Hello Pratish, I thought the spouse of the H1b holder cannot apply for ITIN by filing taxes jointly. Below is the statement I found on IRS and W-7 instructions. Please correct me if I am wrong. ITINs for spouses and dependents. "For tax years after December 31, 2017, spouses and dependents are not eligible for an ITIN or to renew an ITIN, unless they are claimed for an allowable tax benefit or they file their own tax return. The individual must be listed on an attached U.S. federal tax return with the schedule or form that applies to the allowable tax benefit. See Allowable tax benefit, later, for more information."

If the spouse also passes substantial presence test, she becomes a US resident alien. And, when you file as married filing jointly it means your spouse is also filing. In such a case, shouldn't we select option c instead of e as per IRS's instructions for W7? This is confusing. Pls. confirm which option to select if you know.

I went to HnR block in Plainsboro they have acceptance agent there. For ITIN i just needed Bhavika’s passport and I94 and my W2 form and any other souces of income. They did everything else for me including filing the tax and ITIN

You don’t need an ITIN for driving license. You will have to fill up a form at the MVC which mentions that you not eligible for SSN and don’t have an ITIN. Ask them for a form and then will help you out. The form is also available online. Which you can print and fill up. Make sure to get notarised by a notary before you go otherwise you can directly sign in front of MVC agent with notarising

You don’t have to apply for ITIN number now. I would recommend applying it next year when your husband files his taxes. Easiest way is going to be visiting an HnR block with an acceptance agent and they will do everything for you.

You should get W2 by mid Feb and then you can file you taxes and apply for ITIN at the same time. You don’t need ITIN to file taxes. You can apply for ITIN while filing the taxes and it takes around 3-4 months to get the ITIN number.
@@SasmiMama As long you have stayed in US for 182 days (please check this) you can file as a resident as Married filing jointly and claim the Tax benefits. You just have to apply the ITIN along with filing taxes

When you file your return next year your tax bracket would be determined accordingly and you can claim a refund
