The bureaucrats responsible for these illegal acts should face consequences. Given that their own homes have been bought with ill gotten gains from their criminal employment, it's only fitting these bureaucrats' homes should be confiscated through civil forfeiture. Then they'll get a small taste of what it's like.

But from my understanding when it was originally wrote emanate domain was only to be used for necessary Naval Bases that absolutely had to have a certain piece of property for National security. So in my opinion even roads and schools is stretching it to the point of possible abuse.

    Press Release | August 5, 2016
    J. Justin Wilson
    Senior Director of Communications
Arlington, Va.- In a ruling that may bring an end to the years-long battle to save Charlie Birnbaum’s longtime family home from condemnation, Judge Julio Mendez today ruled that the Casino Reinvestment Development Authority’s attempt to take Birnbaum’s property was “a manifest abuse of the eminent domain power” and dismissed the state’s condemnation action once and for all.
“This is a victory for property rights, common sense, and the people of New Jersey,” said Institute for Justice (IJ) Senior Attorney Robert McNamara. “The CRDA’s position was that they could take Charlie’s property for any reason or for no reason, just because they wanted it. Today’s ruling emphatically says otherwise.”

I think the solution for eminent domain takings is they have to pay the appraised value of the property X 3. With payment of 3 times the value of your property, you can get anything you want to replace your house with extra money for beer to cry in.

    • @jvanstyn
      @jvanstyn 5 ปีที่แล้ว

@proven patriot I know that one is only given fair market value for one's property under an eminent domain taking. I didn't say compensation was awarded at 3X fair market value . What I was stating is that it should be, in my opinion. As it is, if one doesn't wish to leave one's house with a fair market compensation one doesn't have a choice. The cost of moving and purchasing a new place that is equal in value to what you left is always more expensive than staying put where you are. There is also the fact that you aren't going to get fair market value compensation in the eminent domain taking as well. Many people are stuck with what the government offers because the property owner is at a bargaining disadvantage.
Under my proposed 3 times the property's value plan, even if you don't get full market value, you will still get substantially more that fair market value and you will be able to better move on with your life and cover moving expenses etc.

They know the property value will increase. Sounds like the type of casino that gives 6-5 payouts.

Eminent domain should NEVER be used to shore up private enterprise, anticipated tax revenue etc be damned.

Imminent domain acquisitions should require paying the owner triple the value of the highest appraisal and the payment of all moving expenses and closing costs on a new property.

@Kevin Cortes: you are comparing two completely different things. When Europeans usurped Native Americans' land, there were no papers of ownership or buildings. They used the lands and lived off the bounty it provided. I am not denying the injustice of what was done to indigenous people, because it was WRONG!
This isn't 300 years ago, it is now! This man and his family PAID MONEY for their property, and have a right to expect to get fair value if/when they decide to sell it. Atlantic City wants to expropriate this land (under the guise of Eminent domain), though they have no specific use for it. So, it is purely for speculative purposes! To take someone's property for no good use, or to benefit the community, is reprehensible. A casino does not benefit the community. It benefits the city & the gaming establishment. This isn't the American way! This is the American Way of Greed, and should not be tolerated or accepted by any individual.

Years ago the state took property along a proposed interstate. A house remained for years that could have been lived in. What a waste!

Please keep fighting for your right to own the property! There are fine people at the CRDA and one of them is Mr. Rob Reed....I hope he is not fighting this poor man. There is another man placed in authority at CRDA whose name is oddly something like Mr. Grabland....its surreal.

Make them pay triple value and move on. The thing is even if he stays and they can't get his property, they're goin to build some big bright loud casino or something like it right up against his property at that point he won't be able to give it away. So the bottom line is you can't beat them.

What kind of "mixed use development" could work in Atlantic City? The casinos are closing and the town is a mess. It's full of empty houses. The city won't find tenants for the building.
