Security Agencies Declare Sanusi's Reinstatement as Illegal

  • How well can the rule of law prevail in the face of political pressure? This is the question begging for answers regarding the controversy that has engulfed Kano Emirate over reinstatement and deposition of two Emirs. But security agencies, under the leadership of the Commissioner of Police in Kano State, have vowed to obey the court order, which ruled against the reinstatement of Muhammadu Sanusi II as the Emir of Kano. The Commissioner of Police, Muhammad Usaini Gumel, noted that the force only recognises the deposed Aminu Bayero as the Emir of Kano, as backed by the Court. He also said that the police will not be compelled to act against the verdict of the court. This is coming after Governor Abba Yusuf ordered the arrest of the deposed Emir, after he returned to Kano.

    This was the same way former Emir Sannusi was deposed by Gov Ganduje through the house of assembly and Bayero ascended the throne. Now the new Kano governor has used the same house of assembly now to overrided itself to a status quo.
    The governors are now using Emirs deposition and enthrownment to settle political scores without due respect, to traditional institutions is bad. We should not reduce our traditional rulers to mere football as a sacrifice between two political gladiators, Kwankwaso and Ganduje. In all these our courts has been used against the rights of the people, and where the courts are supposed to give justice on behalf of common people, the courts have delays judgement. But gives quick judgements I'd injunctions when it affected the rich and powerful members of the society.
    To the TVC crew, when Ganduje dep9sed Emir Sannusi, you supported him because he was an APC governor. But Now that the governor is from NNPP done the same in revenge, the song has changed.

    Ganduje is a member of Apc which is the party in power, Ganduje is applying power from above with the support of Mr President, army and police are in the hand of Mr president, that was why they brought Bayero back in tight security.when Sanusi was dethroned, why the army and the police did not bring back Sanusi in tight security? The same court declared the removal of Sanusi illegal, but the government of Ganduje didn't obey court's order too, The police and the army were supposed to stand by the court's order then.

    This BKO seems to give the impression that he knows a little about the law but he doesn’t. I first noticed it when he said “if the motion on notice is brought before him (i.e the Judge)…” see 7:08. The motion filed by the applicant was ex parte and not on notice. BKO has to abreast himself of the facts before coming to speak on tv.
    Secondly, a Federal High Court does not have jurisdiction over chieftaincy matters. See the case of Tukur v. Government of Gongola State where similar Emir tussle issue was raised. It is only a state High Court that can sit on such matter. It is wrong to blindly argue that court orders should be obeyed no matter how and in what manner they are obtained. This is a clear abuse of court process by obtaining an ex parte order from a court that clearly lacks jurisdiction. The lawyers to the deposed Emir ought to be fined heavily. According to BKO, this is just like saying that I can approach any court without cognizance to the fundamentals of jurisdiction and seek any order or relief from such court and expect the other party to comply because “court na court” (i.e all courts are the same). It is wrong to encourage such. Please bring actual lawyers to discuss these issues and stop fooling around.

    If Ghanduje had the right to remove Sanusi,the current governor has the right to remove the new Emir.If Kano Emir was originally designed to be one whole emirate and then fragmented and that was allowed to fly then reverting to the original structure for which the Emirate was conceived and established.     It would be interesting to see that section of the constitution that permits a judge to pass judgment on a case electronically. In those days prior to electronic technology, can this happen??     I stopped taking Journalist Hangout serious when it became clear that the consistent "discussant BKO" will always take stand against anything not in the interest of APC. He would have taken a different stand had the coin been flipped. Did Rivers state court not dissolved the pro-wike 27 lawmakers assembly ? Viewers should watch his reactions on Rivers imbroglio. I also noticed that once BKO takes a stand on an issue, the other 'hangout' journalist dogmatically align with him. The reactions preceeding this my comment say it all. What a shame of a programme?
