As a Patent Agent from India, I can only say, if US startups file their first patent in India, they can save thousands of dollars. Cost of patent services in India is much lower than the US, and the Indian government gives an 80% discount on patent filings for startups. Also, you can get a professionally drafted application drafted and files for less than 1000 dollars. Also, PCT filings from India also cost less. So, if you are a US startup, make a subsidiary in India (Good cities: Gurugram, Bangalore, Hyderabad, Pune) and file all your applications from India. This will save you millions of dollars in building your patent portfolio. Also, engineer salaries in India are much lower in India. By the way, many US law firms anyway outsource a lot of the work to India, so we have a large workforce that can draft patent applications for US and EP jurisdictions. Also, most of the patent searching is done in India. I.e., Build your R&D in India and first file in India and then take it to the world.
As if Indians are going to buy software products designed for the American wallets. Parent protection only works under the jurisdiction that the inventor had applied to.
I agree with Elon Musk about patents. They suppress innovation. The best way to protect your IP is to innovate faster than the competition, that's what Tesla does. If software, Hardware or any solution is superior to the competition, you will win.
Thanks for this video. I was in the process of looking for an IP lawyer to try to patent my idea, but I think it will be a waste of money at this point since the idea most likely is not patentable anyway.
@@phoneywheeze it's just a really nuanced subject. In fact there's a whole specialisation called intellectual property law that deals with people being diddled out of their rights for not filing proper protections, so a simple "you don't need a patent" is bound to lead a bunch of people straight into some lawyer's arms at some point. And I'm willing to go so far as to say those rights and protections are needed as much for creating software as they are for making heavy machinery (someone else's comment I read earlier). Just because a big tech company doesn't sue a rival for copying their idea, doesn't mean they aren't protected, or that they can't sue. They may have business reasons for not wanting to draw attention to the issue. Anyway I could go on but I really shouldn't. Not sure why TH-cam recommended this video to me, but I suppose I needed the light relief hahaha
@@AdrianMark thanks a lot for the detailed answer. I had an IP subject for 1 semester in my college, but all I could remember is patent goes over the process, they didn't teach us about product patents. Your explanation about not suing over business relations makes a lot of sense. Also I feel a lot IP stuff isn't black and white so it's probably best to take all precautionary steps. Hope your business grows
@@phoneywheeze thanks mate, though I think my comment has disappeared for some reason. Yeah, play smart and get advice when you need it, ideally from someone qualified. All the best to you too.
Nah mate. If you invest years of your life in a craft and you end up building something so good, and so refined that it ultimately makes so much sense for anyone that stumbles upon it and seems simple because of how refined it is… it should be patentable.
@@ryan.a 10k is a bit high in most countries, but it still makes sense if you could still turn a profit in any of those countries. Otherwise, infringement means you'll have to turn over all your accrued profits to the patent owner (even if they filed the patent after you started selling hahaha now there's a business model for you!) Or, well, you could just raw dog it and hope for the best 😂
I understand your point, thanks for sharing your thoughts. It's just ridiculous for an individual like me investing money in paperwork instead of actually developing my ideas.
@@ryan.a that's certainly fair. All I'm saying is that if you become profitable, take the steps you can to secure yourself, and get good advice. It will be worth it down the line. All the best with your business.
Google made a mistake when it patented the1-click Buys. They should have patented 2-click, 3-click, 4-click, ... 17-click buys as well. Leaving royalty-free only the 18-click buys and above, crippling the entire e-commerce industry before it was even really matured. All patents are bs.

Lol no one wants to work in that cow worshipping hole

In general, you don't file a patent to sue competition. You file a patent so competition doesn't file a patent and then sue you.
Love it! I'm so tired of explaining this to non-technical cofounders and those who are oblivious. Now I can just send them this video!

Ideas are like opinions, everyone has one. It's not patentable because it's just an idea but it might be if you executed on it.
Patents make no sense because they build a legal fence! 🚧📜
Aren't you the guy I was chatting with in the Panama City airport lounge on Monday night?? How random!
Copa Lounge! TH-cam algorithm is crazy!
As a lawyer, I am grateful for all the future business you are providing to my industry 😂
didn't understand that, is the video wrong?

Clicked the video because I saw HDR video in the preview in the feed. Awesome work.
First time we hear of an earned click because of HDR! Thanks!!
Yeah! That's why the video seems brighter than the rest of the youtube in my browser!
Very insightful. A recommended "must watch"
I agree with you, Elon Musk says, Patents are for the weak
If you invent something, it should be so complex that replicating it becomes challenging.
Sure, but it's NOT always the case!

You might actually want to file for patent to make sure that you are not infringing on other's patent. Then you can get in the real trouble.
Let's pay 10k per country per year just to be sure then 😏

What about copyrights?
What about your company and image ??
can you do a video about shares classes and voting power?
What about trademark?
Saved me a bundle watching this video 😂
Good to see more creators embracing HDR!
Very great video. Thanks for this
Does like on videos help get more visualizations?
It does :)
Please tell Terrance Howard this 😂

No need to file a patent?
Great video
Software yes but heavy hardware you must.
