      “He was creepy”; From HER OWN TESTIMONY, she didn’t trust him, she lied to him and had her mom lie to him. She actively avoided him. It just doesn’t make sense that just this one time she decides to have contact with him, alone?
      Isn’t it possible that she was already drunk or high on her own and wanted a booty call? Maybe she even changed her mind and wanted it to stop but was too out of it to actually say the words out loud?
      I just couldn’t convict beyond a reasonable doubt.
      ‼️TRIGGER WARNING‼️ A video of an assault comes to mind. The woman involved is in and out of consciousness. Her eyes open only briefly once or twice during the nearly hour long video. The men are too drunk and excited to notice- after all, people often close their eyes during s3x and besides that, they are more focused on her mouth. She goes between weakly saying no to showing strong enthusiasm. For example, at one point, when the other men join in, she can be seen and heard grabbing at them w/one hand, actively putting them in her mouth with the other and saying, ‘yes’. While most of what she says in the video you have to strain to hear, she is slightly louder during what was presumably the most painful of what she endured and can be heard saying, ‘give it me’.
      She was absolutely too drunk to have consented, however, because of her enthusiasm, the men involved had no real way of knowing that. After all, people often close their eyes during s3x; they were drunk themselves, and she was putting her hands on them and pulling them closer.
      It’s not always about finding a lie. Sometimes it’s just a sh1tty situation all around.
      If nothing else, BOTH the video assault I mention above and this trial are examples of why it’s important to teach young women not to put themselves in these situations. In the video I mention, the woman was drinking at a frat party, had even intended to fool around. In this case, no matter what you believe she still was still hanging out with someone she admitted she found creepy to begin with. Just like a man would be stupid to walk down a dark alley, unarmed and at night, we as women need to get over ourselves and stop walking into dangerous situations!

      I’m a survivor of SA. My education is both in psychology and in the law. Women’s mental health center and halfway house, youth advocate with the state then law school. I *HAVE* the background to speak on this.
      Sometimes it’s not about finding a lie. Sometimes it’s just a bad situation all around. Frankly, her story doesn’t make sense. She said she found him creepy, she lied to him, avoided him, had her mother lie to him and refused contact. But she also admits to having a drink with him the night she was r4ped.
      Then there are the lies defense called out. This woman had no reason to lie, but did anyway, a tell tale sign in any interrogation which typically means the person speaking knows they’ve done something wrong and are trying to re-write their part in it.
      SA situations where the woman was definitely too out of it to consent are common, however the men involved sometimes have no way of knowing. In one case that was videoed, the woman involved DID mumble ‘NO’. But just like anyone half asleep or very drunk, she couldn’t quite get the words out and wasn’t very loud. Her meek protests were countered with the grabbing of multiple men around her and pulling them towards her, enthusiastically taking part. If the video didn’t exist, we would have only had the event from her perspective, in and out of awareness, the memory of saying, ‘NO’ and afterwards, waking up with bruises. Her physical enthusiasm may have been the result of a half conscious dream, a fantasy she didn’t know wasn’t real, but that IS what the men involved saw.
      We don’t like to say there’s no one to blame, because it doesn’t satisfy our need to take a pound of flesh or relieve us of the desire to punish someone- to hurt them because we perceive them as having hurt us. But sometimes, no matter how badly we want to cast blame, we can’t.
      I look at this, everything I’ve seen and then this woman’s own testimony and I think about what *DOES* make sense. What does make sense is that she was a heavy drug user. What does make sense is that she called this guy for a BC got *REALLY* high and hit him up. What does make sense is that she wanted to stop when he got rough but didn’t get the words out. Is it possible she continued to be ‘unconsciously’ enthusiastic’ even after she was hurt? Yes. Is it possible he didn’t hear her or might have relied on her physical cues instead of her verbal ones? Yes. And is it possible that there just may not be anyone to blame?
      Is it possible I’m wrong? Yes.
      It is possible that I’m not?
      And *THAT* - is reasonable doubt.

    I don’t want to disgust anyone but I need to clarify something. Rectal prolapse occurs when the intestine slips outside of the anus. It may not be seen immediately after trauma. The defense attorney insinuates that if she hasn’t had surgery & it’s been over a year, then there must not have been an injury. If there was no injury then she must be lying. 😡 As a woman, a nurse & someone who has many female friends, I can tell you that getting approval for surgery for conditions like rectal, bladder, or vaginal prolapse is not exactly easy. You can first be sent to get Biofeedback treatment & physical therapy amongst other things. Only after you fail those will surgery be ordered because….that’s how insurance works.

      Yep! I told a 1st yr resident I had it & she laughed & told me it was impossible. It's a problem with copd patients who are end stage like me. Unfortunately I can't have surgery to repair it due to my copd. I just have to be careful, not to get constipated.

      This happened to my MIL in the late 70s after childbirth. She said after her first appointment with her doctor, she felt so much shame and disgust at herself and her body, she felt the condition was her "punishment" for her marriage failing. The doctor told her "this condition" only happens to women who participate in an*l s*x. She told no one about what was happening to her, and managed to deal with it for two or three years. At some point, my MIL got the courage to talk about her prolapse to a church elder. This person went with her to the doctor, standing as a force to make sure my MIL didn't feel bullied or shamed about the condition. They were surprised when the doctor she saw explained the condition was a "normal complication" of "many things" that could happen to the body, especially childbirth. She was quickly scheduled for surgery to fix the issue.
      After working in the medical field on and off for 30 years, I'm forever disgusted at "professionals" who judge and shame their patients to the patient's face. I understand plenty of medical personnel discuss patients in secure areas, and I've heard some cruel things said. about "what the patient" did to create their situation. Making these comments directly to the patient in a judgemental/shaming way should result in sanctions against the medical person.

      I am just like her - she’s passive and when someone disgusts me, like after we meet for a 1st date or something, I am always nice and say stuff like she did to let them down easy, plus she had to be neighbors with this “creepy guy”. I don’t like being mean to people or them being upset with me, even strangers, but being nice doesn’t give an auto invite to violate her. That attorney is ick!

      Lets see if Judge Slaye thinks that they are allegations.
      It doesnt matter if she she had substance abuse problems or if she was flirting.
      Consent is a big thing. She had an affair with someone she thought she liked and knew.
      She didn't ask to be SAed and dr@gged into unconsciousness. She didn't deserve what happened to her.
      I'm glad the judge didn't put up with the defence attorney's bullying.
      Respect to Judge Simpson.
      I understand her lies, she didn't think they'd take the assault seriously.
      If he did do it he deserves to have his life destroyed by the conviction. He's old enough to know better. If he didn't do it he'll be on his merry way and continue with life.

      There is a big difference between being polite and just saying no to his favors (like drugs, rides, cans, cleaning). I got the clear impression that she was stringing him along till it backfired on her. And that's being charitable and assuming she was indeed sexually assaulted. She couldn't say enough how creepy he was and she avoided him, but he offers some weed and she's over to his place like a shot. SMH.

Asking for rides and to smoke a joint is small in comparison to drugging someone against their will and sa-ing them

      Especially knowing that her addiction would be central to the defense. It’s embarrassing enough to have been assaulted and to be an addict in recovery but to have to talk about it with a hostile defense attorney is even worse by far. I hung out with people that crossed all kinds of lines with me in my addiction because it’s a world of survival. It looks crazy to people on the outside looking in, but people in the lifestyle understand.

      Jessi has a disturbing history. She’s made false accusations against men before, and she’s had repeated run-ins with the police due to her treatment of her own mother. Just this year, there are police reports detailing incidents where she pushed her mother down the stairs and left large bite marks on her elderly mother's arm. She lies and cries and calls the cops.

      My daughter was date sa'd. She didn't tell me about it at the time as she felt like she had brought it on herself for getting into that situation and she never reported it. I told her that there is no excuse that overrides her ability to say no or chose not to go through with sex even if she had flirted, had drinks or was dressed in any manner that some people would deem "she was asking for it". All I see is the defence using these excuses to deem she brought it on herself. We expect that the perpetrator has no sense of self control if the victim gives them a scintilla of an opening to override a simple "no". If this is truly the case then we lower the standard of defence to that of an animal.

      I also had something similar happen to me. He was an elderly neighbor (80's at beginning) and the SA was a daily thing that I remember from around age 9 (I know TMI, but I started becoming a "woman" so to speak, very very early on. So in a way I guess "I was asking for it" because of it) but I'm sure it started way earlier, I was just too young. I didn't tell my parents because I didn't want them to blame themselves since it occurred a lot when they would send me over before school to wait until it was time to go to the bus stop. They both had to go to work It also occurred other times where I blamed myself and he manipulated me into thinking that and that I would go to jail too, so I never reported it and didn't tell my parents about it until after the man moved to be with his sons until he died (which happened in my mid-late teens). He would tell me he did it to his sick and dying wife liked and so would I. It has and will continue to effect me to some extent, even a couple decades after it stopped (only because he ended up with terminal cancer and his kids moved him). I feel for this young lady as the perps were both neighbors and the reminder is right next door. Having to live and drive by can be very traumatic and haunting.

    This defense attorney is a real piece of work. He just keeps falling back on "I don't want you to explain anything, just give me the over-simplistic sound bite I'm digging for." - no man, as long as her answer is responsive to the question, she has every right to explain it within reason.

    Literally NOTHING during cross examination means that he had the right to violate her. It doesn't matter if there were drugs involved. It wouldn't even matter if they had previously had sex. As soon as she said "no" and he proceeded to act, this 100% became a sexual assault. i know defense is doing their job so i cant hate too much but there were def times that he was out of line, especially when addressing Judge Simpson.

    i hate cases like this where you bring up shit like.. oh you chatted a year before... oh you agreed to dinner once... oh you get high.. all these are reasons it was clearly okay and signs you could not have been raped... the surgery thing sometimes takes time so why bring that up beyond me _ its not ok to r** anyone.. anyone you have dated not dated gotten high with said hi too __ its crazy some of the shit being pulled out ___
    just like saying oh well she dressed like that tho ( Also all the people talking about she wanted money or other things - wait until its your daughter your sister... ) he used her being raped hurts like no other _ flirting playing anything does not give the man the go ahead and consent ... so many men in the chat thinking he was wronged are sick ....

      @@jennyleekays I have see a documentary where a woman wrapped up in clothing for bad weather was attacked in the snow battered suffered SA was not found until the next day , it’s never anything to do with what they wear it’s all about power & control it’s about getting what they want , ❤️❤️

      Also, you can consent in the beginning of an encounter, then... in the act, decide you want it to stop, once someone decides they don't want to do it & say no or stop - that's it! The end of encounter, the end. So, nothing in the past matters, all that matters is that she said she didn't want to be doing it & he kept doing it. This guy doesn't get to hide behind these excuses. Even if she discussed doing an act of sex work with him in the past, it is entirely irrelevant.

      @thezachx not at all. He reacted to the defense attorney. The first couple of questions were fairly benign, but then the attorney was pretty rude to her about "looking toward the prosecutor." Judge Simpson admonished him, and he had an attitude from then on.

      100% I immediately cringed when he opened his mouth. Like dude, read the room. He’s also defending a guy who does and supplies drugs. So in that sense he’s just as “bad” as she is, so why is he treating her the way he did when the same is true of his own client? Where did the lawyer find that high horse? Also, has he never met Simpson? And how freaking difficult must it have been for a drug user, who had a somewhat close relationship with the defendant, to come forward? She’s brave. Just wow.

    As a woman who was nearly raped while I was drunk at a beach party, when you are impaired by drugs and/or alcohol, you don’t read signals as well as you should. It is easy to misconstrue what intentions the person has until it is too late and then it is so hard to fight because once someone has their body weight on you, and they grab your arms, it is suddenly out of your control. I was so lucky that his friends saw what he was doing and dragged him off me. They quickly got him out of there. I went back to my friends and never told anyone about it because I was so ashamed and felt like it was my fault because I was drunk and alone with him. I cried out and said no so many times, he shoved a handful of sand in my mouth to shut me up. I applaud any woman that goes to the hospital or calls police after they have been raped, based on my experience and also what we are seeing in this courtroom. The double edged sword of prosecuting a rapist is that the victim is usually the one on trial, and has to fight the idea that they “asked for it”, ie it was consensual.

    So, If I'm understanding the defense attorney here. If you had a potential sexual relationship be it for money or anything else, you cannot be assaulted later. because last time I checked, that's still assault.

      Abd it sounded like you also can't use the excuse that you cant date someone "because you have a boyfriend" when you don't. Of course women say that because its the only way to shut some men up. It doesn't matter the reason, ir what comes after the "no I dont want to date you...". Women are not logicbox problems to solve to get them to go on a date. If a woman doesn't say "yes, when, sounds awesome" then stop.
      This guy couldn't stop which is scary.

      No. The defense attorney is arguing that because in his opinion she was lying about these other things, she was lying about the alleged facts pertaining to the charges as well. Every time defense convinces the judge or the jury that they have caught the complaining witness on a lie, the credibility of that witness goes down. In a he said she said case, that credibility is crucial to the fact finder's determination.

      ​@@CrystalPerry-r3r Even if all that is true, and it may be, 1) that doesn't mean she wasn't raped, and 2) all rape victims still have to go through this processes when they press charges. It's this humiliating and painful. A story of a woman comes to mind: she was a cop and had investigated sexual assault cases before. She found the process of legally dealing with her assault more traumatic than the rape itself and wished she could go back and deal with the cases she investigated differently. She wrote an essay about it and I can't recall her name but you could probably Google for it. I've heard other accounts from men and women who found the trail process as traumatic as the rape and wished they never came forward.
      I think it's still important that victims come forward, especially in cases where they can prevent future victims by jailing the assailant. But it is an extremely draining and challenging process to relive an experience like that over and over while the defense challenges you in every humiliating way possible. It's exactly the kind of confrontation that would hurt the most following the psychological trauma of rape.
      I don't know what the answer is. All I know is that there are good reasons victims don't come forward, and after watching this video it's easier to understand why.

      she was doing all kinds of different substances -- was doing enough opiates to 0D multiple times needing to be revived. that habit is expensive, the txt messages contain stuff about "trade" for rides or whatever.... obvious she did some of this sort of work.
      totally lying about their relationship what else is she lying about.
      can't believe people on here are just so quick to think she's being truthful, so inconsistent with her story

      I still don’t buy her 100 dollar for one time thing, as for house cleaning. At this moment we don’t know who is being guilty and who is not. It is very difficult to prove with current evidence. Also it seems she has history of lying, if what defense claimed is true. The jury must get all facts together before passing final judgement. Also judge cannot take sides during hearing.

    I experienced similar situation at 17. The only person I shared it with was my best friend a the time and later the father of my 3 boys. He used it against me and no one believed me.

      I reported my assault to the police.
      I endured snickers, snorts, and condescending remarks from the male detectives.
      They clearly didn't believe me, and felt I was making an accusation against the "professional" man because I didn't want to "pay his bill." (My copays to him were paid in full each time I had an appt.)
      I gave the police a CD of the threatening voice mails from the man who assaulted me.
      Guess what?
      I was told the "incident" was a "he said, she said" situation, and there was nothing legally they could do without more evidence or a witness.
      That was 25 years ago.
      I now endure seeing this man on the cover of a local magazine at least once per year.
      I feel your frustration.
      Something horrible happened to you.
      And people think you're lying, dreaming, making it up.
      They'd rather come up with all sorts of "reasons" why you'd lie, instead of believing you and helping you.
      That's what happened to me.
      The cherry on the top is when you trust someone enough to share what happened to you, and they later take the information to paint YOU as whatever "evil" person they want everyone to believe you are.

    I don't consider myself a perl clutcher, but I disagree with the "SA victims are at least partially at fault if there was no knife fight involved", probably I grew up with this Mantra. And Mike, I accept that you don't trust female intentions, mirror this onto "never be alone with a man if you don't want to raise his kids". And, I interpreted "her truth" as "this is what she remembers and not made up" after the defendant's attorney questioned everything she stated. Just saying

    Defense attorney trying to build an argument against her memory. Then he goes on to ask her questions about years ago.
    On top of that, he includes the word "assault" in most questions. For example - ' Did you remember telling the orthopedic doc that you dont remember details of the assault?' .. if it were me answering the questions, I would start each answer with, "thank you for recognizing it's an assault"

      This defense attorney is building such a weird narrative with no clear indication of her ever directly agreeing to or initiating any physical intimacy and just basing it on some complicated multi-person plot to entrap him so the neighborhood can kick him out and it’s come across so unsettling that it makes you wonder how he reads any supposed cues from the women in his life. He’s also equating that inconsequential memories are going to hold the same weight as a traumatic and significant one for her. I realize he has a job to do but it really bothers me that he thought these were based in any logical reasoning and don’t just make him seem kinda creepy as well.

      And it also bothers me how vitriolic and personal he’s made many of his comments toward her during questioning. I don’t know if he was trying to push her into a corner, but it’s doing the opposite and making him seem overly combative and emotionally invested in an unprofessional way.     I just want to point out that prostitutes/trafficking survivors/CSE survivors are absolutely credible and they experience SA (which often includes murder) at much higher rates than other women. The idea that a prostitute is automatically lying just by virtue of being a prostitute is so disgusting. I hate this defense attorney so, so much. It’s one thing to do your job; it’s another to be an a-hole while doing it.

    I can’t stand the defense attorney but I think if he had not started off so hostile, things could’ve gone better. He created such an ugly atmosphere and I think he doesn’t know how to read a room. I know he has a job to do. I totally get that a man’s life is greatly impacted by this, but as a woman who would rather be hit by a bus than hurt someone’s feelings, even the creepy guy next door, I could see myself saying some of those same things, but that doesn’t mean I want a sexual relationship. It is a horrible character flaw to have, to be that afraid to be honest, but it is a hard thing to overcome and be ok with someone thinking im rude. Then I’m called a bitch.
    I’m trying to raise a daughter that isn’t afraid to hurt feelings because I know the repercussions of being too scared to be honest.

    I’ve always loved true crime and during my Bachelor’s program, which is in accounting, I became very interested in law. While obtaining my MBA I was going to pursue a CPA license and I also decided I wanted to go to Law School. Unfortunately, I became very ill and became disabled and was unable to do either. I did earn my MBA, one of the best times in my life. At any rate, Mike, LTWM and the Old Squisy Gardner channels bring me up close and personal to court cases and I have learned so much. Thanks to the both of you wonderful gentleman.
    P.S. Mike, I am an old woman and it is my opinion you get back on the horse. You are brilliant, funny, handsome, and I bet a catch! Any woman would be lucky!

    Dude covered his tracks best he could and thought the court would throw it out with their common sense as well. If dude was, in fact, supplying money and rides to the woman, it would not make sense to ruin this with a fake claim. Bro is a pred and thought he could do whatever he wanted because the woman made some bad life choices.
    Just as people say that women shouldn't put themselves in bad situations where things could happen to them, neither should men. I'm sorry this woman had to report her assault and recount it before everyone. Guy felt entitled to take what he wanted. I hope he learns his lesson.

    As a prosecutor, I applaud the zeal with which the defense attorney defended his client. However, this is one of those times where lawyers can learn a lesson in credibility. This defense attorney probably lost objections he had meritorious grounds for winning because of his attitude and disregard of the Court's admonishments. Additionally, if this is how the attorney conducts himself at trial, he may lose likability points with jurors, and make them more sympathetic to the victim as a result. This is just a prelim, and while I see that he's trying to get the case dismissed at this early stage, this case is a likely loser for the prosecution at trial (I say "likely" because the jury pool in Washtenaw County, consisting of many educated, left-leaning individuals in the Ann Arbor area in particular, may be more receptive to the complexities that underlie the concept of consent, namely "consent may be revoked at any time before completion of the act," "being willing at one time doesn't mean someone is willing at a later time," etc.).

      Yes, thanks for the excellent summation. The exact same facts stated by the plaintiff could have been brought out in a very different way. It would have appeared better to the court if the allegation was false and if the allegations were true would not re-traumatise the victim.
      It is such a tricky subject but the prosecution and defence can handle it with compassion and still allow for honest testimony.

If anything, any bias Simpson might have would play into the hands of the defense on appeal. In fact, maybe the attorney is intentionally trying to goad Simpson into getting emotional and making unfair rulings so that the whole thing could get thrown out on appeal.

    In some way I wish we could have seen the defendant's face/reactions when the victim gave her testimony ... but on the other hand, it's enough that the judge can see his reactions. What a horrible thing to have happened. It does go to show that "just say no" doesn't work against a sexual predator.

    I think most women know why she’s saying and doing certain things. It makes perfect sense to me.

    Honestly, I've seen both situations personally, SA and false SA claims. The victim and suspect deserve the truth to be brought to light. The defense attorney doesn't seem to understand that the information he's taking to court has been extremely one-sided. He seems to be emotional from the jump, but good attorneys leave their emotions at the door. Maybe his client has him convinced of innocence. But, he seems to forget that even if the victim isn't one, his viciousness is doing him nor his client any favors.
    In the end, trying to get the charge tossed in prelim isn't going to work. The victim went to law enforcement immediately after the incident. It makes me wonder if the lawyer's intent was to unsettle the victim enough to get her to plead to the prosecutor to end it so she doesn't have to go through more at the trial.

      The surgery is like 5 minutes and outpatient IF they even need it. Sometimes you can just push it back in there lol or sometimes the doctor tells them to do kegels and sends em home... its also an elective surgery and most states have cancelled those for awhile with the Baxter iv fluid shortage due to hurricaine so she better start those kegels... the people who need surgerybfor this are rarely ever sent home. She stretched it with this....

    Some of you don't like the lawyer's approach but actually he is doing his best to represent his client and sometimes that's all you have to go off of. However I don't like how essentially scolded her and treated her like a child to yes and no questions. If she isn't answer questions properly the judge can instructor her or ask the the judge to rule it as non responsive.

    I think judge has a point. Why would he need to ask consistently if she was okay. Giving the stance that if he had to ask then maybe he shouldn't have moved forward. Why would he let her smoke and he did not which never happened before. Also she stated she told him no many times. Flirting doesn't mean a green light. She acted afterwards by telling him he took advantage of her. That's my take and im also an ex-victim when I was younger.

      How about, there are two sides to every story? We experience things through the lens of our experience. What one person interprets of a situation can be different from the other person involved. Speaking one's truth means honestly stating what happened from your point of view, doesn't have to mean lying. If he were to tell the truth, I imagine it would show that he knew she was not in a position to consent, and that she expressly said no.

    Wow, chat turned horrible in this one. So let's lay down some facts: 1) Consent can be given ONLY if the parties involved are of sound mind and mature age. 2) Coerced consent is not consent. Holding drugs over an addict's head to get 'em to do what you want is a form of coercion. 3) Consent can be revoked at any point, even during the act itself. If consent is revoked, all involved parties must stop. 4) Personal truth is greatly misunderstood. Personal truth has nothing to do with objective facts. It has everything to do with subjective experience. YOUR truth is how YOU view a given experience. 5) It does not matter what else someone has or hasn't done outside of the facts in the case at hand. Someone can be guilty of assault and still get r8ped. Someone can be guilty of r8pe and still get robbed. Someone can be guilty of robbery and still get murdered. 6) False reports are drastically fewer than real reports, and real reports are drastically fewer than actual incidents.

      She's already accused one guy of sexual assault, falsely claimed another was holding her hostage, and even made wild accusations against her own mother-who was later found at the bottom of the stairs with bite marks all over her arm from her. So, what's more likely: that someone who repeatedly invents serious accusations is lying again, or that a man with a clean record has done something terrible?

      @ yeah, I hope the same. It is a topic that often gets swept away in a headline and people forget or don’t think about the effect of it on the victim, their family, friends, employers. And it happens so much. But each individual case is interesting and painful and emotive. Have to say I was ping ponging with the examinations and it would be interesting to see how it plays out as it comes down to he said she said.

I think ya she strung him along to get what she wanted when she needed it and said “nice things” the keep him right where she needed him, in arms reach. He knew she was using him and I think the next time he invited her over to do drugs, he decided to give her something stronger and kind of took it from there, so to speak (meaning… she’s not totally dead so it’s consensual)

      I am only half way through, so maybe my opinion will change. But right now, I will say two things can be true at once. This lawyer has no tact and is making an ass of himself. And the harping on whether she had a boyfriend or not doesnt matter at all. Who cares if she was single yet told him she was not? Lots of women use that as an excuse to shut men down, she has no obligation to tell him her relationship status. But I also question her story. Telling him he was limited to touching her hair, knowing that she (IMO) used him for free drugs and free rides, I would not be surprised if she offered him a little something.

    Judge Simpson did not like the defense attorney! Attorneys should start recognizing the Judge swinging his chair is a sign of irritation. The attorney wasn’t pleasant; however, the judge should have instructed the witness not to embellish yes/no answers, as asked. Judge Simpson seemed to determine guilt pretty early.
