    Sounds to me like Midwest motors needs shut down. The minute they file a stolon car report on a car that's not stolon that should be fraud among other things.

      T Ritchie thats FRAUD and or a false police reports But in the laws eyes it's borderline,, in the what he did to sell the car was illegal anyway people like this are called "yo-yo dealers" Because they put the car in front of you and then try to take it back, and tell you he didn't make the financing, and then try to tell you you're trade-in was already sold So that you will feel forced to keep the car, and then they offer you a high interest rate

      Keye T .. The problem with your theory ("yo-yo dealers") is that the buyer can always (before or after the sale) arrange financing on his own. He is not in any way dependent on that dealership alone for a loan.

      Well, in cases like this, the buyer may feel intimidated by the dealer and may end up agreeing to a new loan at a higher rate out of fear that the dealer will repo his car.

      Dwight Stewart you're right, but for that matter the dealership should not be offering any type of financing and telling the customer that their approved allowing them to leave with the car until they're sure that they are approved, the customer is under the impression that they are approved for the loan, and the dealer also should not be selling the training until it is confirmed that the financing has went through... Because then they tell the customer that their car they traded and is no longer there so the customer feels like there's no choice but to take the high interest loans from the dealerships partner banks ... This is an a. This has actually been done and dealerships have been penalized for this foolishness several times

    I had a California new car dealer try this with me AFTER they had sold the two cars I traded in. One was a '65 Mustang. I told them that I'd bring them their car when they had my two cars back. Magically, they managed to find me financing.

    the problem here is not so much the new car, its the fact they took the trade in and likely sold the thing already. so if he's to return the new car, they should have the trade in car for him or one of a very similar value and condition.

      twilson1118 these people are called "yo-yo dealers" Because they hand you the car and then try to pull it back and they lie about saying your car is already sold, and try to force you into a high interest loan in order to keep the car they sold you, so you won't be without a car, in this case no the lender was willing to give a loan so they put their self over a barrel

    dont let the car leave the lot until financing is locked in, how freaking hard a concept is that to grasp? I got approved in 15 minutes for wall units and a big TV. Had all my cars approved while filling out paperwork. They took his down payment and a trade-in, pre-approved him and then try to take back the car? No way. Dealer is a scum bag.

      ALWAYS arrange your own financing. If you can't get financing with decent rates, the dealership cannot either - especially the Buy Here, Pay Here dealerships. Spot deliveries almost always fail. This dealership knew full well that the financing would not go through - it isn't their first rodeo. If they want the car back, the dealership must return the trade-in and the cash down payment if any.

      Jesse jesse The dealer did this on purpose. They use the no finance as a way to steal a person's money. Many state that if finance doesn't go through you lose down payment and possibly trade in.

      Jesse jesse His intention was to do that, and then try to offer him a high interest loan, By telling him his trade in was sold, and forcing him to keep the car they sold him by offering him a high interest loan, however this guy could not find any lenders to offer such a outrageous loan So the joke was on him, and he wanted the car back

      Mr. King Kitty No mistake many lots do this to steal money. If finance doesn't go through they say you forfeit down payment. This is against law but they bank on fact many people can't get help to fight crooked business.

    If a trade in wasn't also involved I might be sympathetic with the dealership, but they did get partial payment and likely already sold the trade in vehicle. They can't reposs without returning the other car.
    Of course, even then, they should get final credit before extending the loan. Alternatively, he could have given him time to finance with another bank on his own. Instead, they pushed, tried to get his car for nothing, and got in trouble for it.

      That's a good point. The trade-in is part of the sales agreement (it's not a contract). No sale = no trade-in.

      Dealership cannot unwind the deal without all the components. They need to return the down payment and the trade-in in the same condition as given. A good dealership would have sweetened the pot by returning more than was initially given but this was not a good dealership.

      I'm not sympathetic with the dealership because they SHOULD know their state's law and structure their deals in such a way as to comply with it and not be left holding the bag if a customer's financing falls through. The trade-in and partial payments should not be triggered until financing has been 100% secured. If it falls through, there is nothing to unwind because the customer has not given anything to the dealership and no vehicle has been driven off the lot.

    Simple law - If a dealer approves a deal and tells the customer their loan has been approved (Regardless of "preliminary approval' 'conditional approval' whatever) if they permit the customer to leave the lot with that car and signed contract - THAT dealer is on the hook to honor that deal and all the terms including interest rate, term of payment etc.
    Put that law into effect and this sort of sham dealership will evaporate in a week.

    This reminds me of a purchase I made back in 1989. I walked in to a Ford dealership and Highland Park Illinois. I made a deal on a brand-new Ford Probe trading in my 1986 Toyota MR2. I trade in was in good shape and I got a fair deal on the trade. However, after I signed a Ford Motor Credit agreement, I went home with the new Ford Probe.
    The next day I got a phone call from the dealership to come in because there was a financing issue. Although my credit was good the dealer told me that my loan had fallen through and I needed to re-negotiate a new loan at a higher rate. This also is an illegal practice in Illinois. I spoke with a lawyer friend and he told me that this was a scam. The First Agreement had to be honored in the state of Illinois. The lawyer gave me some guidance and I followed it. I went into the dealer and told them only the original deal was good if you didn't like it here are the keys and I walked out. as it turns out the dealer didn't want the car back they just wanted more money. I kept offering to renegotiate until they honored my original deal.

    Four times now, I've purchased cars only to be told a few days later the original financing deal had fallen through. The last time I bought a car, I was prepared. When the dealership left me a message about the financing not going through, I went to the dealership with a cashier's check in hand from my credit union. That shut them up real quick. If at all possible, arrange your own financing in advance of purchasing a car. My credit union offered an excellent interest rate, far better than what the dealership had arranged. And remember, finance managers get a cut of the interest rate on a car loan--so it's to their advantage to drive up the interest rate as far as they can.

    Used car salesman. There is a reason they have that reputation. I was buying a car once and only during the final paperwork did I discover that it had major structural damage underneath. They just tried to gloss over it real fast and have me sign two forms to acknowledge the damage but when I insisted on bringing it to a mechanic they tried pulling the "you can trust me, we will fix it if you have problem..." I just tore up the contract and walked away.

    Kinda had the same thing happen when I leased a car from toyota.. They said the lease was good to go with an extra $100 per month. Told them to go pound sand.. They kept the lease as it was..

      All of the cars in his inventory have to be insured. He could be looking at insurance fraud if the dealership has issues. They would file an insurance claim in order to collect the money from the insurance company.

    I'm so confused. So he got to keep the car even though he didn't get approved for financing? I know he traded a car in and he also put down a down payment. So what does it all mean? He gets to keep the new car free and clear of future payments? Like i said - I am very confused.

    Spot delivery should be illegal in a states. I would hazard a guess that >90% of financing on those transactions will fall through. This isn't the dealership's first rodeo. They knew full will that this buyer would not qualify for this loan based upon the credit application. Car buyer should never accept spot delivery even if it is legal in your state. Spot delivery is a sign to the dealership that you are in a desperate situation and they'll take full advantage of that. In my state, if the financing falls through, you can turn the car back in, get your old car back and your down payment. But dealerships will never tell that to the car buyer.

    Spot delivery happens all the time in CA. In fact, sales contract clearly states that its contingent on a loan approval, so you have to return the vehicle if financing falls through. And it's not illegal. I've bought several cars this way and never had problem getting financed. But there are unscrupulous dealers who do spot delivery knowing the customer won't be approved just so they can stick them with higher rates and more money.

    Okay I read up on the story a bit more and it seems the dealer did offer to give the Jeep back however nothing was said about the down payment. Without both of those being returned I say no deal.

      Some states its legal to record if only 1 party knows about it..And that could ever be an answering maching picking up a voice mail...Everyone has voice mail these days that is recorded

      This occurred in Michigan, which is a state that requires consent from all parties before recording a phone call. However, I think it becomes legal (but I'm not a lawyer!) if one party were to say at the start of the conversation or before beginning to record that s/he will be recording what follows and anyone who doesn't give consent should hang up immediately. You've probably received tele-marketer calls before that start out with an automated voice saying the call is being recorded. Giving that notification is required for legal reasons.

    I bought a 2015 Mazda3 and the next day and elk hit my car, everything with my insurance went thru and the dealer used my approval to put me into a new Mazda but the bank got my paperwork late and rescinded my loan. I was so afraid I'd have to give the car back. Thank Heavens another bank already approved me which was even more weird bc the day i set up my account and finalized my loan, I got a letter of denial from them.

    Right Toyota did this to me sold me a used Mitsubishi Galant after a month they call me and tell me I didn't get approved on my credit rating which they checked when I was in the dealership buying the car told me I wasn't approved for a used Mitsubishi at a Toyota dealership but I'm approved for a brand new Corolla with 10 miles on it scams and I also told me if I don't bring the car back that help call the police department have me arrested for Grand Theft don't buy cars from dealerships it's not worth it you get ripped off and you get the same product as a car that's 2 years old that you're buying from AutoNation or budget or Enterprise or Craigslist

    Suppose a person has good credit so to speak😔and they decide to sell the car to them,, they pull off the lot, get into an accident that totals their car and kills them....😶they had no co-signer because of their so called ' perfect credit'.....now, who pays the remaining price of the loan?????another government bail out perhaps????😒my point is,, is that good or bad credit is bullshyt...you can't control what happens in life....most of these car "stealerships" were bankrupt to begin with, when they borrowed from banks to open up their lots.......so you see, a person with good credit is still at risk for not paying back those loans either😶this is what causes the car dealers to go further into the bankruptcy they know they already had to begin with.😒...if they just sell cars at reasonable prices that people could afford, that wouldn't happen. Cheaters never win.....

    Never finance through dealerships with the possible exception of 0% offers through manufacturers. You only talk the bottom line price for the vehicle you are purchasing. Period. Have your financing preapproved and do your research. Never trade in if possible and if you do don't talk about it until you have agreed on a price for the vehicle your want. This is when all the "creative math" starts to happen. Always look for hidden charges. I caught a dealer charging double for title and registration fees along with all sorts of "administrative" fees. Call your DMV and ask what fees are supposed to be charged. NEVER ANSWER THE QUESTION "HOW MUCH CAN YOU AFFORD PER MONTH?". That's your business, not theirs.That's when the crazy math starts again. I hate car dealers and eat them for lunch when I go to one.

      I agree with most of what you said however with regards to the trade in it is actually better to do so because you pay tax after they take off your trade-in value. At least that's how it works in Ontario.

    This is why for my first car, I’m going to pay cash, and to ensure that I am getting a good deal, and no one is going to try and repo it, I’m going to buy from a private party, not a dealer, and request that I see the title before I buy, I can look at it and if I see more than just the sellers signature, or they dance around the subject, I can say, this isn’t going to work, and walk away.

    There is a lot of info missing from this story. I sold cars for a vw dealer. We had people that tried or did get financing at multiple dealers the same day. The bank would approve the loan and get more info later... they have the right not to write a check to the dealer if they back out of financing. This puts the dealer in the position of... the car has not been paid for and is not in their possession, after a reasonable amount of time can be repoed and miles driven withheld from any down-payment. This might sound bad, but people canbe shady on both sides of the deal not just the dealer. Thay

    I had something similar happen. I went out and bought a late model used car from a well known dealership. Even though my credit was ok and I had obtained on my own what was suppose to be pre-approved financing through my bank the loan fell through around a week later. Why? The dipshit company I have worked for around 10 years refused to verify my employment. Why? I don't know. That's just how they are. If someone calls to verify your employment they give you some third party number to call which charges you a fee to verify it. This went on for around 3 weeks and finally I was able to get it straightened out. Moral of the story, don't drive a car off the lot until you are 100% certain the financing is straight and your insurance is transferred over to the new car.

    if your financing is rejected, you no longer have the finannce, and thus the car was never owned by the buyer, hense, the buyer has to returnt he product otherwise they woul dbe giving it away fro free

    Normally you don't get the car unless you get approved. Unless you fail to pay the loan back no car.

    this happens when you have bad credit or no credit. pay your bills on time from the age 18 till life. don't co sign for no one, not even your parents, wife, girl friend . when you do that you just put your credit at risk

      Daniel Garcia This has nothing to do with bad credit. This is a scam many car lots pull. They don't try to get you approved. They have it set up were you lose your down payment and trade in if finance doesn't go through.
