The IRS will send out notices and warnings prior to the SFRs or 6020b returns being filed and the TP can petition tax court or appeal if the numbers are wrong. If the TP purposely doesn’t file, that’s cheating the system and evading tax, especially if they’re high income

Based on my experience with IRS I cannot accept the assertion that the IRS is almost always right. The revenue agents I have worked with have mostly been ignorant of the tax code and are dishonest. Having studied tax law at NYU I think I know what I am talking about.

I would say that I agree with this for the employees who have been in IRS for years and maybe never had non government jobs. But the new hiring is of a lot of highly qualified people from public accounting with a high degree of knowledge and experience. They are also able to use that knowledge of accounting industry and the pitfalls associated with high hours of compliance, that they can effectively learn audit procedures and be more of a threat to taxpayers. Public accounting has become so bad the people are bailing for hiring paying irs jobs at high gs levels. But the irs still has a culture of assuming the worst of the taxpayer and it’s very pervasive and agents are susceptible to indoctrination. It’s crazy how quickly they get a mindset of taxpayers committing fraud and not paying taxes.

FYI IRS has No Authority to prepare your 1040 returns under 6020b. IRM Manual 5.1.11.6.7 clearly states the authority they have. If one works and lives in the Private sector, 50 states of the union, they are NOT required to file a 1040 tax return. You can Elect to voluntarily make a donation, but its 1000 percent not required. People living and working in the private sector were duped into thinking that its "Law" that they must file a return and did so without full disclosure. They were once Non-resident alien individuals who filed a voluntary form 1040 which then made them a resident alien individual, meaning they became a resident of DC, and now a 'Taxpayer". I have Revoked my election to voluntarily donate my hard-earned money to a corrupt for-profit corporation known as, United States, Meaning DC.

    • @NoelLorenzanaCPA
      @NoelLorenzanaCPA  3 หลายเดือนก่อน +25

It's clear you've done a lot of research, but there are some misconceptions here. The idea that people living and working in the 50 states aren't required to file a 1040 tax return is a myth that's been debunked many times. The IRS’s authority to collect income taxes is based on laws passed by Congress, specifically the 16th Amendment, which gives the federal government the right to tax income from all sources. The IRS is enforcing those laws, not creating them.
As for the “voluntary” part, it means you voluntarily report your income and deductions, but once you have taxable income, filing and paying taxes isn’t optional. Claiming otherwise can lead to serious trouble, including fines and even criminal charges.

@@NoelLorenzanaCPA The US Federal Income Tax is lawful, but only in one jurisdiction-the statutory United States. No Un apportioned direct tax can be lawfully levied within the Constitutional Republic, as affirmed by the U.S. Supreme Court. After failing to create a Federal Income Tax in 1895, the National Government made another attempt under the William H. Taft Administration in 1909. Through clever chicanery, Taft and Congress performed a work-around and got an act passed, which ultimately led to the creation of the 16th Amendment in 1913.
Few people know that the act and 16th Amendment apply to only one jurisdiction, the federal (statutory) ‘United States.’ This is a separate jurisdiction than the Constitutional Republic.
The version that passed created a 1% tax on annual incomes of $3,000 and above. This represented a tax on the top 3 percent of the U.S. population. What they left out was any provision to adjust the reporting threshold based on inflation.
Over a century later, very little has changed. The so-called “tax on the rich” has largely turned into a tax on every worker. The threshold has only been adjusted to a little over $9,000. The original $3,000 figure equates to roughly $100,000 in today’s currency.
The rate later became a progressive rate that averages around 29% today.
This is another tactic of the National Government. They get some legislation passed, and then later change it to benefit themselves.
I can get into all the Supreme court decisions, but not sure your viewers will understand unless they research, as I have.
      Have a Blessed day, Sir.

Thanks for sharing such detailed insights-it's clear you've done your homework on this topic. Honestly, some of this is above my pay grade, but you raise some interesting historical points. From what I understand, though, court decisions consistently uphold the federal government's authority to levy an income tax, and tax protesters typically don’t fare well in the legal system.
That said, I’m always open to learning more about these perspectives, even if they challenge the mainstream understanding. It’s fascinating how tax laws have evolved over time, and I agree that what started as a "tax on the rich" has expanded to affect everyone. If you have any more resources or insights, feel free to share-I’d love to dig deeper. Have a blessed day as well!

The revocation of election process is just a boondoggle. It does nothing because most people haven’t ACTUALLY made the election they’re purporting to revoke. Besides, the revocations of elections I’ve seen only revoke the persons election (if actually made properly) to be treated as a resident of the United States. It’s not a “one and done” except to the purveyors of these scams.

It is important to understand the “real” reason why people don’t respond to IRS letters. It’s because they are either scared or overwhelmed. If the individuals dynamics (nervous system) is already overwhelmed from life, family, marriage and finances to the point they are not on top of their taxes, then when a letter comes they are so afraid to even open it and add more to their already monumental overwhelm-ed-ness. Once the IRS understands this they can take a different approach. I have experienced this personally in a different situation but I called and actually found the IRS to be very helpful in resolving it with minimal pain. After the 2008 financial crisis banks were sending solution options to people but the same thing happened where they were too scared to open the letter that they missed out on what may have been a viable solution offered from the banks. Fear is what runs this world so you must recognize this and adapt so that you can better reach people.

As those programmers retire, these companies will begin to pay through the nose to hire new programmers who decided to learn COBOL. They will eventually do a cost analysis and either continue to pay extortion prices for these programmers or be forced to take a stable system and convert it to something else.

My individual return............I got the letter from the IRS. Said I owed 650 more than what I'd come up with and paid for 2023. A couple of calls to the IRS and I was able to find the problem, some unreported income from a brokerage account. Not a big deal but for many like me with simple returns I wonder why the IRS just doesn't send me a bill for what I owe or a refund if applicable instead of me having to do it then they check it. The IRS already has all the same numbers I have and we go by what they have anyway.
