To my knowledge probate is compulsory if there are immovable assets in Mumbai, Chennai or W.Bengal.
In Maharashtra, on the basis of will (registered or not) the legal heirs names are entered on property / land records. Once it is done, banks should not have any issues in mortgaging the property.

Who gets the rent untill the will is not executed by court..

मेरी मा टीचर थी 1995 मे उसने रजिस्टर वसीयत बनायी नोव्हेंबर 2000 मे वह चल पडी रजिस्टर वसीयत होने के कारण मैने तहसील में अर्जि दाखिल की इन्क्वायरी के बाद मेरा आपलिकेशन 2002 मे मेरा म्युटेशन मंजूर हो गया.
मेरे भाई ने आक्षेप ले लिया लेकिन दोनो बहनों ने मुझे साथ दिया लेकिन पहिले अपील मे और दुसरे अपील मे जिल्हाधिकारी के सामने 2004 जुलै मे मेरा मुटेशन रद्द हो गया उसी वक्त 2002 मे मेरे भाई ने वसीयत रद्द होने के लिए सिव्हिल सूट दाखल कर दिया था.
2004 के ऑगस्ट मे हमारा कॉम्प्रमाईज हो गया लेकिन सुट मे दोनो बहने दाखल नही है. सिर्फ हम भाई भाई में ही कॉंम्प्रमाईज हो गया था.
2005 के अमेंडमेंट के बाद एक बहन के मिस्टर जो एडवोकेट थे उनके जबरदस्ती के कारण 2009 के डिसेंबर मे वशीयत झूठा है, के साथ साथ पार्टिशन सूट कर दिया सूट करने वाली बहन मर गई 2017 मे. अभी केस उसका पती चला रहा है. मगर वसीयत पर रजिस्टर के समय दो अटॅस्टेड विटनेस मे से एक साईन बहन ने करी थी जो जिंदा है और जो अटेस्ट विटनेस भी है. वह बेनिफिशरी भी है. उसीने कोर्ट मे अपने कैफियत मे मेरे अपोजिट यांनी वसीयत फसाके करवा लिया है ऐसी कैफियत दि है.
मेरा सवाल ये है कि क्या पहिला कॉम्प्रमाईज रद्द हो जायेगा या नही जो ट्रायल कोर्ट के सामने हुआ था? दुसरा सवाल अटेस्टेड विटनेस वाली बहन मेरे अपोजिट खडी है जो बेनिफिशरी है और दुसरा अटेस्टेड विटनेस सच बोलने को तयार है कोर्ट किसकी विटनेस सही माने गा?
