Sir, there is mis-information regarding form 483 Form of 483 is issued after every inspection by US FDA. USFDA specifies its list of observations in form 483. Company submits capa plan answering their response to the USFDA,observations If the regulator is satisfied, it issues NAI certificate if the regulator is satisfied but want to further reinspect it issues VAI If the regulator is not satisfied, it issues OAI status Even after OAI status, medicines can be exported to the US market but if regulator is not satisfied, it issues, warning letter and import alert Signifying ban of drug import from that plant into USA

There is also patent term extension for 5 years after patent expires. Also, exclusivity depends on the drug. whether it is a rare disease drug or normal drug.
