It was my SECOND Fed case. I thought it was automatically federal, but I know now that it doesn't always go down that way. For example, the feds don't always pick those cases up. It's only if the state turns it over to the ATF or possibly DEA, or if the Feds ask the state to take over your case. Here is the main reason they get involved: say for example you are in TEXAS and your gun was manufactured in TEXAS, it is NOT possible to be charged on a federal level. Reason being, the gun has to "interfere with interstate commerce". (crossing state lines and being found in possession of a firearm with a prior felony conviction, in a state or country where the weapon was not manufactured.) That is how it is considered a federal crime (in and of itself). However, if it is found in your possession along with drugs, or used during the commission of a crime (especially violence), it is an automatic 5 year federal sentence by itself, and it is to be served consecutive with any and all other sentences imposed.
