H.E. is deeply entangled in the judiciary's affairs, from overriding the CKGR court ruling and funding burials to criticizing judges on Human Rights Day, knowing they can't respond. Now, his own activism is being used to free Morupisi. He must remember he's the Executive in a democracy where separation of powers matters.
The issue here in my view is , Is it possible for a lower court to over-rule the judgement of the highest court in the land. The hierarchy of the judicial system was inherited from the UK, whose judicial system is almost the same as the one in the US. In these countries no judge in any lower court can overrule the supreme courts, in the US its called the Supreme Court of Justice of the US (SCOTUS), so im wondering if we are considering ourselves better than the US. All SCOTUS rulings are regarded as constitutionally accurate and adequate and no lower court judge can challenge them.
This Morupisi case is very interesting in a number of regards, quite a number of startling exceptions, but the judgement of the Court of Appeal should have stayed to preserve the sactitiy of law and order , judicial independence and the rule of law in Botswana for now and future generations.
