      To be fair, he's right. Let's say someone breaks into your house while you are naked inside and tries to murder you so you escape but you are naked on the streets.
      Police can't arrest you for indecent exposure since that wouldn't happen if the threat to your life didn't exist. The malice component to the crime is missing, and you need to prove malice to arrest someone.

      The two of them are dirty cops and its played off. Its no surprise they abuse the law to charge the victim

      If it's "should it come to it, this is the distribution of tasks", all is fine.
      If it's "we have already decided to use unreasonable force"... not so much.

      The reason he's really locked up. People who (claim to) care about family values want to punish cheating (and not the offending party), they literally said so while locking him up.
      The excuse on paper, they didn't have (read "make") time to investigate the threat claim, despite being witness to it and having the statement from the assailant.

    I'm oddly on the naked dude's side. Even if what he did was beyond shitty [assuming he knew she was married], running for your life should take precedence over getting dressed in any situation.
    If your house catches fire, I don't think you should be arrested because you jumped out a window without pants on.

      He won’t actually get charged with indecent exposure, because the DA that did that would get laughed out of court.
      What he did to be chased down the road by a man is irrelevant, and isn’t allowed to be admitted in court, only the fact that he was.
      Even a really shitty lawyer could get him off easily. Basic defence of Necessity.
      It’s also not a wrongful arrest since it’s not unreasonable for the police to want to keep him there until they get the facts of the case. Just kind of dick move. Kind of like sleeping with someone else’s wife.

      They probably knew it would get dropped, but decided it would get the guy a little more public humiliation for cheating. He'd have to explain what he's doing running naked down the sidewalk, the judge would rip him a new one and dismiss the charges.

    They both make a valid point, usually breaking someones arm dosent fall under "reasonable use of force" but if he was resisting, ran, cops gave chase and tackled the suspect, who unfortunately landed on a curb and has a forearm fracture. Its hard to specifically say its 100% malicious intent on the officer as he was using reasonble force to detain the suspect

    Yeah, Graham v Connor gives law enforcement "permission" to stop threats. If you want to resist arrest, the consequences are on you. If you think it's an unlawful seizure, COOPERATE ANYWAY and then sue later. If you're right, you get paid. If you were wrong all along, at least you didn't get tuned up.

    I don’t know about the laws in the US, but across Europe and the UK you can’t be done for indecent exposure just for being publicly naked. Technically it’s legal unless your actions are indecent like being sexually lewd towards someone or flashing your privates at someone in particular with the intent to shock them or make them uncomfortable. I found this out one year in London as over 100 naked cyclists passed me by. This is why there’s no laws against nudist beaches as well. I don’t know US law, but if it’s similar then the guy running away naked won’t have broken any laws.

      @ sorry, I should have been more clear of what I meant by across Europe. I meant across many European countries, and by that I don’t just mean the EU. I know it’s not completely illegal in the UK, Spain, France, Netherlands, Germany, Latvia, Lithuania, Estonia, Norway, Sweden, Denmark, Serbia, Czech Republic, Slovakia, Bulgaria, and a few others. However, I don’t understand why your friend could be given a ticket for that when there is no specific laws against public nudity in Austria either, so driving in a bikini is one that really has no grounds for being given a ticket. I don’t know what law they could have claimed your friend broke unless there’s something specific to driving like that.

    Only thing I hate about this and every other cop show is how they interpret law. There's no way the naked man running from another man with a weapon would be charged with indecent exposure. In real life he'd have a nice lawsuit for that. Think about it. An arrest like this would make it impossible to run away from a rapist if he already ripped off your clothes.
    I should point out I'm a fan of the show. I just hate when they do crap life this. I love psych and they did this kind of stuff a lot

      She took it as he was saying that she had abuse her power before by using over-excessive force on a suspect. But he of course he didn't mean like that, he meant the officer who made the arrest but he inadvertently said "u" instead of saying "the officer".

      @ulizez89 the point being that it doesn't take severe brutality to break an arm. If he was fighting them and was taken to the ground and broke his arm, that isn't police brutality, that is you choosing to fight and getting hurt.
      The idea that police are supposed to treat people like they made of glass while those fighting them are actively trying to hurt them is BS.

      @ulizez89 are they supposed to just stand their while you attack them or other people? Someone chooses to fight they take the responsibility that they will be hurt. Police officers are not magic, in an altercation people get hurt. Flailing around while hitting the ground or wrestling on the ground (as 90% of all fights end up on the ground) increases the chance of being injured worse.
      People don't get to break the law and attack people that keep the order than complain about getting hurt. If someone attacked you, and you hurt them, and they sued you for brutality, you be pissed. How is that any different from a cop? The badge doesn't make you super human, in a fight there is going to be consequences.
