    Sorry to add this onto an older video, but it's a Vexels question. I just had a brief look around the whole Vexels' Merch Store and Merch Maker tools they've added, and was almost instantly overwhelmed by how one goes about setting up a store there. I did manage to pick a name and vexels url for my store, then my brain sort of shut down trying to figure out the rest, and I've set up different online stores so I'm not a total novice. Anyway, I was hoping you'd do a video or even a series on this whole new aspect of Vexels that they've introduced. Thanks in advance!!

    I've seen the brand THERAPY. It's usually embedded in their clothing in the tag. I don't think using words like that in a sentence outside their trademark or different contextualization would get you into trouble. Such as Coffee Therapy with the image of a coffee cup would already imply it has nothing to do with their branding. I would only think something like this would apply if you tried to start another clothing company and called it THERAPY, then they might find out and come after you. Even if it's just a picture of someone laying on a beach with the word Therapy under it, that would also imply it has nothing to do with the company THERAPY. I could be wrong, but I think in a practical sense this is how it would work.

    • @PhilipAnders
      @PhilipAnders  ปีที่แล้ว

      yes I totally agree with you for the most part. I just know that the amazon algorithm which rejects listings doesn't really follow this logic. It often just sees a trademark and therefore give you a rejection which has a bad impact on your account

    Hello, thank you for all your valuable videos. I would like to know if the Etsy algorithm recognizes copyrighted words, such as the word "therapy," even if it's just printed on the shirt but not included in the title and description. Does the algorithm recognize text from an image? Additionally, I would like to know what happens if a trademark is registered after the listing is published. Should I periodically check all my listings on tmhunt? Thanks again for your valuable contribution. I'm eagerly hoping for your response.

    • @PhilipAnders

Sorry for the trivial question but I'm now starting my experience with print on demand. Thanks

    • @PhilipAnders
      @PhilipAnders  ปีที่แล้ว

      Good question! Trademarks are confusing. In your example the sentence "home is where I feel happy" would be infringing on the trademark "home is". So it's technically not allowed

    Doesn't trademark work for a whole phrase? Like if "capyabaras are my therapy" isn't trademarked as a whole phrase is the trademark on the word "therapy" alone actually valid?

    • @PhilipAnders
      @PhilipAnders  ปีที่แล้ว +3

      You could be correct, I am not a trademark expert. And in front of a court that may be a valid argument. Unfortunately the amazon rejection algorithm doesn't work that way though. You can definitely get rejections for single word trademarks even if they are part of a phrase

    That's pretty weird (trademarks & copyrights). So if I come up with a slogan saying "I need hug and cuddle therapy" I cannot use it because the word "therapy" is trademarked? So in theory I could go out there and trademark words like "love", "peace", "unicorn" just to make other designer miserable 🙄

    • @PhilipAnders
      @PhilipAnders  ปีที่แล้ว

      On most marketplaces selling a sentence like that wouldn't be any trouble. I just like to caution people because amazon can be really strict and ruthless. But yeah it seems like you can trademark any random word

    Hello. As a note from someone who owns several trademarks; you cannot own the exclusive rights to a commonly used word as therapy hence why there are tons of uses of the word in several word marks even those specifically for t-shirts. When we submit a mark with a common word there is a line that says we understand that we are not claiming the sole use of that word. My lawyer points this out everything we submit a trademark with a common word. You can of course confirm this with any trademark lawyer.

    • @PhilipAnders
      @PhilipAnders  ปีที่แล้ว

      Thanks for the headsup and I totally agree with you. The only issue is that amazon merch has a rejection algorithm which sometimes doesn't follow this logic. It just sees a trademarked word and automatically rejects it, regardless if it's common or not. And as too many rejections lead to account closure I typically recommend to stay away from most trademarks as possible. I wish they had a trademark lawyer judging rejections instead :D

    The trademark thing is wrong. The only way it would be infringement is if you were having single word 'Therepy' like eg Nike lol. You can't trademark a single word and say someone can't use that in a slogan/thrase unless the Nike example again 'just do it' obviously that would be infringement
