I got married in Feb 2024, after marriage my wife got a govt job and now she is asking for divorce within 2 months on basis that she has a govt job and I've no govt job.
I'm ready to fight case but legally I'm strong
if police register the FIR of 498A Same day of complaint without conduct preliminary Enquiry & if police is Not following guidelines of Lalita Kumari Vs State of UP 2013 then high court or apex court can entertain 482 or SLP in this Law point .
Note - in this case FIR register after 6 month delay . No preliminary enquiry , omnibus and general allegations, also fir is register after divorce case as counter blast . Now fir can quashed ???

Woh 1 saal se maike main thi .. fatak se Good Friday k din aa k mere naam se FIR kar diya. Thana se 41 diye Bina mujhe arriest karne k liye aa gyai thi. Shukr hai Thane se pahle hi mujhe inform kar diya tha ki tum hat jao maa ko le kar. IO paisa khaya hai. Main ne maa ko Bhutan bhej diya Q ki main indo Bhutan Border Jaigaon (Phuentsholing) main rahta hu. Fir mujhe dost ne sujhao diya ki ab anticeptory bail le Lena chahiye. Toh main ne le liya. PP ne bhi Maan liya ki IO jo hai bina 41 A lagaye mujhe arriest karne aya tha. Aur uska record accha nahi hai. Magistrate bhi usey badhiya se dhoya aur mujhe kaha ki IO k against ek affidavit Dene k liye. But mujhe toh apni jagah pe rah k kaam karna hai police se jhagar k koi faida nahi hai. Ab hazri de rha ha hu. 3 hearing complete hua hai. Ab 498A ko kaise withdraw Kiya Jaye. Q ki in 3 mahine mein Mera kaam thik se ho nahi pa rha hai.
