Abu qatadah ibne- rib i Radiyallahu anhu reported that Rasululla sallallahu alaihi wasallam narrates in a hadith Qudsi that Allah Azza wa jall has said: verily i have enjoined upon your ummah five times salat and i have taken upon myself an oath that anyone who observes them at their appointed time , I shall admit him into Paradise ; if anyone does not offer them regularly, there is no such guarantee from me for him ( I may punish him or forgive him ). @mdfisa4453 brother this hadith clearly states that the person who does not perform Salah "Regularly" there is no guarantee of him.. So yeah you can call that person non practicing muslim as he is not regular but still prays .. But if someones abandons completely, they are out of fold of Islam.

If you say the shahadah, and you believe that alcohol is halal, you are a kaffir, even though you say la ilaha illallah, because your kufr nullified your islam. In the same way, if you don't pray, even if you say la ilaha illallah, you are a kaffir because your action nullified your islam.
