    Twitch simply gives you a platform to make content on, they don’t employ you, you don’t get PTO. You can’t just break copyright laws because you wanted to stream for a living.

      Technically if you are a partner they do employ you. You have a contract with them that states your working hours and how much you get paid. But also don’t be lazy and watch a show and then complain you got striked

      So when someone signs a contract with twitch and streams there every single day and is not allowed to stream on other platforms And gets paid by twitch. Twitch isn’t their employer? I mean cmon sounds like an employer to me. Just a wayyy easier job than most that’s all

      Again I see this and again it is wrong. For low level streamer they are self employed. But higher level streamers have signed contracts with twitch and are 100% employed by twitch. They have to sign non-competes and everything.

      but there’s also the other part of being a public figure, and other people have watched that show on twitch before, and a million other points in the argument. I would be upset if my income was suddenly cut off though - which i think is the main point she should’ve made.

    DMCA bans should be looked at case by case because it depends if the person streamed multiple episodes or was just looking at highlights. It also depends if they actually said anything during it or paused it to give commentary or if they just slept through the entire thing

      Again, wrong. She has a signed contract with twitch. She had a set number of hours she has to stream or she will be in violation of her contract and won’t get paid. People on Twitch at higher levels have contracts.
      She can’t just “stream whenever she wants.” There are set hours.

      @@CM-ky5go yes, but she gets to decide when she does those hours. A contract is a contract, if she fulfils certain criteria then she’ll get paid extra. She still gets paid from the subs and donations, but her job is one of the most free jobs, you can’t complain about sick days when you could do a sick day stream. Her freedom allows her to make money out of almost anything, at anytime, so she shouldn’t have paid sick days because of that freedom. Yes, there are exceptions, and it should be changed, but there’s a difference between a sick day where you can’t get to work on a set time on a set day, and a sick day where you just stream whenever you want. There’s nothing stopping her from streaming less, or more.

    I think that regardless of whether or not you're an entrepreneur or an employee, there should be SOME kind of institution to take care of those needs. Doesn't even have to be the government, it could simply be streamers coming together to have a fund for that.
    I see it as akin to buskers and their revenue streams in NYC. Some of those guys take home $200 a night playing drums. Problem is that when they get sick, there's no system in place to ensure they don't end up homeless if they're not out there every night.

    Was a barber and owned my own buissnes- yah as a self employed person it's your responsibility to make a savings for sick time, vacation time, and taxes.
    I got sick and needed surgery. On top of rent I still had to pay I also missed out on thousands being out of work.
    If I didn't have a savings I would have been screwed

    DMCA bans can be unfair when you are an IRL Streamer and someone just so happens to be playing The Weeknd in the background, but if you're just watching a show like Forged in Fire or Avatar The Last Airbender or do something like that one guy who tried streaming an entire UFC Pay-Per-View but had himself in the bottom corner holding a controller to look like he was playing a video game, then you just need to shut up and eat that ban

    Twitch can sometimes be cruel to streamers yes, but this is a ban that YOU fully knew. You knew you were watching something that CAN be DMCA'ed.

    Yeah, even as a twitch Partner, you aren't an employee but a contractor. Basically, no work, no money. You don't get medical. You don't get vacation and you don't get pto.

    Although I don’t know the stream or contract of any most streamers have to stream a certain amount of hours weekly or monthly in order to keep the contract. I do think that the tweet is dumb since streaming does not make you an employee but it makes you a contractor since you are being contracted to complete a task for the buyer

    I saw another thing on this guy that had to lay off a bunch of workers and got shit for it because they could be struggling, to put it simply, you’re not entitled to a job, you’re not entitled to pay, you don’t get to break the rules and then continue expecting payment. If I commit a crime, I don’t get off scot free because my family would miss me, and I make a positive impact on people, because I still committed the crime.

    Twitch do not employ streamers there for streamers are not entitled to employee benefits such as sick pay and paid time off. As for the ban,don’t watch TV on stream.
