Ador still responded humbly within the period demanded by Nwjns that they couldnt reinstate MHJ as Ceo since it is the companys BOD who has the business discretion to appoint mngmt. There is a reason why Korean Law explicitly allowed and specify a period of 14 days for a party/company to respond. We are talking about contracts, not a life/death situation where urgent care is needed. And all Nwjns demands are not even the responsibility of Ador as per obligations with their excl contracts. Legal courts are very specific and are strict when it comes to period compliance. Strictly and legally speaking, Ador was able to comply it Pls dont use make up words such as "spirit of the agreement". You have the right to terminate a contract when you believe it is breached. Now whether the counter party accepts that or not is another matter entirely. In my knowledge, newjeans is one of the most if not THE most promoted rookie group in kpop, the luxury brand deals right after their debut, their spotify deals and promotions, the cost of their mvs, the magazine cover shoots, the collabs, etc. I seriously cannot name a single kpop group that has had this quality of promotion in their first 2 years of debut. Ador has the full 13th floor of hybe and newjeans were provided with luxurious dorms in my opinion. Their gains far outweighs anything a normal rookie group would be provided with and that is undeniable. Their claims of bullying, like being ignored, finding cockroaches in their dorms (this one is just....) , rude comments are personal disputes at most (from an objective pov the company cannot control the actions of each and every employee), unless the company has actively violated contractual clauses, they'll find it hard to come out of this unscattered, since it's the group that wants to unilateral terminate the contract while not providing solid grounds or evidence. let's remember that the "dispute" between newjeans and hybe started due to them wanting mhj to be reinstated as ceo, all while mhj was still kept as their creative director. It needs to be repeated again and again to ostracise you from everyone else and to make you feel alone, such as in a school setting. But it seems to have only ever happened once if at all, as there is no evidence of it happening apart from one person’s word on the matter. The fact that it was claimed to have been said by an employee of a different company weakens the case even further and especially if the person concerned had already been slandered by you in the past. It happened when MJH was in charge at Ador but they didn’t report it to her or if they did, she did nothing about it. They only raised the episode later as an afterthought once MJH had been dismissed to try to blackmail Hybe into agreeing to reinstate her as CEO. That failed so now they are attempting to use it to defend their efforts to terminate their contract. But it falls well short of what is required for that as explained in the video. This is why they are not trying to get the contract terminated in court because they know they will lose. MJH is trying to cause maximum harm to Hybe using NewJeans as a weapon to fight her war but sadly the girls are too young and naive to realise this, having been groomed from an early age to believe she cares about them and they now have an emotional bond to her. They would believe camels can fly if she said so and that is the problem for them. Only their parents can save them but they seem to be taken in by her charisma as well which she uses to further her own ambitions. I want the girls to come to no more harm but it is hard to see how with bad influences whispering in their ears. I can do little but hope the best for them and no more.

Great video. Being non Korean my knowledge of Korean law is sketchy and is based upon general principles of law in other countries. Common sense usually prevails as business is basically the same in any country. Thank you for explaining the points in detail and particularly taking every one of the 8 contract breaches claimed by NewJeans and discussing their legal validity. I found that highly informative. This video has been needed for a while and should have tens of thousands of views unlike many that already have that are often misinformed.

They train them like a boot camp and make it deliberately tough to weed out the thousands of wannabes who would never survive in Kpop and who give up before long and then they start to process the trainees in readiness for a potential debut. Very occasionally there is real talent found and they have great potential but they have to fit into the model for a particular group. This creates the basis for Kpop as we know it and it is big business. Much bigger now than ever before. Billion dollar companies are now involved with investors pouring millions into the industry hoping to strike lucky with a top group that gives them a good return on their investment. That is why contracts are so tough because it is critical to the industry that investors get rewarded when they get lucky with a hit group and consequently trap a group in a company for a long time to ensure that is the case. We would not have Kpop otherwise and I wouldn’t even know about its existence. The themes are often repetitive and rarely show originality but that is what makes it so successful. People know what they will be getting and they like it. If they didn’t they would go elsewhere. A few groups buck that trend with a wide range of genres performed and have distinct personalities and styles that separate them from regular mainstream Kpop and an identity that stays no matter what genre they do. They can have great vocalists who can really sing live and who actually sound better live than the studio track unlike many more popular groups who think lip sync is fine in front of a paying audience. These are the groups I like to follow rather than the others who just follow tried and tested Kpop formulas. Artists are not really Kpop even if they sing only in Korean and are based in Korea because they usually have original talent and are not dependent on being spoon fed music. They are often less successful because they attract a niche following but are often very talented. However that is not where the money is and Kpop follows the money now that it is one of the biggest industries in Korea. It is also a massive driver for the tourism industry as so many tourists come having been drawn there by Kpop and Kdramas. It is hard to emphasise just how important Kpop is right now for the image and reputation of Korea and for the country’s economy.

I’d say you are correct about almost everything. Agencies are not so quick to hire MHJ. They e watched how she has handled this situation and how she betrayed the owner of a company interested in investing in her. The industry doesn’t trust her because they fear she would try something similar if they hired her. Also there is the possibility of her being found guilty of trying to stage a coup with ADOR and plotting to bring down HYBE - which by now we can safely say it wasn’t just a plot, but some of what she planned has actually come to fruition by her actions.
I agree…She may have years of experience and she may be good at what she does but she is a liability. I don’t care how good she is. If I was a music company I wouldn’t hire her after what she did to Hybe and New Jeans. If anything she can be hired as a temp. To say, NewJeans is a very valuable asset to HYBE is an overstatement. NJ debut went so well because MHJ promoted NJ as "BTS' younger sister". As a result, many BTSARMY gave support to the girls, just like we gave support to TXT at the beginning of their career, just to use our fandom power to boost a new group related to BTS. But after APRIL 2024 (when the whole scandal with MHJ blew up), ARMYs do not support the girls anymore since MHJ dragged BTS' name. Then when NJs started showing their ridiculous behavior towards ADOR, many of their own fans left. Right now, NJ is one of HYBE's artists with low earnings. Other HYBE artists like BTS members, Seventeen, TXT, Les Serrafim and iLLit are doing extremely well. Next year, GFRIEND will go on a World Tour and their comeback concerts are sold-out. So.... NJ's position in HYBE is not strong anymore. I'm sure right now, ADOR is probably preparing to launch a new group.

A very good, objective analysis. I don't understand how these simple laws about contracts ( internationaly recognized) dont apply to NJ. How can they think that they can win? The January Vogue shoot had been scheduled for a long time. After NJ stated in a press conference that they would only be attending scheduled by Ador events until December 29th, Vogue canceled the shoot. Now both Vogue and the NewJeans account (managed by Ador) and the JeanzForFree account (apparently managed by the girls themselves) have published covers and images from the shoot, which has evidently been reinstated. Some have thought that Vogue has signed with JFF (with whom? they don't have a label), but this is still the same shoot scheduled by Ador. The only difference is that the girls only appear under their stage names, and not as a group NewJeans. This may have only been possible if Ador and Vogue signed a further agreement in which Ador allowed Vogue not to name NJ. The girls presumably refused to appear in the shoot under the NewJeans name, and Ador bowed so as not to violate its branding deals with Dior, LV, Gucci, Omega and Chanel, who dress the girls in the Vogue shoot.

MHJ already cited that she planned to make Ador an empty shell. Tying up their only group in litagation is going to be doing that. A whole of of wasting the courts time and costing Ador/Hybe lots of money. Which is why they never petitioned the court themselves. Just my opinion because it seems to the only explaination. There is no way an educated lawyer said they could win this. Which means there is something else up their sleeves.
Just pay the termination fee and leave. Then they can go on with their lives. I mean they recently made donation so I am wondering why not use it to pay the term fee. The root cause of this is MHJ. Really appreciated the logical breakdown. The only part I disagree with and would be curious about an expansion of your position is that MHJ can go anywhere and get massive funding to create more groups. Because if there is one thing that investors do is constant risk assessment, and she has proven to be a huge risk. She planned to not only try and drain HYBE, has spent months doing everything in her power to devalue them via the media from inside information she had, but also showed no signs of repaying her personal loan from BSH. That's why from her perspective she absolutely NEEDS NwJs to stay with her because that is her only collateral. To me, it always looked like she is trying to drag them with her so, indeed, she could try and find investors, but with her January court cases finally occurring (after months of literally hiding from being served). The only way someone would take her on as a producer in the future is through a very narrow contract where she doesn't have stocks or power in the company, and frankly no access to company data. She's proven to be a risk to investors, forever. In my opinion, of course. 🤣
People can still hire MHJ as an independent producer. Kind of like gig work. HYBE's mistake was giving her an executive power as we can see what she had done with it. But they have no issue having her as a creative producer. In fact, they did offer her to continue as a producer, which she rejected.

First the boss got angry and told about it to the press and then suddenly there are telegram messages between MHJ and a family membered leeked. But my biggest reason I suspect they might not be united is because of their last press statement. It sounded really messy and they emphasised how they stand united. That hasn't happened in a previous statment as far as I can recall and people tend to remember claiming to be united in times a dived starts.

Ador sent a formal response to Nwjns within the timeframe given and even took steps they could to address some of their demands but within the legal/allowable boundary of what the company can do.
Dont question and equate the urgency of the situation with how fast Ador should answer to newjeans. There is a reason why Korean Law explicitly allowed and specify a period of 14 days for a party/company to respond. We are talking about contracts, not a life/death situation where urgent care is needed. And all Nwjns demands are not even the responsibility of Ador as per obligations with their excl contracts.
Legal courts are very specific and are strict when it comes to period compliance. Strictly and legally speaking, Ador was able to comply it Pls dont use make up words such as "spirit of the agreement". When those very demands arent even in the agreement with their exclusive contracts.

In my knowledge, newjeans is one of the most if not THE most promoted rookie group in kpop, the luxury brand deals right after their debut, their spotify deals and promotions, the cost of their mvs, the magazine cover shoots, the collabs, etc. I seriously cannot name a single kpop group that has had this quality of promotion in their first 2 years of debut.
Ador has the full 13th floor of hybe and newjeans were provided with luxurious dorms in my opinion.

It needs to be repeated again and again to ostracise you from everyone else and to make you feel alone, such as in a school setting. But it seems to have only ever happened once if at all, as there is no evidence of it happening apart from one person’s word on the matter. The fact that it was claimed to have been said by an employee of a different company weakens the case even further and especially if the person concerned had already been slandered by you in the past.
It happened when MJH was in charge at Ador but they didn’t report it to her or if they did, she did nothing about it. They only raised the episode later as an afterthought once MJH had been dismissed to try to blackmail Hybe into agreeing to reinstate her as CEO. That failed so now they are attempting to use it to defend their efforts to terminate their contract. But it falls well short of what is required for that as explained in the video.
This is why they are not trying to get the contract terminated in court because they know they will lose. MJH is trying to cause maximum harm to Hybe using NewJeans as a weapon to fight her war but sadly the girls are too young and naive to realise this, having been groomed from an early age to believe she cares about them and they now have an emotional bond to her. They would believe camels can fly if she said so and that is the problem for them. Only their parents can save them but they seem to be taken in by her charisma as well which she uses to further her own ambitions. I want the girls to come to no more harm but it is hard to see how with bad influences whispering in their ears. I can do little but hope the best for them and no more.
I strongly suspect the members did get legal advice directing this nonsense--from MHJ's legal team which would be protecting her and not them. If that is the case there are probably tampering charges to come.

Great video. Being non Korean my knowledge of Korean law is sketchy and is based upon general principles of law in other countries. Common sense usually prevails as business is basically the same in any country. Thank you for explaining the points in detail and particularly taking every one of the 8 contract breaches claimed by NewJeans and discussing their legal validity. I found that highly informative. This video has been needed for a while and should have tens of thousands of views unlike many that already have that are often misinformed.

They train them like a boot camp and make it deliberately tough to weed out the thousands of wannabes who would never survive in Kpop and who give up before long and then they start to process the trainees in readiness for a potential debut. Very occasionally there is real talent found and they have great potential but they have to fit into the model for a particular group. This creates the basis for Kpop as we know it and it is big business. Much bigger now than ever before. Billion dollar companies are now involved with investors pouring millions into the industry hoping to strike lucky with a top group that gives them a good return on their investment. That is why contracts are so tough because it is critical to the industry that investors get rewarded when they get lucky with a hit group and consequently trap a group in a company for a long time to ensure that is the case. We would not have Kpop otherwise and I wouldn’t even know about its existence. The themes are often repetitive and rarely show originality but that is what makes it so successful. People know what they will be getting and they like it. If they didn’t they would go elsewhere.
A few groups buck that trend with a wide range of genres performed and have distinct personalities and styles that separate them from regular mainstream Kpop and an identity that stays no matter what genre they do. They can have great vocalists who can really sing live and who actually sound better live than the studio track unlike many more popular groups who think lip sync is fine in front of a paying audience. These are the groups I like to follow rather than the others who just follow tried and tested Kpop formulas.
Artists are not really Kpop even if they sing only in Korean and are based in Korea because they usually have original talent and are not dependent on being spoon fed music. They are often less successful because they attract a niche following but are often very talented. However that is not where the money is and Kpop follows the money now that it is one of the biggest industries in Korea. It is also a massive driver for the tourism industry as so many tourists come having been drawn there by Kpop and Kdramas. It is hard to emphasise just how important Kpop is right now for the image and reputation of Korea and for the country’s economy.
Already Katseye is taking over New Jeans globally and Aespa, Lsfm domestically.

I’d say you are correct about almost everything. Agencies are not so quick to hire MHJ. They e watched how she has handled this situation and how she betrayed the owner of a company interested in investing in her. The industry doesn’t trust her because they fear she would try something similar if they hired her. Also there is the possibility of her being found guilty of trying to stage a coup with ADOR and plotting to bring down HYBE - which by now we can safely say it wasn’t just a plot, but some of what she planned has actually come to fruition by her actions.

If I was a music company I wouldn’t hire her after what she did to Hybe and New Jeans. If anything she can be hired as a temp. To say, NewJeans is a very valuable asset to HYBE is an overstatement. NJ debut went so well because MHJ promoted NJ as "BTS' younger sister". As a result, many BTSARMY gave support to the girls, just like we gave support to TXT at the beginning of their career, just to use our fandom power to boost a new group related to BTS.
But after APRIL 2024 (when the whole scandal with MHJ blew up), ARMYs do not support the girls anymore since MHJ dragged BTS' name. Then when NJs started showing their ridiculous behavior towards ADOR, many of their own fans left. Right now, NJ is one of HYBE's artists with low earnings.
Other HYBE artists like BTS members, Seventeen, TXT, Les Serrafim and iLLit are doing extremely well. Next year, GFRIEND will go on a World Tour and their comeback concerts are sold-out. So.... NJ's position in HYBE is not strong anymore. I'm sure right now, ADOR is probably preparing to launch a new group.

A very good, objective analysis. I don't understand how these simple laws about contracts ( internationaly recognized) dont apply to NJ. How can they think that they can win? The January Vogue shoot had been scheduled for a long time. After NJ stated in a press conference that they would only be attending scheduled by Ador events until December 29th, Vogue canceled the shoot. Now both Vogue and the NewJeans account (managed by Ador) and the JeanzForFree account (apparently managed by the girls themselves) have published covers and images from the shoot, which has evidently been reinstated. Some have thought that Vogue has signed with JFF (with whom? they don't have a label), but this is still the same shoot scheduled by Ador. The only difference is that the girls only appear under their stage names, and not as a group NewJeans. This may have only been possible if Ador and Vogue signed a further agreement in which Ador allowed Vogue not to name NJ. The girls presumably refused to appear in the shoot under the NewJeans name, and Ador bowed so as not to violate its branding deals with Dior, LV, Gucci, Omega and Chanel, who dress the girls in the Vogue shoot.

I don’t think many people who point out MHJs issues *morally* agree with Hybe. But understand that the likely legal consequences will not achieve a goal that is in the girls best interest but they do serve MHJ.
MHJ is not doing her due diligence to protect those girls, if she was she’d have made sure they had a solid legal case. That woman isn’t stupid, she’s calculated but she is not calculating for the girls interests and that is so apparent.

Really appreciated the logical breakdown. The only part I disagree with and would be curious about an expansion of your position is that MHJ can go anywhere and get massive funding to create more groups. Because if there is one thing that investors do is constant risk assessment, and she has proven to be a huge risk. She planned to not only try and drain HYBE, has spent months doing everything in her power to devalue them via the media from inside information she had, but also showed no signs of repaying her personal loan from BSH.
That's why from her perspective she absolutely NEEDS NwJs to stay with her because that is her only collateral. To me, it always looked like she is trying to drag them with her so, indeed, she could try and find investors, but with her January court cases finally occurring (after months of literally hiding from being served).
The only way someone would take her on as a producer in the future is through a very narrow contract where she doesn't have stocks or power in the company, and frankly no access to company data. She's proven to be a risk to investors, forever.

People can still hire MHJ as an independent producer. Kind of like gig work. HYBE's mistake was giving her an executive power as we can see what she had done with it. But they have no issue having her as a creative producer. In fact, they did offer her to continue as a producer, which she rejected.

First the boss got angry and told about it to the press and then suddenly there are telegram messages between MHJ and a family membered leeked.
But my biggest reason I suspect they might not be united is because of their last press statement. It sounded really messy and they emphasised how they stand united. That hasn't happened in a previous statment as far as I can recall and people tend to remember claiming to be united in times a dived starts.

I used to be neutral since i didn't know the full details and both parties has not provided evidence proven thru court. But my opinion become more leaning towards Ador after the press con they made. Like what? It's giving an impression that they didn't respect the contract/law. It is very suspicious when they didn't file a lawsuit thru court after they decided they have legal grounds to terminate.
