      It doesn't matter. The gov. is the one that took the bribe. She is the one they need to get rid of. Whoever bribed her has some interest in the issue. If they didn't someone else would.
      They only had to bribe her. There should be a veto override process. If not, that is something that needs to happen first.

    If a private citizen wants to buy from another private citizen the State has no say.

      I'm a retired attorney from Oregon and worked in the restaurant industry. The reason for not allowing "home cooked food" is that they don't have the training or the equipment to cook food so it isn't contaminated.
      I like IJ, but on this one they're wrong. If you're going to sell food to the public you need sterilized equipment and know how to do that. (1 part bleach, 10 parts water. One of my clients got tagged at a street venue for having too much bleach! Easy solution, told him to just dilute it some more). But the state does and should check these venues and restaurants.
      Should the same apply to a "bake sale" school fund raiser? Tricky question. Yes, back in my home state Wisconsin loads of people got sick buying baked goods from school. They sued the school. The school settled. So much for the fund raiser.

      @@rabbit251 Again, that's stupid. Freedom is about CHOICE. You CHOOSE to take the risk engaging with their business. 9,999 times out of 10,000 you're not gonna get food poisoning eating your neighbors casserole.
      That bake sale wasn't the best example. I've seen too many where the kids are involved and that's a whole different level of stupid.
      If my neighbor is going to bake cakes for people for money, they should be able to. That's not the same as having warm food in a container for serving all day, or day after day.
      Food trucks are probably dirtier than the average kitchen of these people.
      Regardless. If I wanna buy from a mom & pop, that's my choice, it's my fault if I'm too stupid to consider any risks and make an educated decision. The State can fuck right off.
      Here's another explanation: 99.9% of OSHA bullshit can fuck off. At most it should be a list of best practices. A business with too many injuries won't find anyone willing to work there. But forcing "safety" on a company often has inverse effects. I worked in a papermill as a millwright. Almost every bit of "safety" kit that went up, provided zero extra safety for any operator with an IQ over 40, but raised the hazards of my job anywhere from 2-20x. Forcing me to work in suspended positions where before I could crouch with plenty of room. Inserting "safety" circuits that made troubleshooting impossible, meaning I'd now have to stand INSIDE a running converter to assess what's not running correctly since I can't jog only part of it with the rest of the machine disabled. They'd tell me, oh you can't remove that fence now, it's a permanent safety feature? Well how am I supposed to fix this, or adjust this valve? When the fence provided zero extra protection to an operator.
      It should be up to the individual to decide their acceptable level of risk.

      ​@@rabbit251 I just can't support this having worked in Restaurants as long as I have. Regulation be damned, I've never seen any kind of inspector except the in house starbucks one... Standards are very low to match. Many people got sick from my stores, but unlike the school we were never sued.
      I'm not sure what special protection we've got for stores, but they're not safe... And if they're not safe anyway, why not let home cooks work to the same standard?
      It's 100% possible to run a sterile operation at home, by the way. No special gear is actually needed, just good handwashing and sterilization discipline. Neither happens in most commercial kitchens.

      Don't just go for the easy "pure" ideology. There are damn good reasons for *some* regulation regarding these businesses. Read The Jungle sometime.
      However, there's been a lot of regulatory capture which has morphed and expanded sensible regulations into schemes which benefit big businesses (and the politicians they back).
      Libertarians and liberals should be on the same side more often than not. More effective regulations are usually *less* intrusive on peoples' lives. But just mindlessly opposing all government regulations on principle ends up with private entities (usually big corporations) being very intrusive to peoples' lives.

      Every step leading up to those votes, though... That's fair game. Up to and including shutting down polling locations you're told are going to the competition for "safety concerns". You can rig an election without touching a single vote, no problem.

      I spent five hours in absolute misery at a truck stop in cramps ejecting from both ends. Because of some chili I had in the morning. It's a human right to associate and conduct commerce but it's also a human right to live and be uninjured in person. At some point in my ordeal I felt like I could really die from it. So there needs to be something that prevents some piece of shit from leaving chili out overnight and then serving it to the public heated lukewarm. You figure that one out.

      @@statinskill I would 100% agree with you but was this chili you bought from a casual seller at a pop-up table, or from the convenience station inside the truck stop?? Bev if it's the latter, they're supposed to have a food license and you can tell them what happened to you and technically sue if you wanted to. They were the ones leaving the food out too long. They're supposed to have strict procedures for that, like any certified restaurant.

      @@statinskill that does sound absolutely horrible and I'm sorry that happened to you. I've been lucky as I've never had food poisoning that bad. I had a month long bad something from undercooked chicken one time that made it painful to eat, which got pretty bad and i probably should have sought medical attention for, but I waited it out and it eventually got better. That was 12 years ago - sure hope I don't have any lingering dormant parasites from that lol. They say some parasites can last up to 30 years in some rare cases. I feel ok today but I guess only some tests would tell for sure.

That's not saying that every private kitchen is dirty. It's just that they can get people sick and worse and therefore these sorts of things need to assiduously implement food safety and be inspected regularly but unannounced.

      @@statinskill yeah every commercial place is supposed to be inspected and graded. But it only takes one person not maintaining proper food safety to cause a problem. There's no real way to inspect home food sellers tho, or mobile food cart sellers. I mean health inspectors can always check the carts if they really want to but I doubt they would feel like going that far. People just have to trust that food vendors will maintain proper cleanliness.
      They can create a license tho for all mobile food vendors, that worst case scenario can be revoked if someone reports a food safety issue from that person.

      Try reading a book called "The Jungle" by Upton Sinclair. It's about making sausages around 1900. It was his story that led to the Food Safety Act and the creation of the FDA, to ensure food standards.

      @Dick Pick Your education does not make you as superior as you seem to think it does. People have been selling food to other people from the beginning of time without bleach to clean their kitchens. The idea that government has to fix all of our laziness is part of the problem and as an attorney who collected money off of that arrangement you are naturally going to have an opinion in favor of it because to believe otherwise (as some of us indeed do) your life's work would be less important. If a person who makes others sick with their food does it very often word spreads and people learn not to buy from them, the problem solves itself without beurocracy and seldom does any government action prevent anything that would not have been prevented otherwise. If people used common sense when buying their food and took the time to consider whom they are buying it from the result would be as effective and personal accountability would once again become the standard rather than running to some official to solve all of your problems or paying some "educated person" out of your own pocket to play word games with other "educated" people so they can all presume that they are superior to you because you allowed them to solve problems that you could easily have done on your own.

    I used to buy Tamales from a lady selling them from a wagon walking around my neighborhood. Honestly, you can't get food that good in a store or restaurant.. AZ also arrested a nice lady for feeding homeless in a park.. Get rid of Hobbles and put the rightful Governor in office..

      Totally agree. There was a lady here who sold tamales in the business district. They were so delicious! If you didn't queue up in time she'd sell out. When she passed away a few years back the newspapers and TV stations gave her obituary for days. California at least respects home-cooked food sellers, hope AZ catches up soon.

The people next door would come over and take paddles from my Cactus then bring me plates of Nopales and fresh home made tortillas... If everyone had an opportunity to try some of these foods,, it would end a lot of the cultural issues in this country..

      @@mgreg8134 : Whether or not that’s an accurate statement, I was comparing commercial kitchens to home kitchen. Not restaurant kitchens to home kitchens. Commercial kitchens (meaning the large scale producers of packaged foods) are generally pretty clean, but the food standards which permit a certain percentage of rodent fur/droppings in packaged food tells me that home chefs are almost certainly more careful since their customers are more discriminating with the final products. Also, large commercial co-packers use a lot of ingredients that no home cook would ever think to use. Just read the ingredients list on store bought packaged foods and it sound like a chemistry experiment.

      @@______IV I forget who did the study but it was shown in the study. I would consider a restaurant's kitchen to be a commercial kitchen, just on a smaller scale.
      The home kitchens use the same ingredients that the commercial kitchens do and they fall under the same FDA guidelines. The flour comes from the same mills, the meat from the same packers, etc. etc. Many of the same additives used by large companies to produce prepackaged food are found in the same ingredients that the home cooks use.
      You are confusing FDA guidelines at the with health codes. I know of no local health department that would allow rodent droppings in the food once it is cooked. Not even a large scale producer of packaged foods.
      The commercial kitchens have to meet certain health regulations of cleanliness and food cooking and cooling regulations to maintain food safety.
      The difference is the home cookers are not inspected by your local health department to make sure they are using proper food handling procedures.

      I'm a retired attorney from Oregon and worked in the restaurant industry. The reason for not allowing "home cooked food" is that they don't have the training or the equipment to cook food so it isn't contaminated.
      I like IJ, but on this one they're wrong. If you're going to sell food to the public you need sterilized equipment and know how to do that. (1 part bleach, 10 parts water. One of my clients got tagged at a street venue for having too much bleach! Easy solution, told him to just dilute it some more). But the state does and should check these venues and restaurants.
      Should the same apply to a "bake sale" school fund raiser? Tricky question. Yes, back in my home state Wisconsin loads of people got sick buying baked goods from school. They sued the school. The school settled. So much for the fund raiser.

    Not sure of the details on this, but most restaurants and food trucks are subject to health department inspections to make sure things are kept at the proper temperature and that there aren't flies and rat droppings everywhere. Not sure if there was any provision for hygiene inspections in this bill.

Every person has the right to harmlessly earn subsistence income without license nor permit. The commerce of a sole proprietor is a Basic Essential Need, necessary for acquisition of all other Basic Essential Needs in a capitalist society. 18 USC 4 requires IJ agents to make proper criminal complaint against the governor and all her party co-agents , that colluded in this crime.

    How would the dept of health monitor health risks of making food in homes? In my southern state, the DOH can barely monitor the restaurants. Unfortunately many asian restaurants in my area, even though illegal, chop all their veggies at home in their backyard in very unclean conditions, and leave these veggies outside all day with birds crapping on it. They dry ducks by hanging them in their home carport Then they gather them up in cardboard boxes and put in their cars and take the prepared food to the restaurant. The city ordinance fined them several times for hanging ducks out in the carport. So they installed a wall around the carport and continued their practice. I never ate at that restaurant again.

    Not sure how I feel about, the food mentioned are at higher risk of carrying Salmonella( at worst). If there is no food inspector going to these homes the veto is smart.

      Actually, thousands and thousands of AZ residents, mostly republican did not get to vote do to the shady election she presided over. Can’t say we all asked for it.

    Tamales are a time and temp controlled food usually right? With meat inside, not a cottage food to be sold out of unregulated homes. Having said that, tamales are like 90% of what I see people selling without a business here in Texas. But how are you making sure no one gets sick etc?

      @@TW--- Are you twelve years old? Do you know the difference between being responsible for your own safety, and your own family. Versus being responsible for hundreds of other families? Do you not realize eating at home has no travel time? Buying from someone across the city, or outside the city, any travel time over whatever it takes for bacteria to grow before you can eat the food or refridgerate/freeze the food? Do you not understand WHY restaurants are regulated? Do you not understand that food sold out of homes is supposed to be as safe as possible, since there is zero oversight?

      @@TW--- My grandma kept canned and bagged foods that were sometimes over 10 years out of date. I know she is not unique in this. Just because you MIGHT be smart enough to cook food properly and not use unsafe ingrediants, cooking methods or storage methods, does not mean everyone is.
