To be fair. It does mean its supposed to be exempt from legal prosecution. The idea however that freedom of expression can be applied to anything especially corporate business strategy is ludicrous.
Interestingly, EA's "rights to property and freedom of expression" argument is the same one the big tobacco companies used trying to fight Australia's plan cigarette packaging laws. The cigarette companies lost that argument too btw.
There's also a problem with it. Most countries do not actually have the same laws to protect freedoms of expression that the U.S. has. Then again. if some have their way the U.S. won't have it any longer either, but until then It's actually one of the things that makes the U.S. actually fairly unique in the world.
What's the situation in Australia? Here in the Netherlands, we've basically reduced the branding to just the name, with all the packages the same color and adorned with all kinds of disgusting imagery displaying the consequences of smoking.

They are disagreeing with how the evidence is being used. By this court's logic a MMORPG where enemies drop randomized loot can be considered a game of chance since you are able to sell your account. Their logic will ban any form of RNG from online games. I personally find RNG mechanics interesting and can keep repeating things fresh. Banning RNG severely restricts game design.

This, I do some gambling myself but only safe bets etc, and I've won some pretty nice sums, most betting sites REALLY hate paying you any real large amount of money, numerous times I've had so much trouble cashing out my money often taking weeks or months to get it, you know needing to send multiple photo IDs, multiple times as they say it was wrong, I once had to take a selfie with me in frame in high HD with my DL and Passport in frame because the passport and DL was simply not enough, but at least they have to pay out eventually, these game companies prey on children's minds for the taste of gambling and give them in return a timed reward that ends once they release their next copy and paste game (It's not even a permanent digital reward). I'm not addicted but I can tell you for SURE they both provide the exact same Euphoria of winning and anyone that says Lootboxes aren't gambling is an idiot.

In Brazil, EA is being sued by soccer players due to use of image and likeness without paying a dime. EA is losing every one of then, being forced to pay to the players something about US$ 50.000,00 each, and I know so far there are at least 200 players sueing. Hope every player on the planet do the same thing.

Preventing sales in an entire country, especially a country like Netherlands where football is a big part of their culture would be very detrimental to EA. Memoria Freese, the mobile game for Danmachi, isn't too bad and very F2P friendly. You can do all the campaigns and events on easy without paywalls and banners have guarenteed drop rates. Playing for over 2 years and haven't had the need to buy currency. Yes, there's pvp and ya, the whales win but pvp is really just a way to get extra income and doesn't really effect the game much unless you love pvp in that game for some bizarre reason.
In the couetdocuments, the Judge also States that: "The gambling was created in 1964, and its unthinkable that the creators of these law knew about the jumps that technology would make. So even if it was not gambling by the LITERAL rules of the law, the law should be taken into the context"

Right now, EA has been grasping at straws for a while now. They'll keep doing that, until there are no straws left. Their biggest "argument" is that they offer no monetary prizes (which makes it even worse than real gambling, imo). So just a few minor changes, could make a load of difference. EA's legal department would have to seek for new loopholes to exploit.

Even if it’s a small sum to them the fact remains that lootboxes are gaining a terrible rep. They’ve always had a bad reputation to begin with, but now that a governing body has deemed them having broken the law it sets a precedent in which lootboxes can be considered gambling and therefore possibly illegal to sell to minors which is a huge portion of EA’s consumer base. In time we can hope that this will paint them as a liability and force EA to abandon them in most of their products since games with real gambling require an A for adult rating here in the US which is unappealing to most retailers.
More countries with no limit of 5 million on it. Let them pay until they fix it. Let them bleed. And if the Income from breaking those laws makes up for their losses by the fines, even better. "Our games can only prosper when we break international laws." makes for a good headline for investors.
Even if this fine doesn't take down EA it is now clear for every corporation that Netherlands will judge lootboxes as gambling and act as such. If this is the cost of having lootboxes in a game released in Netherlands they'll think twice about these mechanics

I'll never forget the patent for the "motivation system". A system that attempts to encourage you to buy the lootboxes by pitting you against players who have all the good stuff from the packs. Just straight up manipulation.
Hopefully this will serve as a precedence and other countries will follow Netherlands' example and that also other publishers will be held accountable. Then they need to be punished for that tax-return fraud. As for other scummy mitrotransactions and monetizations, it's not something governments can really address (nor should they be able to) so it's in the hands (wallets more specifically) of players.
Another point about "value": Even if you got your Messi card after spending £500, you can't transfer it to the next year's installment anyway. You don't even get a year of value from it since the ability to play against other teams online gets hampered drastically if you're playing older versions simply because the player base drops off and online support is diverted to the new installment. So even if you get what you want, you'll have to do it all over again in a year or less. This is how they get people spending thousands on a $60-$70 game annually. That's the opposite of "value".
Literally worse than gatcha! People complain about Genshin Impact, a free to play game, but that game will stay relevant for years. Example is Honkai Impact 3rd that came out in NA and EU in 2018 and still more relevant than any FIFA. FIFA players are literally mentally challenged. This is a personal opinion but I Can't understand why people play sports games. "sports" games. And pay dozens and hundreds of dollars... Just buy a ball and go outside? EA was probably stunned by that one. Game companies are used to getting away with it by simply saying it's against the rules to sell stuff, without addressing that someone might find enough value to be willing to spend money on the item. Dutch court saw right through that.

The controversy about the thing you're mentioning is that the ad's seemed to target people 18/20-25 years old (young adults and early mid-20) and it is forbidden by law to advertise and promote people that age to go gambling. If the item in question according to EA, has No monetary value, and they are admiting this, and they are selling this, then they are also in violation of commerce laws as this would fall under basically "Scam" laws. as you are now allowed to leagally sell something to someone if it has absolutely zero value.

As a Dutch we're now in the poopy situation, where we're not getting certain games. Upcoming is Lost Ark & Bless Unleashed and already released is PSO2(NGS). As a person I'm happy that lootboxes get their just-deserts. As a gamer, I'm incredibly frustrated to not be able to play games I'm looking forward... without breaking the law through making purchases through VPNs and risking my account to be banned - EVEN IF I do not interact with any lootboxes present. While some game's publishers/developers make adjustments for us (like for example MapleStory making lootbox rewards untradable, or CS:GO not allowing us to open boxes at all (good)), the reality is that many publishers find the Dutch market (at about 1 billion euro/year) not to be large enough to care about entering. And therefore no alternative for our market is created.

As a Dutch (Netherlands) citizen I contacted the KSA and made a request for them to take action against lootboxes back in 2018. I was triggered by personal experience and your videos. I dont know if my request had any impact on these proceedings but it's nice to believe we can eventually put a stop to these predatory practices. So thank you for persuading me to take action.

It happened with Rocket League about a year ago. Could still buy credits and use them to trade, but when opening a crate the message “not available in your country” popped up. Now they changed their way monetisation to a more transparent one. The upside is knowing exactly what you’re getting, the downside is higher prices for fewer items and the fact that $100 wheels were now being sold by Psyonix for $20,-, though these were untradeable with other players. It was a bad day for stonks.
it's quite common in the Netherlands that fines are collected weekly/monthly in these big company court cases. It creates an insentive to comply early, so the don't have to pay the entire fine. If they had to pay the €5m all at once, there would be no more pressure, and it could be seen as a license to keep doing bad things, like "we don't comply, but we all ready paid the fine so we don't have to comply anymore".
This even got some traction on the Dutch national news broadcasts, so it's now also being brought to the attention of regular parents and children, not only die-hard gamers. Hopefully, this helps to increase awareness further so that more and more people and organizations stand up to this crap.

They are disagreeing with how the evidence is being used. By this court's logic a MMORPG where enemies drop randomized loot can be considered a game of chance since you are able to sell your account. Their logic will ban any form of RNG from online games. I personally find RNG mechanics interesting and can keep repeating things fresh. Banning RNG severely restricts game design.

This, I do some gambling myself but only safe bets etc, and I've won some pretty nice sums, most betting sites REALLY hate paying you any real large amount of money, numerous times I've had so much trouble cashing out my money often taking weeks or months to get it, you know needing to send multiple photo IDs, multiple times as they say it was wrong, I once had to take a selfie with me in frame in high HD with my DL and Passport in frame because the passport and DL was simply not enough, but at least they have to pay out eventually, these game companies prey on children's minds for the taste of gambling and give them in return a timed reward that ends once they release their next copy and paste game (It's not even a permanent digital reward). I'm not addicted but I can tell you for SURE they both provide the exact same Euphoria of winning and anyone that says Lootboxes aren't gambling is an idiot.

Memoria Freese, the mobile game for Danmachi, isn't too bad and very F2P friendly. You can do all the campaigns and events on easy without paywalls and banners have guarenteed drop rates. Playing for over 2 years and haven't had the need to buy currency. Yes, there's pvp and ya, the whales win but pvp is really just a way to get extra income and doesn't really effect the game much unless you love pvp in that game for some bizarre reason.
In the couetdocuments, the Judge also States that: "The gambling was created in 1964, and its unthinkable that the creators of these law knew about the jumps that technology would make. So even if it was not gambling by the LITERAL rules of the law, the law should be taken into the context"

Right now, EA has been grasping at straws for a while now. They'll keep doing that, until there are no straws left. Their biggest "argument" is that they offer no monetary prizes (which makes it even worse than real gambling, imo).
So just a few minor changes, could make a load of difference. EA's legal department would have to seek for new loopholes to exploit.
This is a case of folks not letting folks get away with violating the spirit of the law while adhering to the letter and it's about damn time. Sick and tired of seeing folks with money get away with breaking the law with extra steps.

Even if it’s a small sum to them the fact remains that lootboxes are gaining a terrible rep. They’ve always had a bad reputation to begin with, but now that a governing body has deemed them having broken the law it sets a precedent in which lootboxes can be considered gambling and therefore possibly illegal to sell to minors which is a huge portion of EA’s consumer base. In time we can hope that this will paint them as a liability and force EA to abandon them in most of their products since games with real gambling require an A for adult rating here in the US which is unappealing to most retailers.
The fine may be small, but they will also lose the FUT income from the Netherlands.
More countries with no limit of 5 million on it. Let them pay until they fix it. Let them bleed. And if the Income from breaking those laws makes up for their losses by the fines, even better. "Our games can only prosper when we break international laws." makes for a good headline for investors.
Even if this fine doesn't take down EA it is now clear for every corporation that Netherlands will judge lootboxes as gambling and act as such. If this is the cost of having lootboxes in a game released in Netherlands they'll think twice about these mechanics

Another point about "value": Even if you got your Messi card after spending £500, you can't transfer it to the next year's installment anyway. You don't even get a year of value from it since the ability to play against other teams online gets hampered drastically if you're playing older versions simply because the player base drops off and online support is diverted to the new installment. So even if you get what you want, you'll have to do it all over again in a year or less. This is how they get people spending thousands on a $60-$70 game annually. That's the opposite of "value".
That's enough to buy loads of indie titles AND a killer gaming rig to play them on.

As a Dutch we're now in the poopy situation, where we're not getting certain games. Upcoming is Lost Ark & Bless Unleashed and already released is PSO2(NGS).
As a person I'm happy that lootboxes get their just-deserts. As a gamer, I'm incredibly frustrated to not be able to play games I'm looking forward... without breaking the law through making purchases through VPNs and risking my account to be banned - EVEN IF I do not interact with any lootboxes present.
While some game's publishers/developers make adjustments for us (like for example MapleStory making lootbox rewards untradable, or CS:GO not allowing us to open boxes at all (good)), the reality is that many publishers find the Dutch market (at about 1 billion euro/year) not to be large enough to care about entering. And therefore no alternative for our market is created.
That slow, creeping, smile at the beginning was exactly how i felt.
And on that day, the Grinches smile grew and grew, if they cant have a good game, they will take all of EAs greens and golds.....

As a Dutch (Netherlands) citizen I contacted the KSA and made a request for them to take action against lootboxes back in 2018. I was triggered by personal experience and your videos. I dont know if my request had any impact on these proceedings but it's nice to believe we can eventually put a stop to these predatory practices. So thank you for persuading me to take action.

It happened with Rocket League about a year ago. Could still buy credits and use them to trade, but when opening a crate the message “not available in your country” popped up. Now they changed their way monetisation to a more transparent one. The upside is knowing exactly what you’re getting, the downside is higher prices for fewer items and the fact that $100 wheels were now being sold by Psyonix for $20,-, though these were untradeable with other players. It was a bad day for stonks.

it's quite common in the Netherlands that fines are collected weekly/monthly in these big company court cases. It creates an insentive to comply early, so the don't have to pay the entire fine. If they had to pay the €5m all at once, there would be no more pressure, and it could be seen as a license to keep doing bad things, like "we don't comply, but we all ready paid the fine so we don't have to comply anymore".

This even got some traction on the Dutch national news broadcasts, so it's now also being brought to the attention of regular parents and children, not only die-hard gamers. Hopefully, this helps to increase awareness further so that more and more people and organizations stand up to this crap.

@@DUxMORTEM This ruling means they will be fined for every game with Lootboxes released in the Netherlands. It is actually a pretty good ruling that could hurt them in the long run.

They will just announce layoffs and put more people out of a job. Even if the company tanks and goes under the execs have made more money than they can legally be sued for so it doesnt hurt them really.
