One way to look at the oath of office is standing. according to the law and officer without a properly subscribed oath of office does not have standing to make an arrest.

Everyone's forgotten about the oath of office, the reason is an oath of office is useless for a federal citizen, maybe not quite useless but it is nowhere near as powerful a tool as it is when wielded by a Fourth Article State citizen.

In California, a officer is guilty of a misdemeanor if they do not take you without to a magistrate. California Penal Code 145. (Enacted in 1872).
A officer is from the electoral branch of the government. Only a officer from the Judacial branch can make a legal determination against you.
Practicing law without a license is against State BAR Rules.
