That is true though, philosophically and legally. Guilt is a matter of morality as much as action. A jury even has the right to return a 'not guilty' verdict if they find the accused did the crime but was morally justified or absolved in some way (judges and prosecutors have an interest in not making that well-known). For example, say someone kills your child. They did it, it's 100% sure, evidence is air-tight, they're even on tape admitting it...And then they escape through some loophole or technicality. If you proceed to kill that person, that's murder - and murder is a crime - but the jury can declare you not guilty given the circumstances make it a morally righteous act.
