I'm a frusciante guy and I just ordered the empyrean. You aren't alienating anyone by branching out brother. Do what you're inspired to do! Thank you for making such great products. I'm excited to see what you do next.

As a small business owner for 10 years, who has done several product launches, my advice would be for future pedal releases, focus on one lane, either the chunky vintage repro, or the the newer modern smaller footprint ones you mentioned.
Can't the pedal 'guts' for the DME with a different enclosure still be produced? Or does the whole thing need to stop being made? If it has to stop being made, that'd be a shame. Keep up the good work!
To be straight with you, they are well within their right for the C&D and if I owned EHX I would probably do the same. It's one thing to mimic or mod the electronics. But when the design starts also looking like the original, that's starting to cross the line of plagiarism. Watching China steal so much IP from other countries and get away with it has really hurt a lot of businesses over the years and we need to go back to protecting the original designers. I know many corporations abuse their power over trivial stuff and bully the little guy but I see this as a fair request from them. It's one of their original and most marketable pedals and they are a successful company because they have been able to protect their innovations for decades. It's changes a bit if Moog came after you as they chose to discontinue their product, so you could argue you aren't hurting their sales. What would be cool is if you could come up with your own modern design that makes it truely unique. Just my two cents, but don't let that stop your great work.
Thanks for your honest opinion 🙏 I'm happy that a lot of people have been supportive over this with comments/messages but I was hoping to hear more dissenting arguments as well. I'm obviously not as well versed as I should be when it comes to trade dress/IP infringement. I did this with the understanding that these fonts are available for use. And based on the email I got from EHX, it seems like the word "deluxe" was their biggest point of contention with the enclosure's design. And on its own, I didn't think there could be anything wrong using a common word like Deluxe. Anyways, I've been leaning towards a more original direction anyways so this was a good wake up call for me!
@ Using the name deluxe along with that colour scheme and design is just too close to the original. Theres a reason you never see any amp clones or VST amp modellers use the same name without licensing. EHX don’t own the word “deluxe” obviously, but it’s used in conjunction with their trademarked product and there are plenty of lawsuits that have favoured the original designer. I’ve always known EHX to be quite reasonable to deal with though so I think this will be the end of the complaint. You live, you learn and I guess you can pat yourself on the back that they felt your product worthy of a call to their lawyers.

What a pile of BS! Like everyone hasn't been cloning their stuff for the past 50 years, and nobody thinks this was an EHX pedal
