in the area creating a smell of alcohol. This guy should have called a tow company before law enforcement arrived on scene to get his car. Not said a word to police and let them book him and refuse all breathalyzer and blood tests. Regardless of whether the tests are taken and what the results are, a good attorney could have that evidence rendered inadmissible on the basis of lack of evidence supporting why they would breathalyze or take blood in a single car accident. Claiming there was not enough supporting evidence to warrant a DUI test of any kind. Instead this guy said he had a glass of wine and thats all they needed. Don’t be like this guy. Keep your mouth shut and let them book you and charge you based on supporting evidence.
His lawyer friend obviously isn't a criminal lawyer. Nobody is required to take field sobriety tests and she would have told him to refuse if she was a criminal lawyer. BAC tests are required, however, or else you will get a suspended or modified license for two years in Oklahoma if you refuse. However, sometimes they gets tossed for various reasons, so it's always best to not help the police rack up evidence against you by doing FSTs. Sober people fail those tests all the time. Most importantly, don't drink and drive.

If he had a dui he would have known to take off running the moment he crashed his car. Its alot better to get charged with fleeing the scene, they cant prove you were drunk the next day.
