  • It is manifestly unjust for anybody to demand people to look for rent for one year or two in advance. Nigerians don't earn much, the salary scale of most people is abysmal and not comparable to so many other societies, this bill will be beneficial to both tenants and landlords

    In the 90's, rents were paid monthly in most places in Nigeria. My understanding as to why it changed to annually is as a result of either late payment or none payment of rent by tenants.
    The none payment of rent was mostly caused by non-payment of salaries by government and other organizations.
    My take is, instead of chasing shadows, how about effect Labour laws first. Ensure workers are paid as at when due (both for private companies & government).

    Start with increasing employement, then you can expect people to come up with monthly rent. You can't apply this is a grossly informal economy.

    A society where people are not paid for years!!!
    This is a call to stop being a landlord.
    For this to work, all Nigerians with a job need a guaranteed of being paid at the end of a work period.
    And guaranteed of being evicted if not paid within 2 months.

      Regulation of rent payment is a welcome idea. The problem in Nigeria is that anything goes. We are one of the most unregulated society in the world. In the Uk and most developed societies all rents are registered and regulated.
      Now the essence of the regulation is to protect both tenants and landlords in such a way to also create opportunities for lenders to play active roles in the industry.
      When a landlord for example earns his rent monthly, a bank can lend 50-70% of the accumulated rent to the landlord for a year or two and use the rent contract as repayment source which can be deducted monthly as the tenant pays. The tenant in turn can take short lending to meet monthly rent obligations when salary delays or in the case of a small business owner when his or her earning is late.
      This monthly rental not only reduces pressure on tenants it also helps to unlock financing options for landlords. It’s the way things works in most developed societies.

      In America/Canada, your rent is due on the 5th of the month. If you do not respond by the 15th of the month, the sheriff will be there to help you move but all rents are paid monthly.

    Abati made an excellent point. Why don't the government build low cost houses and collect the rents monthly or whenever they decide to pay salaries. Instead of pushing it to citizens who own land, landlord no be human being, is he not facing the same Nigerian effects

      It's actually not a good idea for government to single-handedly build housing for the masses. The government that can't manage what they currently have at the moment. Government can work with the banks to give an affordable loan to potential investors to build more housing and government can also have a stake in it. The housing reforms that's been proposed must have protection for both the landlords and the tenants. Why is Nigeria always vilifying their citizen and one wonder why there's proliferation of nefarious activities. There must be a data base system to report any issue with tenants in which every landlord can do a rent history and background check on individual tenants. This will solve many of this issues when it comes to tenants unscrupulous activities. There must be a regulation to act as a check and balances for both parties and this is required in every sector of the society. The same way government regulate business and also it will create jobs for some people. This things have been implemented in many society around the globe. Also, government and all employer must pay on time. It is actually inhumane to not pay your worker as agreed, this things should be a ground for litigation as well, if anyone refuses to pay their employee according to the terms of employment contract.

      Its a two way thing. The idea of monthly payment to me is not cool. I prefer paying one year ahead. What i think they should be discussing is the hike in rent all over the country and how to control the prices

    The monthly rent will go higher immediately. No court or Tribunal will finish one tenancy case within 2 years. Trouble coming for both tenants and the landlords.

    Ridiculous. These money bag senators think that all rent payers across the country receive steady flow of their monthly salaries. What happens when a tenant is being owned three months salary? Senator did not answer Dr Reuben's question about this. Even the US and UK they always cite as examples have lots of homeless people on the streets despite availability of jobs. Nigeria should have their own unique and different systems of handling their affairs not always referring to the US and the UK

      Don’t mind them, they never talk of how easy it is for a landlord to evict a tenant who are not able to pay their rent, neither do they talk about landlord being able to get their money through garnishing anywhere you get your source of income.

    In my opinion, this is one starting to count from nine to one, instead of counting from one to nine. The government monopolize the policy on major building materials. The government is not regulating the prices of building materials as suppose to. The government does not have proper data on properties and potential tenants. The government is not subsidizing building materials or tenants fees, what right will the government have to tell the landlords and the tenants the best way their agreement should go? Some tenants prefer to pay in months of advance than monthly payment advance because of economic and system of things in Nigeria. What works elsewhere easily will always find it difficult to work in Nigeria.

    Senator sir, the bill should allow tenants to either choose between paying monthly or annually. The bill should equally address government laxity in allowing developers/landlords to build houses that are not livable - houses with unclean water, improper sewage channels, low quality fittings and all. In fact, government irresponsibility has allowed some landlords to put up structures on which they make millions of naira every year, yet, they won't provide basic things like the above in their houses.

    To do ordinary foundation you need almost 80 bags of cement and minimum wage is 30k naira, cement prices is over 10k, shey when the landlord finish the house, he'll be running after someone that government hasn't paid his salary?? For his information, Alausa already has recirds of property and development going on, in which developer is charged different fees and landlords are charged land use fees based on the value of the property....make this Agbaya no let people swear for am

    It is a very very good move but so many many Nigerians won't be able to pay monthly like it's done in many other countries.
    Remember that salaries are not regular in Nigeria and many tenants will be thrown out homeless in huge numbers once this comes to practise.

    In my opinion, I prefer to pay rent yearly because I am not a salary earner, I full-time businessman, I may not have the opportunity to make money every month, due to different business seasons, but they can make the law, and also make available options like monthly payment, quarterly, 6 months and yearly payment, the tenant will now have the option to choose the one that suites him or her,
    But I think the government should look at a higher amount being collected by the Landlords as rent from tenants, some Landlords in Lagos are becoming more heartless by the day, In Olodi Apapa Lagos a 3-bedroom flat is now 1 million per year,

    This bill has good intentions, but is very impractical in Naija environment. Even abroad, Landlords collect rent in advance for 2 or more months as a hedge.

    A newly built house was rented out to a tenant in Abuja. The tenant paid for 1 year and refused to pay for another 3 years. She has just been evicted after one year in court. If she paid monthly, I am pretty sure, she would have paid one or 2 months before determining to live in the house for free.
    The guest is considerate of tenants which I think is nice but not considerate of the landlords who bring in the development to many areas in Nigeria.
    This I think is a shame as many landlords invest their life savings in their properties and many have loans to pay back!!

    I wish this bill can work.
    I wish I can be making monthly payments of rents instead of pulling out bulk sum to pay upfront.
    I receive monthly income, i would want my expense to be monthly too.
    This will also help Landlords. You can detect tenancy issues from the outset not when tenants owe landlords for years.

    Sen.Nwoko, I must thank you for your effort towards ameliorating the plight of Nigerians through your human faced bill if am to say. But please channel this your strength to the issue of how the price of goods in this country will go down. Also, like you made mention of salary skill , you guys in the senate that approves any money that will enter your pocket within two weeks but it takes you all through the existing assembly tenure to add 1naira to salary of government workers. Please look into that, once the price of goods comes down , the landlords will put that your concern into consideration.

    Senator Ned Nwoko has my support. In the 70s and early 80s rents were paid monthly in Lagos until landlords became greedy and exploitation set in. Collecting yearly rent from tenants keep them in perpetual poverty, all they plan is rent, rent, nothing is left for self development. The National Assembly should fast track that bill and give it quick passage.

It's up to the gentle men and women of the media to send their proposal to the committee to make the bill a reality. The proposed bill will cater for the greater number of people for greater good.

    This issue here is how many tenants can be trusted to fulfil their obligations of paying as at when due. Will the proposed agency have enough resources to manage large number conflicts of default from parties involved. How will the interest of the landlords be protected?

    He quoted UK, USA, Canada etc. Agree this is true.. But what the Senator forgot to add is that these economies run a credit system. While rents are paid monthly, before you get a house to live, every landlord conducts a credit check on you and your credit history and credit score will determine if you'd get the house or not. The landlord will also want to ensure that a would-be tenant has a verifiable source of income. Most people do not have a job or a verifiable source of income because it may not be the normal 9-5pm kind of job. You may even have the cash to pay and nobody accepts it from you if you don't have a good credit history or credit score..it is assumed that you may just go and borrow to pay the first month and unable to continue paying subsequently. like In the early nineties, rents were paid monthly in most places in Nigeria. Why did this change you may want to ask.

    Can you see the level of docility and how uninformed our senators are?? They fail to provide housing and basic facilities for the people, but want to inflict pains on the investors. Why couldn't government build and subsidize to low income earners like we have in U.S, called section 8. The purpose of this proposed bill is to generate revenue not for the poor people

    This makes no sense. We are in a country were salary's are not paid on time. What is being created is a situation whereby squatting will be a norm.
    It is one thing to bring in a law that is viable, but its another to bring in a law just because you want to seem as if you are doing something.
    Also concerning registering, isn't that what the land registry is there to ensure that land is registered. This should be looked at under the Land use Act. This has. Nit been thought through.

    l will also like to say here is that buying a house in Nigeria should be abit stress free. In the uk you take out a morgage for 25years,but if you sell out you repay back fully. unlike Nigeria that ask you to pay back in 12 months or so. It too stress full.

    Since October 2017, my landlord always asked for increase of #50,000 every year. He refused to fix anything in the house including the plumbing which is always having problems.
    For the past 8 weeks, the water has not been coming up and the plumbers (more than 3) said they need to drill a new hole. We have not heard from him since he was told to do that.
    This is an educated man collecting $800,000 per annum on 4 flats. He would not fix anything no matter how dangerous it is. He is only nice when collecting money. He believes if he gets rid of the tenant he will collect agreement each time. Every year he would try to get rid of the tenant if you don't agree to the increase. Lagos state should do something because this man would proudly tell you "it is my house, I can do whatever I like with it".

    I am shock to know rents are paid 2yrs in advance. In some major cities in Cameroon, for the first year most landlords want a year and from the second yr it goes back to monthly payments

    I totally support the monthly rent, no employer pays an employee one year advance . Even though you borrowed money to build your house, the bank will not compel you to pay all your debt at once.

    Nigeria is not a clean country. Corruption would not let his idea work. I see trouble when the government gets involved in what should be a free market. Landlord dictates but people do not have to rent from him. They can shop around until a suitable rental agreement is found. I'd love to live in banana island but I can't afford it so I will not even try because it is just too expensive to live there on a middle class salary.

    This man doesn't know/understand what he is saying at all. This is not UK. Trust me, this will even drive up the housing cost. All they want is to keep tasking poverty.

    Houses are not even properly numbered in most places; everyone writes what they want. Mr Senator, how many houses are in Nigeria. We don't even know how many we are.
    This is a fo*lish bill. The tenants will still be the one to indirectly pay the cost of registration and taxes. All the government want is more money to satisfy their selfish desires.
    The most annoying things is him mentioning interest of the people.
    You didn't regulate cost of land, cement, building materials, labour cost, etc. Only the rent should be regulated.

    The bst solution to this is fir government to provide low-cost housing for tenants. Landlords should not be made to accept rent according to the amount of salary a tenant recieves. The cost of building materials today will not have this policy make sense to new and upcoming landlords.

    This will lead to shortage of houses as there are no incentives to build if the government want to regulate rent but not the underlying factors that make it too expensive to build in the first place. If they really care, they should make it biannual and wait to change it after the inevitable war between landlords/tenants that will occur. His argument is based on the false premises that tenants are willing but incapable of paying. Some don't want to pay because we love "awoof" too much.

      If anyone chooses to build or buy a house for renting, they should be prepared to take gains or looses(it's a business).
      You comment says it all, the same way the government acts like they don't owe the citizen anything after getting into office.

    Not all landlords are bad and not all tenants are good. While I support a softer rent regime for the tenant, landlords also need to be protected.
    There are many tenants who after they pay the first rent and enter your property, will refuse to pay any more rent and tell you to go to court since you cannot evict a tenant without an order of the court.
    These court matters sometimes take from months to years and during that period the landlord is deprived of any rental income and is still burdened with the cost of maintaining the property.
    Finally when the matter is slated for judgement, the tenant will secretly pack out of the property, usually leaving the property in a terrible state of disrepair. This is not fair to the landlord.

    What sanctions do you place on governments that fail to pay its employees for months, sometimes years as a result of which tenants are unable to pay their rents?
    How do you compensate the property owner when that happens particularly those who have to pay mortgage loans, and those whose source of income depend solely on rent?
    How do you help property owners recover unpaid rents and the legal fees from a tenant who is taken to court for default?
    Do you pay workers promptly, on hourly/weekly basis to enable them raise money to fulfill their rental obligations?
    A beg find better thing talk. Those in Banana Island, Ikoyi, Victoria Island, Lagos, Garki, Asokoro, etc, are they going to pay on a monthly basis as well?

    A rent control agency is LONG OVERDUE. How can landlords be collecting rent, 15% agency and legal, caution fee of 500K to N1m and diesel deposit fees of N1m and above? Madness!

    Dr. Abati. States in developed country set the Home policies for Landlords and tenants that all follow. Landlords follow what’s legislated to form their own agreements with tenants. So you can’t say that all powers lie with the Landlords because it’s their investment.

    Change Nigerian income before you talk about this. l love the idea, but the minimum wages in Nigeria are too low. How do you want people to pay rent when the income is #30000 a month. Is like 1000 a day it can't even survive one person talkles of the whole family. The idea is great, but something has to put in places. Is because of low income and none payment of salary, that is why landlord demand for rent in advance for year and more. The country economy has to fix first. Don't get me wrong, it is a great idea. Also, monthly payment is another problem. Weekly or biweekly is the best.

    Ned Nwoko lived 35 years abroad, he could see a system that works, that's why paying monthly is not an issue. Their law abroad is binding on even the President or Prime minister as it were. When a tenant owes when it's a year payment who says he won't accumulate it for months and still wants to pay monthly. Why can't the government build houses and give it out on monthly or mortgage payments

    I hope the government would empower landlords to evict tenants for late payments. Government should not make private citizens responsible for the housing of other citizens. This irresponsible government should be responsible for something! They're not responsible for security, electricity, water, roads. What are they responsible for these bunch of thieves?!!!

    This is a myopic bill based on unoccupied buildings in Abuja and Ikoyi springing from unexplained wealth. Litigations over unpaid rents take as much as 2 years. And who pays the Cost of litigations. If this must happen then the must be rejigged and tenants made culpable in the event of default. And security deposit

    People don't understand the beauty of this proposed bill. It doesnt stop you from paying the rent yearly if you still so which, it only just gives you also the flexibility of paying monthly. It will make it unlawful hence, if the landlord tries to enforce you to pay beyond a month.

    Uk and America, one month, correct, but you failed to mention the homeowners got loans from banks at a ridiculous low single unit interest rate. What are the costs of building materials today in Nigeria? What is the cost of borrowing from the banks? Mr Senator tell us how much you pay for the one month? Govt should build low-cost and medium housing units for its citizens. I borrowed money to build my house at unreachable interest rate and u want to determine how to recover my money. No wahala, I will charge monthly, like the US, the equivalent of $1200 minimum for single bedroom, that's it.

    If you understood how things works at other places that you have being, but you and other senators are there while mountain is on the fire in Nigeria. Paying rent monthly will create more hardship for the citizens. You think that everybody will afford to be paying monthly? It's easier for yearly. I live in abroad and i understood how hard it's to be paying monthly. And by paying monthly will help the landlord to get his money in large enable him to use it and invest in other things. Or are you jealous of landlords? My dear that's not the major issue to solve the Nigeria problems.

    There must be a law compelling Tenants to pay every month. Failure to pay after after a few weeks should result in vacation. In America if you do not pay your rent, you will be asked to vacate and you must vacate. That is the law.
