Mother should provide receipts for the year and the amount should be re-calculated accordingly. I'm in a situation where maintainence payment made it impossible for me to stay where I was living. They do not take into account the cost of daily living ect. For example, most people have to pay bills and don't earn much more than minimum wage, most people can't afford to buy a used car without taking out a finance deal. . So you see, it's a caste.

Hi, I have joint custody 50/50 of my little boy. One would assume that neither parent would need to pay child maintenance but because my ex partner receives the child benefit and only one person can claim it she is classed as the parent with care so the child maintenance service say I still need to pay. How does that work fairly?

Thanks for the question, but, honestly, it would need a conversation as it has to be tailored to the case, and your financial circumstances and so on. We would need to talk numbers. hello@courtwingman.com if you wanted to follow up ...

What is the charge when a cohabitation agreement needs to be changed due to father moving out - what else do we need to think about apart from child maintenance when separating

You need to agree who owned what percentage of the property before he moved out and what percentages there will be, if any, afterwards. You need a trust deed or declaration of trust to enshrine this and it should be lodged with the land registry.

If there is a child involved and me and my partner separate, he has moved out - how much does it cost to change the cohabitation agreement to change it to reflect the changes.

We would need to look at your case, it's just not possible to answer. Could be £250 - could be £2,000. It's so hard to tell without looking at it all and seeing what is needed.

CMS have cleared my bank acount, got a letter from my bank saying they could not take my mortgage payment…
In January this year I had been paying down arrears at the time £1100, I was paying £200 extra to bring it down and I have texts between my ex and myself agreeing every time a payment was made the new lower balance.
I have paid every month since at a higher rate so couldn’t pay the additional £200 but was paying £30-50 extra.
I get a random letter a week ago saying my arrears were £7000 and they will be taking it from my account, I have been calling them to sort it before that happens, I was told by 3 different people on 3 separate calls it would not happen and I would be contacted by enforcement, no one has called back.
Now my account is at zero, I have no money for bills, mortgage, car finance, insurance, nothing !! What can I do ??
