      Believe it or not, just remaining silent without invoking the fifth amendment has been ruled by the courts to be deemed suspicious enough for detention. You must invoke the right to remain silent to be protected by the fifth. Screwed up, huh?

      It may not be illegal to remain silent, however, staying quiet is not an assertion of rights. The best way to not speak in a way that cannot be misinterpreted is to state I would like a lawyer present prior to any questions, period. Or… state “I invoke my right to remain silent” and then shut up; otherwise, it may be misconstrued and not applicable. The courts do not recognize straight silence as an assertion of rights, nor speaking after you invoke your rights. Just be quiet.

Then maybe they will be inclined towards ending QUALIFIED IMMUNITY. Look at what has happened where it has ended. Bad Officers May quit and move to other jurisdictions and I say good riddance. They will soon get caught or have to change🙏🏾before they kill somebody(ALTON STERLING).🙏🏾

    The fact they are so easily willing to say "sue me" just shows the mentality that Qualified Immunity has given these tyrants.. "sue me... what do I care, I'll never accept wrong doing. You and the rest of tax payers will pick up the bill." Qualified Immunity should be abolished and every badge should carry liability insurance.

Almost as if the people running the show are all typically hiring little "henchmen" for themselves to do their evil bidding almost like their little cronies or something rather than upholding justice and the law in a professional manner. What's the problem? I mean how hard can it be to hire sensible, ethical, professional, hard-working, moral, kind, educated, and normal people to do the job correctly???... 🤔🤔 Do we seriously live in a reality in which this is simply not possible?     The officer is legally allowed to ask almost anything. He can ask for your sandwich and he can ask you to wash his car. He cannot legally order that you comply with those requests.
    The officer is asking to surrender your rights for his safety. Who will protect your safety?

    The issue with rolling the window down all the way is that now cops, who know they're being filmed, use the fully lowered window as an excuse to claim that they smell something and now have probable cause to search without your permission.

We have the "RIGHT", don't need permission, to record our public officials in the performance of their duties, while in public. I am not saying public officials conduct themselves properly at all times.. I am saying, when they do overstep their authority, they are breaking the law.

    Bonus fact: When in the military, your state license can be expire and still valid. Each state is a little different, but they all say your license is good for as long as you're in the military without having to renew said license.

      As you stated, having an expired driver's license depends on state laws. Some states only allow your licenses to be expired for up to 90 days while others may authorize up to six months. Are you actually saying that as long as I have an active duty CAC, I don't ever have to renew my driver's license? If so, that is incorrect. I lived in state A, my driver's license was from state B, and my car tags were from state C; and yes, if you are on active duty, this is legal in all states. Some states will allow having a driver's license without a photo; so if you have a DL from state A, then state A may allow you to mail in your DL and they will mail you your new DL without a photo on it.

      You receive your "official" state of residence when you enlist. That never changes except when you reenlist and that's up to you to change. Thus no matter where you live after that, you can' have a license in one state, live in another state. You can't have a vehicle registered in a third state, unless you've established residence there.

      That is not correct, you cannot go your entire career without renewing your DLs. Each state has its own requirements on how and when to renew active duty members' DLs. And yes, you can have a tag in one state, a DL in another state, and a residence in another state, or at least prior to 2016 when I retired after 28 years.

      @@james3588 According to the laws in my state (IN) you can go your whole enlistment without ever having to renew your license. Most states are that way, but i will admit there may be a state or two with different rules. The variation is how long you have to get a new license once you end your military service.
      Then there's the idea if you drive anything military while you're in, you have to get a military driver's license, which notes what vehicles you're qualified to drive.
      Btw, while i didn't serve 28 years in the military, i did serve as a personnel admin specialist (75B) at company and battalion level. And the only way you can tag in one state, license in another and reside in a third would be on a temporary basis, dependent on state law, until you can get them all under one state. But that would be a pretty rare circumstance.

Look over HIS shoulder and look at the tint on HIS vehicle and then explain why the police are allowed to have privacy in their vehicles but we are not?!? Str8 up BS!!!

    He’s in the military and this investigation is about an address that’s clearly on his license, so what more do they want, do they want him to give addresses to every military post he’s been on or foreign country he has visited?     IN "This day and age" the cops know if the vehicle is registered, to whom it is registered, and most likely what the registered owner looks like. The need for proof of registration is as pointless as proof of insurance sans property damage!

    If the state has a violation on the books for having an out of date address, then the officer asking if it's a current address is a violation of the 5th. Threatening the man with arrest if he doesn't verbally answer a question that could potentially implicate him in a violation seems like a pretty clear case of attempting to violate a man's rights under color of law. The license is on the address, as you say Abiyah, he's satisfied the requirements under the law. Too bad this officer is too full of himself to ever get how much of a POS he really is.

    It all boils down to an educated public. We have to educate ourselves as long as cops have the us vs them mentality and cops are allowed to lie. It always makes my head explode when individuals question cops if the cop’s actions are lawful. If you ask a cop “do I have to (fill in the blank) - the answer is always going to be YES. We must be able to STATE when something is unlawful. We must understand the best weapon against the cops is silence. Makes my head explode when cops try to intimidate with the threat of arrest.

    The beauty (for the police and justice sytem) of writing SO many laws is that EVERY citizen IS a criminal. It's impossible to go about your whole day without breaking the law. You'd literally have to sit in your home doing nothing if you wanted to not be a criminal.
    So when cops approach us they are confident in our criminal nature because that's how our country operates, legally.
    and even when you DO comply with the law, for example going below the speed limit, they STILL try to criminalize that and claim it's suspicious behavior and probably cause.
    it's pretty messed up.

    This guys skills in communication is great. Even when he disagrees.. he points out that his disagreement is not an offense to the officer himself but with his interpretation of the law. Very disarming. Also props to the cop himself..,. obviously a veteran and knows.. "hey man i'm just here for backup.. it's not my stop. But also does as usual come by and be the good guy and open a dialog. No hate on that honestly... that's their job to try and get anything out of the suspect.. that's why you should stfu .. More importantly is why I give this cop props.. when challenged he didn't get defensive and threaten, use force, etc.
    My guess is that he's been around so long as a LEO that he may have his opinions of what tactics on how to enforce the law but that's not how we do it now. Unfortunately we don't have video from initial contact or the ending. I would like to think this ended with reason over ego and i'm just doing my job and responding to a call, have a good day..but I don't think so.. curious as if you can get any follow up.

    when someone says they are not trying to be difficult or you are being difficul, it is them being difficult as they are condescending and verbally aggressive in trying to get you to say you committed a crime when you did not. it is for quotas.

    The officers have been trained with the belief that they can take certain liberties above, outside and beyond the law, for the base, coarse, and self-serving reason, to be able to make their job more convenient and efficient streamlining in the performance of their duties. And along with that comes an inherent tyrannical attitude that assaults the mind and all civilized notions of a free society, with these arrogant words; 'if you don't like it "hire an attorney, take it up with the courts and sue me". It's that callous disregard for the rights of the citizens they come in contact with, who pay them more than reasonably for their lack of knowledge and training, and expect them to be on the straight and narrow when it comes to protecting and defending those constitutional rights, that make the relationship with the police more of "us verses them", and creates an animosity against law enforcement and the judicial system.

    Unfortunately the police have the ability to indiscriminately punish you for not allowing them to violate your rights. these police were ready to put this man in a cage and pass along a huge financial and social burden if the person declined to allow the violation. If he had invoked his 5th amendment right to silence they would have loaded him up and given him a bond payment. And if you want to fight in court the price just goes up and up and up. Meanwhile they are represented by the city with the full force of the DA and even in the very worse case scenario for them it is the tax payers who cover the costs leaving the police to continue violating people's rights like the mindless savages they are until someone tells them different. That's why they are happy to pass you along to a court. Because they know they will be protected in ever case and face no reprisals for their many violations.

      Qualified immunity needs to disappear. All officers must be held accountable for every civil rights violation. Settlements must begin at $100,000 dollars per violation. Every unlawful action must be a fine of $500,000 and 15 years in prison if committed by an armed officer. Every officer must pay for their own insurance.

    The military is NOT going to give out information to anyone not even a police officer over the phone. It has to be a court order by a judge and delivered by a court appointed officer.
    The military is obligated to keep their personnel safe.

    Many people in this country have houses and vehicles in multiple States. They only hold one DL and the plates to their vehicles are all registered in the States where they are kept. For several years, I had two houses in two States with multiple cars in both States.

    They will do whatever they’re gonna do, once you have their attention. Never speak without an attorney. Simply provide what is required by The Law Of Your Area, then exercise your 5th amendment and state “I will remain silent”.

    Been watching you for a while just subscribed 👍🏻 when I got out of the military years ago lol I was doing the ride along thing and going to go into law enforcement… the reason I didn’t is because most police just act like these… I would be the same as you… I wouldn’t determine everyone Is a criminal right off, but my training would make me just keep an eye out 🤷‍♂️🤷‍♂️👍🏻

    I sympathize with Sid. I got pulled over in Washington numerous times because I did not have a front license plate (not required by my state). Even had one cop tell me I had 30 days to correct it after I explained the reason. I am and always have been a permanent resident of Indiana and I was only a temporary resident of Washington therefore I do not have to change my official records for my temporary residence. If what these cops are saying is true, your registration would be invalid the moment you drove into another state because registrations have different requirements.

    As military, you keep your license from your issuing state. You may not "live" at your place in the military and keep your "home of record"

    I've never told someone "you can sue me in court." know why? Because I do not want to be sued, and I'm not going to give someone a valid reason to do so. Clearly qualified immunity needs to be abolished because cops absolutely know there is zero consequences for them breaking the law, or infring on our rights.

    What is missing here is he is military and federal laws allow military members and their spouses to keep their driver’s licenses and vehicles registered in their home state. He does not have to give a local address. I was in this exact situation and the judge was not happy with the cop when we were in court.

    Unless it’s changed, I once heard that California was the only state where you can’t have the front windows tinted. I just have never gotten what police think they are are going to see with the window all the way down as opposed to partially. I’m sure ego is a major factor.

    They contact the military they will state where he is stationed. They might give his home address when he entered. They won't state where he "lives". They don't have that info.
