I am from Gujarat.
Recently our society got two offers from builder
(1) Redevelopment of cooperative society where we live now. Rs 20000 rent/ month+ 20,000 rs transportation+ gift money for furniture after completed scheme 8 lakh Rs.
(2) Exchange flat of another society of that builder which was completed (different area in same city).
We are total 60 members but 5 members are not ready in above-mentioned offer. I am one of them. We would like to take reasonable money like 75 lakhs and exit from society. Currently price of our flat price is 55 lakhs. So, I can buy house in village.
I read in newspaper 1.5 yeras ago that
" government do not give any clarification about Cooperative society".
My question is if builder are not agree then can I go in court.

Hello Sir, during the conflict between the Managing Committee and society members, where 11 society members reported that the tender process and the appointed builder's intention is not good and not capable of this project. Eventually from the registrar court, it went to Supreme Court and the Supreme court had given the order that the Court can not take the risk with the life of society members as the building is very old and it is risk of life to stay there. The appointed advocate by these society members had kept mum at the 11th hr and now the Managing comitee and Builders are creating pressure of Suprem court and threatening people that you are not following the order of court. Can you please advice on the same? What should people do in such case, All members are share holders.

are you suggesting that no society should go for redevelopment then what shoud the society do then?
Let me flip this question around: SUPPOSE our country's system has some machinery that NEEDS some families to be the human sacrifice i.e. some families have to fall into the machinery, and let their blood and fleshy pulp lubricate the pistons and gears and other moving parts. ARE YOU WILLING to let your family become the human sacrifice for the good of our country's system?
I am suggesting that the present SYSTEM OF REDEVELOPMENT should be changed and not accepted blindly by housing societies and their members. In the present system, all the RISK & POSSIBILITY OF LOSS is loaded on the shoulders of the families of flat-owners in the society going for redevelopment.
@@KrishnarajRaoUrbanNaxal thanks for replying. I just had this idea so let me know if i am thinking correctly. Say the building is very old and cant be repaired beyond a point. Is it wise to just sell off the land and distribute the money among the flat owners rather than getting stuck in a redevelopment project for years as you said.
@@royalh1261 Yes, exactly correct. Just sell the land and distribute the proceeds. Don't enter into a barter trade with a redevelopment builder who will con you into accepting ALL THE RISK while he will reserve all the rewards and profits for himself.

Does every problem in your life have a solution? In my life, many problems have no solutions. So, when your flat gets old, sell it and move away. Let the person who foolishly buys your flat deal with the risks of redevelopment.
