Actually, you get MORE rights. I will give you one. In the state where I live, an inmate MUST be seen by medical staff within 48 hours of requesting NON EMERGENCY care.
I will will tell you for a FACT, that outside of custody, that person has no such right. And I will also tell you that in my own case, never been convicted or charged of any crime, I have a biopsy scheduled. It took 6 MONTHS to get.
I would have been seen much faster if I was in prison.

That opening sentencing statement is not one of an objective judicial statement for the punishment of a serial rapist. What she needs to say is that the outrage Cruz is displaying is something she feels and sympathizes with personally, but professionally she is required as a judge to not allow those biases to influence decisions; in this case, that means even if she believes the person is not trans and is using the system to abuse the real issues that justify those rights/laws, she has to honor the rights of self identified trans people willing to subject themselves to the criteria that they must meet to get that status. I am sure someone in her position as a judge and critical community leader that she has a network in place to ensure this person, or any “trans” person under these circumstances, is not just raping women everyday lmfao like “oh hey mr warden i know personally from undergrad that came to my wedding, this prisoner is on the way over and you may want to apply extra attention.” Lol
And by weakness, I mean admitting that universally condemned demographics of rapists and pedophiles may attempt to use transgender rights and protections in maniacal ways. But that is true of every institution- think of the rapist acting as a gyno being abusive. Or the weird little league coach. This is not a problem unique to transgender people and their institutional protections, but it does need to be accounted for, just as it is in those other situations.
