before federalism is implemented an amendment to the constitution is a must pursuant to Article XVII of the 1987 Constitution, the laws remain valid unless they are repealed. kaya nga yung ibang mga Presidential Decrees ni Marcos ay valid pa rin now kasi wala pang bagong batas repealing them

Hi. May nakadebate po ako about sa issue ng same-sex marriage and I choose pro since I'm part of LGBT at may jowa po ako same-sex for 2 years. To make the story short, sabi ng kadebate ko na same-sex marriage is unconstitutional because of framers intention (because there is no express prohibition but some framers are religious persons). But I hypothesized that the framers didn't put the qualifier "a man and a woman" in Article XV because it would make Presidential Decree 1083 or Muslim Code of the Philippines as unconstitution because it allows polygamous marriage among Muslim Filipinos. So once the Congress legalize same sex marriage or union, it cannot be declared as unconstitutional for the reason our constitution is silent about the gender of parties involved consistent with the principle of Verbis Legis Non-Est Recedendum. The silent treatment in constitution means discretion on the part of legislative to make a law about it. So we can also say thay Family Code that defines marriahe between a man and a woman is also constitutional because the legislative exercised valid discretion to define and limit it. So I think, discretion is political question except when it triggers the expanded power of judicial review (grave abuse of discretion resulting to lack or excess of jurisdiction). Tama po ba yung interpretation ko?
