The problem is that a lawyer who thinks this case is worth taking to court doesn't deserve to be paid. Probably doesn't deserve to be a lawyer either, at least not when it comes to legal issues on that subject.
From what I understand, at the end of a civil case, the prevailing party can request that the losing party pay all attorneys fees. But it's up to the judge to grant the request based on various factors in each specific case.
@@cleetose I am from Canada not the US but this is what I have heard of US law from watching various TH-camrs like Steve. The funniest bit about the service is not how close to your office the other attorney's office is. It's that the plaintiff obviously had your address before they started.
Hey, friend Richter, knowing where and how to serve the defendant[s'] copy of the complaint is a necessary step in exercising your First Amendment right to petition for redress of grievances. I learned that back in the previous century in a "Law for the Layman" night course. I had that lesson reinforced a couple of years ago in a "Protest of Election" action against the official in the city where I live who arranged for the Mayor to be re-"elected" via a process where the outcome was certain victory even before the ballots were printed. Judge P. dismissed the case "with prejudice." And he did so not only because I should not be expressing opinions on matters of Law without being a member of the Shysters' Union but because I had only "informally" served the City Clerk's copy of the complaint. Betch'a cant guess why going to the City Clerk's office in person and putting it in their hand was not good enough 😂 !
Talk about “coming to court with clean hands.” There’s always that lawyer who will tell a client anything they want to hear, as long as that $$$ is paid up front.

Alternate theory based on personal experience as an attorney. I get things like this from time to time, and it comes from not shutting the would be client down hard . -- Pla's attorney is new and hungry. Pla is family friend. Pla has this whole thing written out on 3 reams of paper. She says, "sure, I want to help you uncle Jed-Bob." Then she sees the huge mess, but doesn't have the nerve to shut him down. She says, " that's way too long to file, I would have to rewrite it from scratch." Pla says "Naw. You are just trying to run up the bill. It should be more affordable because I did all the work for you. All's I need is for you to make this all legal- like and put the end bits on there, and file it in the right place...." And then she knows she should say, "No." but she's too nice, and too broke. So she commits a rule 11 violation, and puts her name on the end of some ramblings written by her client.. People used to try to do that with me all the time, and now maybe only every 6 months or so. I tell them cash up front, and I am rewriting everything, to only include legally relevant statements which I can document as provable. I also explain that shorter documents are more persuasive. We just need enough good arguments, not everything that ever happened. They counter that it's all true. I say that I sympathize, but I have to prove things with documents made at the time of the event, and will have to leave out everything else. Also that if they pay me to start this, and we can't find provable evidence, then I will end the project and they won't get cash back. That either causes them to take me seriously and listen, or leave. Either works. If we work together, I write out the skeleton of the case, with what legally relevant facts I need to prove, then give the client a shopping list. i.e. Find me a receipt for when you had the well put in, or a bank statement.
She must think if it helps her win at scrabble, it will help her case. Especially if she can use it in a triple word points section of the legal brief. Im amused by the thought of her watching this video series and reading the comments. Amused until she sues us for teasing, that is.

Frivolous lawsuits like this clog our court system and drive up legal fees.
This is why we need to have laws that lock down torts and why we need a complete revision of our laws away from a system based on the nonsensical English System of law. This is a reason our young people want to vote in a socialist system and away from a money driven capitalist society based on torts and other legal nonsense. We need to reform the entire legal system.
Francis L Mayer no. The answer is not tort reform. This problem is not caused by torts. Rather, whether the attorney is competent and filed a frivolous complaint.

Hey, friend Richter, knowing where and how to serve the defendant[s'] copy of the complaint is a necessary step in exercising your First Amendment right to petition for redress of grievances.

Alternate theory based on personal experience as an attorney. I get things like this from time to time, and it comes from not shutting the would be client down hard
