Because of your info and being a part of your grandmaster course I just went from 50% to 100% as of 3/8/24 just off of radiculopathy upper and lower. I was actually gathering evidence for 4 other claims (3 high roller claims) before the ruling. Did not think I would hit 100% just off radiculopathy. I’ll still file the other claims bc I already did the work on them with all evidence and have an ITF open. Just makes my 100% P&T even more bulletproof when it’s all said and done when those get SC. So I thank you so much for all that you have done for me and other vets! Chow! ✌🏾😉

q for you @syrentertainment135, I've been at 40% for 20+ years and was hesitant to poke the bear for re-evaluation, but my VSO thinks I was underrated for radiculopathy / sciatica and nerve issues. was any of your increase related to mental health associated with your back pain? would love to connect.

Hello Jordan, I’ve finally hit 90% rating 😅. And now have filed an increase for my lower back rated now at 20% service connected. I’ve filed for an increase and filed for radiculopathy for both legs and hip problems. I have used your strategies through the VSO’s which has been a challenge! But, with your videos and their help I’ve hit 90% Thank You. Now I wait on C&P examines and praying for 100% P&T. I will keep you updated. I hope you and your family are doing great! 🙏

I am in the same boat as you. I have 90% disability and just applied for the 100% for my back. I had surgery when I was 87 years old. I am now 93. The VA does not want to give me that 10%. The reason is their stupid mathematics. I am still waiting for an answer from them.

I also made the mistake of being a c&p hero I can push through the pain which the noted but that didn’t change my final angle they noted. Also don’t downplay ur pain. Tell them ur worse day not necessarily ur pain that day.

Sir, I’ll retire in a year from now. I’m knee deep in medical appointments after 20+ years on Active Duty with one 15 month tour to Baghdad and I’ve 50 jumps. I’ve been given some good info from colleagues to get me started in the process, and recently had foot surgery. Your video was the first time I’ve heard of nexus letters. back in 2016 I got 40 for my back 10 for pain down right leg I told them that i had pain down both legs but it is not hurting on my left side ATM of the C&P exam so they only gave me percentage for one leg. . I have a grade 1 slip L5 S1 and a couple bulging disc above the slipped disc. I went to the DAV they filled my paper work out and sent it in, waited less then 4 months it came back you did not fall you did not get hurt during the military. Needless to say made me mad so I dug through my records pulled out the back injury and sent it in. Now at the time I thought that the VA looked at your records. I then ask the DAV doesnt the VA look through your records they said NOPE, they only look at what you send in and what the C&P exam results state / show. they did however send me to xray for my hip as well came back that I had degenerative hip disease in my right hip, which I am not getting anything from it.

I layed on a table and he had me lift my legs and that was it. I dont believe he liked Vets to start with he was very rude so i lost the claim. In ‘74 I was awarded 20% for spondilolsthesis (sp) in L5. In ‘11 Im had back surgery and had to fight to get the back to 40% and 20% for each leg for radiculopathy, which gave me a total of 60%. I have a claim in for and increase for back and both legs as well as secondary neck. They’re still working on it but the DAV let me know that they gave me 20, 20 and 20 from the neck which brings me to 80% and they sent me to another C&P for the back to see if it had increased?? They have 3 MRI’s for the back and en EMG showing severe radiculopathy tied to S1, L5 and L4 as well as severe neuropothy in both legs tied to S1, L5 and L4. No decision on that yet. And yes, I did give them a narative on how it severely affects my ability t do things. It went to decision letter the same day as the second C&P which Incomplied with, but the examiner did not want to hear anything about the radiculopathy or neuropothy? I’ shooting for 100 P&T and if I GET YHE N60% FOR THE radiculopathy, I’m home free. I know that I can’t get both for the legs but from what I’ve read they can combine them and max out out at 80% per leg. If I don’t get the 100T% P&T, there will be an immediate appeal. You thought on my chances. Thanks

I know this post is from two weeks ago, but did you have an actual in-service event? Also, did you have treatment from your in-service event all the way to the current date that’s so many people leave out. A nexus letter from a doctor doesn’t mean much if you don’t have chronicity of treatment. you have to show that your back pain is chronic and that you’ve received treatment otherwise they won’t see it as service connected. I know so many people that have a several year gap from their military service to when they started seeing a doctor about their pain, VA most likely will not connect something like that.

Ex: I just reviewed my record and noticed 4 months ago a physical therapist wrote that my front flexion was fingers 3” off ground. Also stated I can turn 45 degrees side to side. 1. I don’t remember being tested for these movements and 2. I barely can touch my knees.

  • @casuallevelexpert3112
    @casuallevelexpert3112 6 หลายเดือนก่อน

In the description of the rating 50%, how does the VA define the term “unfavorable” ? There is a percentage of range of motion for the other ratings, although it seems unclear what constitutes “unfavorable” at 50%. I’m currently rated 40% for DDD. I submitted intent to file last year and am preparing to file. I will be at 100% if granted radiculopy both right and left leg along with the bilateral effect (20%, 20%, 10%) without an increase from 40% to 50% on my back, due to other conditions/my combined rating. It will make me feel better to understand with more clarity how the examiner determines “unfavorable” motion, as the increase from 40-50% gives me more confidence of my 100% combined rating being awarded. Thank you!

My main issue is the lost of balance from my tinnitus, and the fact that I live with lower back pain my entire life since getting hurt preparing for desert storm. I live with depression and Anxiety as results. The VA. sees that as normal. What else can I do to up my disability rating for these conditions? I only receive 30%. Can I link or service connect my bad back and sciatic nerve pain to a concussion suffered while on active duty? Also, I was a mechanic. Hurt my back and knees due to my job. PLEASE HELP.

I was at a C&P exam a few months back and my percentage for my degenerative disc disease was lowered after the exam. I exited the Army with that condition and was not at the C&P exam for that condition. They did not check my range of motion either. Is this something they are allowed to do?

I don't have a diagnosis. I injured me back during training 10 years ago and was transported to a hospital, but I couldn't continue training until I was cleared so my NCO told me if I don't clear then I can't continue training and would separate me. I force myself to tell the doc to sign me off for full duty. It was denied once because the examiner said in the med record it said "you were fit for full duty" but in reality my back still hurts... Any advice?

I have 10% for lumbosacral strain and there are days when I walk down my stairs and feel like my back is gonna give out. I had this rated to me in 2022 can I still get an increase?

You’re wrong. I’m rated for back pain. I complained about radiculopathy and was denied because I had no medical evidence. I’ve had an MRI now and filed a supplemental.

I’m sorry to hear that, denials are part of the process. Once you’re feeling up to it, read your decision letter for clues to intricate what (if anything) you may have been missing to reinforce your claim.
Use that intel to strike more precisely on the next claim, many times it takes 2 or 3 times to finally get through

Doctors treat health conditions. It's not common to have one that will help you with a claim. At least that's true for most VA doctors.

@jprahl56560 so how do you make a claim on back issues if even regular doctors don't want to help you.
We have decided to go with anxiety claim. I didn't know this could be separate claim from his PTSD.

VA math doesn't add up!! I filed for an increase August 2024 for back. I was at 70% for various other claims. My back rating went from 30% to 50% but my total rating % only went up to 80%. I'm filing now for TDIU 100% since I have the requirements of at least 1 disability at 40%.

My primary care, doctor diagnosis my conditions. I don’t know any other way. It would be done. But for it to be service connected, you must have continuity of treatment. People always leave that part out. It makes a huge difference. It has to be chronic and you have to have been seeking treatment for your condition.
