Basic 60% taken=60,000 then i calculate 15day's
60,000*15/26 = 34615.38
I was worked 6 year's so 34615.38*6 = 207,692
My 6year's gratuity amount - 207,692 is this correct sir

*for basic eligibility criteria, u have to complete full complete 5 years.
*for following additional years of gratuity, 240 completed days is eligible on one year.
you cant pick 240 days calculations for basic gratuity eligibility

As per current law, gratuity received by a government employee is fully exempt from tax. The maximum amount they can receive is Rs 20 lakh as per amendments made following the 7th Pay Commission recommendations. However, for non-government employees the maximum tax-exempt gratuity limit is Rs 10 lakh as of now.

Eligibility criteria.. you have to complete 5yrs..
further add-on year, u can calculate for 240 days (consider as 1 yr)
Initial eligibility you have to work for complete 5 years

company calculation 30% for basic from your gross.. check with other employees basic.. calculate their gross for 30%. u will get a better idea.. if other employees got higher percentage on basic means, u can refer your HR

Recently I have resigned. Am exactly 4years 11 months and 11 days worked (continues service without any break). When I have sent email to my organization. I.e i am eligible and entitled for gratuity. Am received replay msg from organization. U you have to work 5 years. for u not yet completed 5 years. So u will not eligible for gratuity.
Pls let know am eligible for this gratuity. If yes please let known how can I move forward this.

240 days calculation helps to consider one year service
One who joined on 1-1-2003 becomes eligible to get gratuity on 1-1-2008. If he leaves during 2007 but working for 240 days in 2007, cannot get gratuity as per the Payment of Gratuity Act.
In P.Raghavalu and Sons Vs. Additional Labour Court, Andhra Pradesh, it was decided that one who had worked for 4 years, 11 months and 10 days (just 20 days short) was not eligible for gratuity saying that the qualifying phrase "fraction of period exceeding six month shall be taken as one year" will be considered for deciding the amount of gratuity and not for deterning the eligibility for gratuity.
