In case of gift- person does not become holder in due course as there is absence of consideration. So X will not become a holder in due course. He is just a holder. His title will be same as that of the transferor (thief). Since thief’s title is defective, X’s title is also defective

In the first example of holder in due course( as you told it is not) there is consideration as gift falls under exception of section 25 of indian contract act.
