Ang point ni Du30 is this is a hot topic that even if we defend our zones, it may be seen as a threat to China, and if China rages war against us, kawawa tayo, and Du30 is doin this to keep us alive, it is a serious matter but may tamang panahon jan, survival and safety of the filipino is a priority
How about the decision of the PAC that Chinese , along other littoral states , can fish in the EEZ since it is considered a fishing ground? Its decision is based on the UNCLOS. Besides, EEZ doesn't technically mean that you have FULL CONTROL over it but PARTIAL in jurisdiction and economic nature. Therefore, the constitution is in conflict with that international law. If the argument is our Constitution prevails over other international laws, then how can that be enforceable at international level? Bilateral talk? War? What else? So what are the practically optimal solutions then?
On the other hand, why Mr. Carpio is now changing his tone that Chinese must not fish in the EEZ contrary to his statement before that we can share? In fact, even the late beloved MDS had the same opinion.
Obviously, one of the problems is that Chinese harass our fishermen. Why? Simply because they also have sovereign claim over the area which is ridiculous because it is in our EEZ. So the PAC could not even do anything to resolve it since it has no jurisdiction over this issue. It JUST clarified that the disputed area is in our EEZ and warned that Chinese and other states must not drive our fishermen away. Period.
Atty. Batongbacal even implied that that area is no longer sustainable and we can't even have the capacity to make it surplus. So instead of being hostile to each other, isn't it more sensible that the Philippines and China, along with other littoral states , should come to an agreement on how to restore it for our next generations?

Ang pagsukat po ng EEZ ay sa lahat ng direksyon. Tama po kayo na matatamaan ng Philippine EEZ ang katubigan ng Malaysia at Indonesia, nag-ooverlap ang EEZ ng mga nabanggit na bansa. Base po sa quick research ko, mayroong agreement ang Indonesia at Pinas na Border Crossing Area Agreement (BCA) noong 1975 na binuo alinsunod sa UNCLOS. Ayon dito, in-allow po ng Indonesia na pumasok at mangisda ang Pilipinas sa kanilang teritoryo at ganoon din po ang kaso sa panig natin. Kumbaga maaari ang "sharing" na mayroon pa rin namang mga nakaangklang limitasyon. Kasama naman ang Malaysia, mayroon ding agreement ang tatlong bansa na Trilateral Cooperation Arrangement (TCA) na in-establish naman para malabanan ang banta sa maritime security ng bawat isa dahil nga magpahanggang-ngayon hindi pa natutukoy ng Malaysia, Indonesia, at Pilipinas kung aling parte at hanggang saang katubigan ang talagang sakop nila. Sana may nakuha po kayo, puwede n'yo ring i-search 'yong mga kasunduan para mas maliwanagan, hindi ko na rin kasi nabasa nang buo. Ganda po ng tanong ninyo!
