  • Today we’re in Judge Gauthier’s courtroom for a sentencing hearing. The defendant has multiple open cases and convictions and has finally run out of chances. The court has extended the defendant repeated opportunities for treatment and recovery, but rather than follow through with those, he continues to pick up new cases, violating his probation on multiple occasions. Judge Gauthier is at his wits’ end with this defendant, and today is his day of reckoning. Watch to the very end to see the Public Defender’s arguments, and the logic behind Judge Gauthier’s final ruling!

When I was a Prison Officer I knew an inmate who was very nice, cordial, etc. He was supposed to do 40, but he did 20 and they let him out on parole. He was back in 3 months.

My maternal Uncle spent 42 years in prison. He tried to reconnect to with the family. Its been a fiasco the past 5 years or so.
He lives by himself, 650 miles from family and very few of us choose to associate by phone or text.
When I lived about an hour from Hin we got together for A 4th of July and one BBQ. Then shit went sideways.
His prison thinking kicked back in and he tried to be all tough guy with me and my wife and stepkids. Showing up unannounced, banging on the door.
      I almost shot him.
He made the choice to be an 'Outlaw'. The consequences are more than I care to dig into.
      It's tragic and infuriating.

I have sold drugs, I've done worse than that too. I've definitely been around when MUCH worse shit was being done by people I was close with.
After half of my friends went to prison for decades, I cleaned up my act. I'm lucky to have not been there when the shit went down, as I was on my way but got stopped for running a red light, and that escalated because my passenger had a small amount of weed on him. We were on our way to what would become the scene of a much larger crime, that made the news. It was one of the biggest busts in the area in the 90s.

With all do respect, I'm a recovering coke addict. 3 years sober. Addicts aren't clowns. I do understand being fed up with this behavior. I get it's repetitive and he earned a lawful punishment. No doubt. But addicts aren't clown. Something happened in life to each addict that triggered the start of drug use. And I know what you're gonna say, "I've struggled without falling to addiction". Good for you, if that's the case. Not everyone is built that way. We don't need to make addicts feel worse. It'll take what hope they have left to come out on the otherside sober and they'll turn right back to drugs when they feel all they are is a joke. BUT it's completely valid to be done with the behavior and deal the lawful punishment earned. It's okay to be irritated and pissed off. But we should all try hard to say kinder things in most stern ways when necessary. That's all 😊

He said I got it wrong - most criminals commit crimes because their intent is to not get caught, so this defendant did all these crimes with the intent to not get caught - - but I agree, once I'm in trouble I try my best to stay on the up and up so as not to attract attention to myself

I disagree. Being addicted to drugs is like a dog in heat, often there’s very little someone can do to stop themselves. It doesn’t mean somebody doesn’t need a certain amount of punishment, sometimes you can still gotta be punished for it. But act like it’s the same as eating too many sweets throughout the day is only something someone would argue that doesn’t understand it.
So I kind of wonder if the addiction facility should be locked instead of completely open. There’s reasons to have either, but they have a locked ward that’s at least somewhat difficult to get out might help people be able to control themselves a little bit more and stay to learn techniques. And not only learn techniques but have a chance to get time to get off the drugs fully before they are expected to have some superman willpower. Sometimes these people spend a few days in jail and then I released, then after they were released they enter a plea agreement to go to rehab, then they go to rehab even though they were just using drugs days before, and we expect them to have the willpower to stay in? There’s a reason rehabs don’t work, and that’s because often than not set up to work well enough.b
